Common use of Written Warning Clause in Contracts

Written Warning. Written warnings consist of a discussion between the employee and a supervisor in which the supervisor explains in detail the reasons for the warning and then provides a written disciplinary notice to the employee of the action required to correct the unsatisfactory performance, the time allowed for improvement and the consequences, including dismissal, for future violations or failure to improve.

The Employer and the employee may set a time frame and a supervisor check-in program, during which the supervisor explains improvement must be made and maintained in detail accordance with the reasons for terms of the warning and then provides a written disciplinary notice to the employee and/or any plan for improvement. A record of the action required to correct written warning and any improvement plan shall be kept in the unsatisfactory performance, the time allowed for improvement and the consequences, including dismissal, for future violations or failure to improveemployee’s personnel file.
