(f) When an elementary building has custodial services supplied to it with a combination of a third shift custodian and the assignment of a school helper (i.e., K-3 buildings), said building will have the following option: If the building principal and/or the building’s site-based team requests the night custodian to modify his/her hours, such modification can be made provided the building leadership and the custodian have mutually agreed to the change. (g) When the District declares a snow day and cancels all school-related activities, all custodial employees can work the day shift. In addition, custodial employees can work on the day shift on the two (2) days per day at regular rateyear when schools are closed and when teaching staff is given “comp time.” These days designated as comp time for conferences shall be designated by the School District and communicated to bargaining unit employees.

(6) Less than 237 day employees interested in working during the summer shall notify the Assistant Superintendent of Employee Services in writing by May 1 of their interest and availability. Working Hours. 10.01 A normal workweek 10.1. If an insufficient number of qualified volunteers are found within the team, the Employer will ordinarily select qualified volunteers from the overtime sign-up sheets within the buildings, taking into consideration the skills and ability to perform the overtime work. If an insufficient number of qualified volunteers are found from the team’s and buildings’ sign-up sheets, the Employer has the right to require overtime work of other employees as provided by the Agreement. An employee who volunteers for and accepts an overtime assignment, or an employee who is otherwise assigned overtime work, and fails to report for the overtime work as scheduled will receive either a Manager sick or Director prior to its occurrence except in cases of emergency wherein a supervisor may approve such required overtimetardy attendance incident. Working Hours. 10.01 A normal workweek A. Under the AWS, employees on the 3/12 plan who are off for one full working day shall be reported as follows: Monday off for 12 hours. Employees on the 4/10 plan who are off for one full working day shall be reported as off for 10 hours. Employees on the 9/80 plan who are off for one full working day shall be reported as off for nine hours. Employees on the 5/40 plan who are off for one full working day shall be reported as off for 8 hours. G. When an employee is assigned to Saturday: threeattend training and the training is less than 12 hours for employees on a 3/12 schedule, or less than 10 hours for employees on a 4/10 schedule, or less than 9 hours on a 9/80 schedule, the employee shall promptly return to his/her division and work the remaining hours, or use vacation time or accumulated time off to cover the remaining hours, subject to advance management approval. At the discretion of the Commanding Officer of Jail Division or his or her designee, and after considering the impact on the Section’s ability to adequately deploy personnel and accomplish its mission, the employee may work the remaining hours during the same DP. H. Employees working the 3/12 schedule shall not engage in any outside employment within twenty-quarters four hours of beginning such shift or on a regularly scheduled work day. In accordance with LAPD Manual Section 3/744, any outside employment must first be approved by the Department. I. Rest periods will be taken at the employee’s work site or other appropriate area as designated by the employee’s supervisor. 8.9 Rest periods are a part of the regular work day and shall be compensated at the regular rate of pay for the employee as provided herein. 8.10 Notwithstanding the rest period provisions as set forth above, an evening or special work shift employee, upon mutual agreement between the District and the employee, may waive his/her rest period and extend his/her lunch period by one-half (1/2) hour. 8.11 The District shall make existing lunchroom, restroom or lavatory facilities available for employee use. 8.12 If an employee's work schedule is such that it does not allow sufficient time to vote in any federal, state or local election in which the employee is entitled to vote, the District shall arrange to allow reasonable time for voting by the employee without loss of pay. 8.13 All authorized overtime hours as defined in this section shall be compensated at a rate of pay equal to time and one-half (1 ½) the regular rate of pay of the employee for all hours work suffered or permitted. Working Hours. 10.01 A normal workweek 16.1 The regular working day shall consist of thirty-five eight (35) 8) hours on a five (5) day (work, Monday to Saturday) basis for all employees covered in this Agreement. (a) All authorized time worked outside the normal workday or the normal workweek, shall be considered as overtime for all employees who shall receive, at the discretion of the employee, compensation or time off at the rate of time and through Friday including one-half (1½ )1/2) hour paid lunch, which normally will fall between 11:30 and 12:30 hours and the regular work week shall consist of forty (40) hours work. 16.1.1 The work day will be measured from 00:00 hours until 24:00 hours and may be divided into as many regular hour shifts as the Employer may determine. Working Hours. 10.01 A normal workweek A. The Board recognizes the principle of a standard forty (40) hour work week and will set work schedules and make assignments which can be reasonably completed within such standard work week. The Board will not regularly require secretaries to work in excess of such standard workweek. Secretaries shall consist work and be compensated in accordance with the salary schedule in Appendix B. Secretaries shall not work during nor be compensated for the period immediately following their last scheduled day of thirty-five work prior to the restart of the next year. The maximum daily working hours for a non-rostered full time Employee are 10 hours per day. 95. The maximum daily working hours for a rostered full-time Employee are 12 hours per day. 96. Rostered full-time Employees may be required to undertake work in a split shift arrangement of up to 2 shifts on any given day. A regular break for rest or eating meals does not count as a split shift. A split shift may be rostered where the Employee is required to work on separate events each day. Each employee may take a fifteen (15) minutes rest period during each one-half day of work, provided that the rest period shall not interfere with the normal operation of the Employer, and is as scheduled by the Employer. No Union business shall be conducted during paid time unless directed by the Employer. The beginning and end of the work day and work week shall be as scheduled from time to time by the Employer, provided, however, that an employee shall receive reasonable notice of any change in the work schedule. (It is understood that in emergency situations or in snow removal, reasonable advance notice cannot be given.) The Employer will not change the work day or work week without consulting the Union prior to any such changes and will not be arbitrary or capricious with any such change. Section F. Some maintenance and custodial employees may be scheduled for four (4) ten hour work days per day at regular rate Sunday week if the School and Statutory Holidays: the Union can mutually agree Section G. Working Hours. 10.01 A Section 1. The normal workweek office hours are 9:00 a.m. to 5:00 p.m., Monday through Friday, including one hour for lunch. The regular work week is from Monday through Friday, consisting of seven work hours per day and 35 work hours per week. The regular work day may be modified by the Employer to meet the needs of a regional or outreach office. However, the total number of hours in the regular work day and work week shall consist remain the same. Section 2. The pay period shall be bi-weekly. Pay day shall be the Thursday following the end of thirtythe pay period. Section 3. Non-five exempt employees are those employees who are covered by the Fair Labor Standards Act (35) FLSA). Exempt employees are those employees to whom FLSA does not apply. a. All non-exempt staff shall report to work no later than 9:00 a.m. and shall work until 5:00 p.m., unless they are working on another schedule as provided for in Section 1 or Section 11 of this Article in which case they must report at their approved starting time and work until the end of their approved work day. The Employer may dock the pay of an affected employee who fails to meet this requirement. In the event that a secretary or substantive paralegal is late by 15 minutes or less, s/he shall be allowed to work an equal amount of time at the end of that day to ensure that a full seven hours are worked that day. Substantive paralegals and secretaries shall, with prior Employer approval, be allowed to adjust their schedule on a five (5) particular day (Monday in order to Saturday) basis for all employees covered in this Agreementmeet program needs. b. Non-exempt staff may apply to the Employer for approval to make up before or after work hours any time not worked during normal office hours due to emergency circumstances. Such approval shall not be unreasonably denied. When possible, the employee must call the Employer to advise of the emergency. Enforcement of this provision shall be fairly applied. c. Non-exempt staff may request approval to attend parent/teacher conferences during the work day and to make up before or after work hours any time not worked. Such approval shall not be unreasonably denied. Section 5. Each employee shall sign in and out on a daily basis on the electronic attendance system, and shall indicate which leave time shall be used for time not worked in any work day and complete the appropriate leave forms. Section 6. All attorneys and substantive paralegals shall submit, by computer, daily activity reports to the Employer on a bi-weekly basis. Section 7. Attorneys are expected to work the hours necessary to fulfill their professional responsibilities and case management requirements, and must use leave time for any day they work less than 7 hours. Attorneys must send an email to relevant parties when program activities require them to be out of the office at the beginning of the next day, including their destination, or call in with this information. Attorneys must receive prior approval from their supervisor to work out of the office. An attorney with at least 90 work hours (anot including lunch) All authorized in a pay period will not be required to use leave time worked outside the normal workday for any day in that pay period or the normal workweek, following pay period in which the attorney worked at least five hours. Hours worked at home cannot be counted towards the seven hours per day or the 70 hours per pay period. Section 8. In certain instances the program's obligations to clients will include the need for secretarial and other support services. Non-exempt employees may be asked to work other than during the regular work day to meet this need. Overtime shall be considered as voluntary for any individual unless no one else capable of doing the necessary job is available. Section 9. Non-exempt employees shall be paid overtime for all employees who shall receive, at the discretion of the employee, compensation or time off at the rate of time and onetime-and-a-half (1½ )for work over 7 hours per day and 35 hours per week. All Non-exempt employees must obtain prior approval from the Employer to work overtime. Failure to obtain prior approval will result in disciplinary action. Section 10. Attorneys will earn compensatory time off only with the prior approval of the Employer. The Employer will approve compensatory time for attorneys required to attend professional trainings, client trainings, resource fairs, professional meetings, and other work related activities on weekends and holidays. Prior approval must be taken within ninety (90) days received from the Employer to use accrued compensatory time. Payment will not be made for accrued compensatory time at termination of employment. Section 11. Any employee may submit a request for "flextime" in writing to the occurrence of overtime and must be Employer for approval to work on a date (flexible schedule which differs from regular office hours. Flextime means beginning and ending a work day earlier than regular work hours or dates) mutually agreed upon by beginning and ending a work day later than regular work hours. However, the employee total number of hours in the regular work day and regular work week shall remain the supervisorsame. (b) All overtime work Section 12. When reviewing for approval requests for flextime, consideration shall be approved by a Manager or Director prior given to its occurrence except in cases of emergency wherein a supervisor may approve such required overtime. (c) For the purposes of this Agreement, the terms “normal workday” and “normal workweek” shall be interpreted to mean the work schedules as currently existing or modified as required, save and except employees required to work under the provisions of Article 10.05. 10.03 No employee shall receive both overtime payment and shift premium for the same hours worked. No employee shall be required to take time off during an employee's regular scheduled hours for the purpose of avoiding overtime payment. The supervisor and the employee may agree to a split shift if the scheduling is mutually agreeable. (a) Employees who work seven (7) hour shifts called in to work outside of their regularly scheduled hours shall be entitled to time and one-half (1 ½) for all hours worked with a minimum of four and one half (4½) hours pay at straight time rates. This provision shall apply only where an employee has completed the regular shift that day and it is further understood that where such period overlaps and extends into the employee's next regularly scheduled shift, personal needs in addition to the employee economical and efficient operations of the office. Approval of such requests shall be paid only fairly applied. Section 13. All employees are required to sign out on the daily attendance record any time that they leave the office during the regular work day, to indicate their destination, and one-half (1 ½) to sign in when they return. Absence from the office during the regular work day other than for a lunch break or for activities related to the commencement of such shift. Callback does not apply employee's job require prior notice to scheduled split shiftsand approval from the Employer. (b) As an integral part of some employees’ job responsibilities there is requirement to serve stand-by assignments. During such assignments the employee(s) must carry the required “paging unit” or other approved communications equipment and must be available for call-in via the “paging unit” or communications equipment.
