Common use of VERIFICATION OF LICENSES, CREDENTIALS AND OTHER DOCUMENTS Clause in Contracts

VERIFICATION OF LICENSES, CREDENTIALS AND OTHER DOCUMENTS. CONTRACTOR shall submit to LEA a staff list, and copies of all current licenses, credentials, certifications, permits and/or other documents which entitle the holder to provide special education and/or related services by individuals employed, contracted, and/or otherwise hired or sub-contracted by CONTRACTOR. CONTRACTOR shall ensure that all licenses, credentials, permits or other documents are on file at the office of the County Superintendent of Schools. CONTRACTOR shall provide the LEA with the verified dates of fingerprint clearance, Department of Justice clearance and Tuberculosis Test clearance for all employees, approved subcontractors and/or volunteers prior to such individuals starting to work with any student. CONTRACTOR shall monitor the status of licenses, credentials, certifications, permits and/or other documents for all individuals employed, contracted, and/or otherwise hired by CONTRACTOR. CONTRACTOR shall notify LEA and CDE in writing within forty-five (45) days when personnel changes occur which may affect the provision of special education and/or related services to LEA students. CONTRACTOR shall notify LEA within forty-five (45) days if any such licenses, certifications or waivers are expired, suspended, revoked, rescinded, challenged pursuant to an administrative or legal complaint or lawsuit, or otherwise nullified during the effective period of this Master Contract. The LEA shall not be obligated to pay for any services provided by a person whose such licenses, certifications or waivers are expired, suspended, revoked, rescinded, or otherwise nullified during the period which such person is providing services under this Master Contract. Failure to notify the LEA and CDE of any changes in credentialing/licensed staff may result in suspension or revocation of CDE certification and/or suspension or termination of this Master Contract by the LEA.

The LEA shall not be obligated to pay for any services provided by a person whose such licenses, certifications or waivers are expired, suspended, revoked, rescinded, or otherwise nullified during the period during which such person is providing services under this Master Contract. Failure to notify the LEA and CDE of any changes in credentialing/licensed staff may result in suspension or revocation of CDE certification and/or suspension or termination of this Master Contract by the LEA.

CONTRACTOR shall notify the CDE and the LEA in writing as specified in the LEA Procedures and CDE in writing within forty-five (45) days when personnel changes occur which may affect the provision of special education and/or related services to LEA pupils as specified in the LEA Procedures. Notwithstanding the foregoing, if current license or credential documents are not available through no fault of the NPS/A, timely application having theretofore been made, this Master Contract shall remain in effect until such documents are made available to the NPS/A from the Consumer Affairs Department or the Commission on Teacher Credentialing. The NPS/A shall in turn submit copies of same to the LEA within five (5) business days of receipt by the NPS/A. CONTRACTOR shall monitor the status of licenses, credentials, permits and/or other documents for all individuals employed, contracted, and/or otherwise hired by CONTRACTOR to provide special education services to LEA students. CONTRACTOR shall notify provide to LEA within forty-five (45) days if any such updated information regarding the status of licenses, certifications or waivers are expiredcredentials, suspended, revoked, rescinded, challenged pursuant permits and/or other documents as specified in LEA Procedures. CONTRACTOR will be considered to an administrative or legal complaint or lawsuit, or otherwise nullified during the effective period be in breach of this Master Contract. The LEA shall not be obligated to pay contract for any services service provided by a person whose an unqualified provider or one who has an expired credential. In such licensesan event, certifications or waivers are expired, suspended, revoked, rescinded, or otherwise nullified during the period which such person is providing services under this Master Contract. Failure to notify provider shall be paid at 70% of the LEA and CDE of any changes in credentialing/licensed staff may result in suspension or revocation of CDE certification and/or suspension or termination of this Master Contract by the LEAagreed upon rate.

Failure to notify the LEA and CDE of any changes in credentialing/licensed staff may result in suspension or revocation of CDE certification and/or suspension or termination of this Master Contract by the LEA.

CONTRACTOR shall notify LEA and CDE in writing within forty-five thirty (4530) days when personnel changes occur which may affect the provision of special education and/or related services to LEA students. CONTRACTOR shall notify LEA within forty-five (45) days if any such licenses, certifications or waivers are expired, suspended, revoked, rescinded, challenged pursuant to an administrative or legal complaint or lawsuit, or otherwise nullified during the effective period of this Master Contract. The LEA shall not be obligated to pay for any services provided by a person whose such licenses, certifications or waivers are expired, suspended, revoked, rescinded, or otherwise nullified during the period during which such person is providing services under this Master Contract. Failure to notify the LEA and CDE of any changes in credentialing/licensed staff may result in suspension or revocation of CDE certification and/or suspension or termination of this Master Contract by the LEA.

CONTRACTOR PROVIDER shall submit to LEA the SELPA a staff list, and copies of all current licenses, credentials, certifications, permits and/or other documents which entitle the holder to provide special education and/or related services by individuals employed, contracted, and/or otherwise hired or sub-contracted subcontracted by CONTRACTORPROVIDER. CONTRACTOR PROVIDER shall ensure that all licenses, credentials, permits or other documents are on file at the office Ventura County Office of the County Superintendent of SchoolsEducation. CONTRACTOR shall provide the LEA with the verified dates of fingerprint clearance, Department of Justice clearance and Tuberculosis Test clearance for all employees, approved subcontractors and/or volunteers prior to such individuals starting to work with any student. CONTRACTOR shall monitor the status of licenses, credentials, certifications, permits and/or other documents for all individuals employed, contracted, and/or otherwise hired by CONTRACTOR. CONTRACTOR PROVIDER shall notify LEA and CDE the SELPA in writing as specified by CDE within forty-five thirty (4530) days when personnel changes occur which may affect the provision of special education and/or related services to LEA students. CONTRACTOR PROVIDER shall provide the LEA with the verified dates of fingerprint clearance, DOJ clearance and Tuberculosis Test clearance for all employees, approved subPROVIDERs and or volunteers prior to such individuals starting to work with any student. PROVIDER shall notify VCOE and CDE in writing within thirty (30) days when personnel changes occur which may affect the provision of special education and/or related services to LEA students. PROVIDER shall notify VCOE/LEA within forty-five thirty (4530) days if any such licenses, certifications or waivers are expired, suspended, revoked, rescinded, challenged pursuant to an administrative or legal complaint or lawsuit, or otherwise nullified during the effective period of this Master ContractAgreement. The VCOE/LEA shall not be obligated to pay for any services provided by a person whose such licenses, certifications or waivers are expired, suspended, revoked, rescinded, or otherwise nullified during the period during which such person is providing services under this Master ContractAgreement. Failure to notify the LEA VCOE and CDE of any changes in credentialing/licensed staff may result in suspension or revocation of CDE certification and/or suspension or termination of this Master Contract Agreement by the VCOE/LEA. SIRAS user accounts shall not be activated or renewed until verification that all required documents and information have been verified by the PROVIDER administrator or designee. User accounts must be closed by PROVIDER within five (5) days of employee separation.

CONTRACTOR shall notify LEA and CDE in writing within forty-five (45) days when personnel changes occur which may affect the provision of special education and/or related services to LEA students. CONTRACTOR shall notify LEA within forty-five (45) days if any such licenses, certifications or waivers are expired, suspended, revoked, rescinded, challenged pursuant to an administrative or legal complaint or lawsuit, or otherwise nullified during the effective period of this Master Contract. The LEA shall not be obligated to pay for any services provided by a person whose such licenses, certifications or waivers are expired, suspended, revoked, rescinded, or otherwise nullified during the period in which such person is providing services under this Master Contract. Failure to notify the LEA and CDE of any changes in credentialing/licensed staff may result in suspension or revocation of CDE certification and/or suspension or termination of this Master Contract by the LEA.

At LEA request, CONTRACTOR shall submit to LEA a staff list, and copies of all current licenses, credentials, certifications, permits and/or other documents which entitle the holder to provide special education and/or related services by individuals employed, contracted, and/or otherwise hired or sub-contracted by CONTRACTORCONTRACTOR for LEA. CONTRACTOR shall ensure that all licenses, credentials, permits or other documents are on file at notify LEA in writing within thirty (30) days when personnel changes occur which may affect the office provision of special education and/or related services to LEA students as specified in the County Superintendent of SchoolsLEA Procedures. CONTRACTOR shall provide the LEA CDE with the verified dates of fingerprint clearance, Department of Justice clearance and Tuberculosis Test clearance for all employees, approved subcontractors and/or volunteers prior to such individuals starting to work with any student. CONTRACTOR shall monitor the status of licenses, credentials, certifications, permits and/or other documents for all individuals employed, contracted, and/or otherwise hired by CONTRACTOR. CONTRACTOR shall provide to CDE updated information regarding the status of licenses, credentials, permits and/or other documents within than 45 days of known changes. CONTRACTOR shall notify LEA and CDE in writing within forty-fourty five (45) days when personnel changes occur which may affect the provision of special education and/or related services to LEA students. CONTRACTOR shall notify LEA within forty-five (45) days if any such licenses, certifications or waivers are expired, suspended, revoked, rescinded, challenged pursuant to an administrative or legal complaint or lawsuit, or otherwise nullified during the effective period of this Master Contract. The LEA shall not be obligated to pay for any services provided by a person whose such licenses, certifications or waivers are expired, suspended, revoked, rescinded, or otherwise nullified during the period during which such person is providing services under this Master Contract. Failure Consistent failure to notify the LEA and CDE of any major changes in credentialing/licensed staff may result in suspension or revocation of CDE certification and/or suspension or termination of this Master Contract by the LEA.

The LEA shall not be obligated to pay for any services provided by a person whose such licenses, certifications or waivers are expired, suspended, revoked, rescinded, or otherwise nullified during the period during which such person is providing services under this Master Contract. Failure to notify the LEA and CDE of any changes in credentialing/licensed staff may result in suspension or revocation of CDE certification and/or suspension or termination of this Master Contract by the LEA.

CONTRACTOR shall monitor the status of licenses, credentials, certifications, permits and/or other documents for all individuals employed, contracted, and/or otherwise hired by CONTRACTOR. Welligent user accounts shall not be activated or renewed until verification that all required documents and information have been entered by the CONTRACTOR’s administrator or administrative designee. CONTRACTOR shall upload in Welligent all staff information required to document that CONTRACTOR’s staff members are authorized to provide special education and/or related services. CONTRACTOR shall ensure that all licenses, credentials, permits, certifications, or other documents which entitle the holder to provide special education and/or related services by individuals employed, contracted, and/or otherwise hired by CONTRACTOR are current and valid with the California Commission on Teacher Credentialing (CTC) and/or other licensing authority. The District shall not approve payment to CONTRACTOR for special education and/or related services specified on a Register of Daily Attendance or Monthly Service Log signed by a staff member whose Welligent user account information is not current (e.g., containing uploaded, current license/credential, TB and DOJ information) until the current information is uploaded. CONTRACTOR shall notify LEA and CDE in writing within forty-five (45) business days when personnel changes occur which may affect the provision of special education and/or related services to LEA studentsstudents as required in Welligent. CONTRACTOR shall notify LEA within forty-five (45) business days if any such licenses, certifications certifications, or waivers are expired, suspended, revoked, rescinded, challenged pursuant to an administrative or legal complaint or lawsuit, or otherwise nullified during the effective period of this Master Contract. The LEA District shall not be obligated to pay for any services provided by a person whose such licenses, certifications or waivers are expired, suspended, revoked, rescinded, or otherwise nullified during the period during which such person is providing services under this Master Contract. Failure to notify the LEA and CDE of any changes in credentialing/licensed staff within forty-five (45) business days may result in suspension or revocation of CDE certification and/or suspension or termination of this Master Contract by the LEALEA or the CDE may suspend or revoke CONTRACTOR’S certification. Any nonpublic agency per diem Speech and Language or Occupational Therapy service provider must hold a license or credential that does not require supervision by another professional. As such, Speech-Language Pathology Assistant (SLPA) or Occupational Therapy Assistant (XXXX) licenses are not sufficient for provision of per diem services and any per diem services provided by holders of such licenses shall not be payable as part of this Master Contract. When CONTRACTOR is a nonpublic school, providers with Speech-Language Pathology Assistant (SLPA) and/or Occupational Therapy Assistant (XXXX) licenses shall document service provision in Welligent using their own provider Welligent account(s).

VERIFICATION OF LICENSES, CREDENTIALS AND OTHER DOCUMENTS. CONTRACTOR shall submit to SELPA/LEA a staff list, list and copies of all current licenseslicenses and required certifications, credentials, certifications, permits and/or other documents which entitle the holder to provide special education and/or related services by CONTRACTOR and all individuals employed, contracted, and/or otherwise hired or sub-contracted by CONTRACTOR. CONTRACTOR shall ensure that all licenses, certifications, credentials, permits or other documents are on file at the office of the County Superintendent of Schools. CONTRACTOR shall provide notify SELPA in writing within thirty (30) days when personnel changes occur which may affect the provision of special education and/or related services to students as specified in the LEA with Procedures. CONTRACTOR shall maintain and make available upon request to the SELPA the verified dates of fingerprint clearance, Department of Justice clearance and Tuberculosis Test clearance for all employees, approved subcontractors and/or volunteers prior to such individuals starting to work with any student. CONTRACTOR shall monitor the status of licenses, certifications credentials, certifications, permits and/or other documents for CONTACTORS and all individuals employed, contracted, and/or otherwise hired by CONTRACTOR. CONTRACTOR shall immediately, and in no circumstances longer than five (5) business days provide to SELPA/LEA updated information after learning of a change in status of licenses, certifications, credentials, permits and/or other documentation changes. CONTRACTOR shall notify SELPA/LEA and CDE in writing within forty-five (45) days when personnel changes occur which may affect the provision of special education and/or related services to LEA students. CONTRACTOR shall notify LEA within forty-five (45) days if in any such licenses, certifications or waivers are expired, suspended, revoked, rescinded, challenged pursuant to an administrative or legal complaint or lawsuit, or otherwise nullified during the effective period of this Master Contract. The LEA shall not be obligated to pay for any services provided by a person whose such licenses, certifications certification or waivers are expired, suspended, revoked, rescinded, or otherwise nullified during the period which such a person is providing services under this Master Contract. Failure to notify the LEA LEA/SELPA and CDE of any changes in credentialing/licensed staff may result in suspension or revocation of CDE certification and/or suspension or termination of this Master Contract by the LEA.Contract. CONTRACTOR shall provide the LEA CDE with the verified dates of fingerprint clearance, Department of Justice clearance and Tuberculosis Test clearance for all employees, approved subcontractors and/or volunteers any employee or SUBCONTRACTOR prior to such individuals person’s starting to work with any student. CONTRACTOR shall monitor the status of licenses, credentials, certifications, permits and/or other documents for all individuals persons employed, contracted, subcontracted, and/or otherwise hired by CONTRACTORCONTRACTOR to provide services pursuant to this Agreement. CONTRACTOR shall notify LEA and provide to CDE in writing within forty-five (45) days when personnel changes occur which may affect updated information regarding the provision status of special education and/or related services to LEA students. CONTRACTOR shall notify LEA within forty-five (45) days if any such licenses, certifications credentials, permits and/or other documents concerning such persons’ or waivers are expired, suspended, revoked, rescinded, challenged pursuant CONTRACTOR’s ability to an administrative or legal complaint or lawsuit, or otherwise nullified during the effective period provide such services within 45 days of this Master Contractknown changes. The LEA shall not be obligated to pay for any services provided by a person whose such licenses, certifications or waivers are expired, suspended, revoked, rescinded, or otherwise nullified during the period during which such person is providing services under this Master ContractAgreement. Failure Consistent failure to notify the LEA and CDE of any major changes in credentialing/licensed staff may result in suspension or revocation of CDE certification and/or suspension or termination of this Master Contract Agreement by the LEA.

CONTRACTOR shall notify Shasta SELPA/District of Residence in writing within thirty (30) days when personnel changes occur which may affect the provision of special education and/or related services to students as specified in the Shasta SELPA/District of Residence Procedures. CONTRACTOR shall provide the LEA Shasta SELPA/District of Residence with the verified dates of fingerprint clearance, Department of Justice clearance and Tuberculosis Test clearance for all employees, approved subcontractors and/or volunteers prior to such individuals starting to work with any student. CONTRACTOR shall monitor the status of licenses, credentials, certifications, permits and/or other documents for all individuals employed, contracted, and/or otherwise hired by CONTRACTOR. CONTRACTOR shall notify LEA Shasta SELPA/District of Residence and CDE in writing within forty-five (45) days when personnel changes occur which may affect the provision of special education and/or related services to LEA Shasta SELPA/District of Residence students. CONTRACTOR shall notify LEA Shasta SELPA/District of Residence within forty-five (45) days if any such licenses, certifications or waivers are expired, suspended, revoked, rescinded, challenged pursuant to an administrative or legal complaint or lawsuit, or otherwise nullified during the effective period of this Master Contract. The LEA Shasta SELPA/District of Residence shall not be obligated to pay for any services provided by a person whose such licenses, certifications or waivers are expired, suspended, revoked, rescinded, or otherwise nullified during the period during which such person is providing services under this Master Contract. Failure to notify the LEA Shasta SELPA/District of Residence and CDE of any changes in credentialing/licensed staff may result in suspension or revocation of CDE certification and/or suspension or termination of this Master Contract by the LEA.

CONTRACTOR shall notify the County Superintendent SELPA in writing as specified by CDE within thirty (30) days when personnel changes occur which may affect the provision of Schoolsspecial education and/or Related Services to LEA students. CONTRACTOR shall provide the LEA with the verified dates of fingerprint clearance, Department of Justice DOJ clearance and Tuberculosis Test clearance for all employees, approved subcontractors and/or and or volunteers prior to such individuals starting to work with any student. CONTRACTOR shall monitor the status of licenses, credentials, certifications, permits and/or other documents for all individuals employed, contracted, and/or otherwise hired by CONTRACTOR. CONTRACTOR shall notify LEA and CDE in writing within forty-five (45) days when personnel changes occur which may affect the provision of special education and/or related services Related Services to LEA students. CONTRACTOR shall notify SELPA/LEA within forty-five (45) days if any such licenses, certifications or waivers are expired, suspended, revoked, rescinded, challenged pursuant to an administrative or legal complaint or lawsuit, or otherwise nullified during the effective period of this Master Contract. The SELPA/LEA shall not be obligated to pay for any services provided by a person whose such licenses, certifications or waivers are expired, suspended, revoked, rescinded, or otherwise nullified during the period during which such person is providing services under this Master Contract. Failure to notify the SELPA/LEA and CDE of any changes in credentialing/licensed staff may result in suspension or revocation of CDE certification and/or suspension or termination of this Master Contract by the SELPA/LEA. SIRAS user accounts shall not be activated or renewed until verification that all required documents and information have been verified by the CONTRACTOR administrator or designee. User accounts must be closed by CONTRACTOR within 5 days of employee separation.

The LEA (District) shall not be obligated to pay for any services provided by a person whose such licenses, certifications or waivers are expired, suspended, revoked, rescinded, or otherwise nullified during the period which such person is providing services under this Master Contract. Failure to notify the LEA (SCCOE and District) and CDE of any changes in credentialing/licensed staff may result in suspension or revocation of CDE certification and/or suspension or termination of this Master Contract by the LEALEA (SCCOE).
