CLEARANCE REQUIREMENTS. CONTRACTOR shall comply with the requirements of California Education Code section 44237, 35021.1, 35021.2, and 56366.1 including, but not limited to: obtaining clearance from both the California Department of Justice (hereinafter referred to as “CDOJ”) and clearance from the Federal Bureau of Investigation (hereinafter referred to as "FBI") for CONTRACTOR’s employees and volunteers, unless CONTRACTOR determines that the volunteers will have no direct contact with students. CONTRACTOR hereby agrees that CONTRACTOR’s employees and volunteers, unless CONTRACTOR determines that the volunteers will have no direct contact with students shall not come in contact with students until CDOJ and FBI clearance are ascertained. CONTRACTOR shall certify in writing to LEA that none of its employees, and volunteers, unless CONTRACTOR determines that the volunteers will have no direct contact with students, or contractors who may come into contact with students have been convicted of a violent or serious felony as those terms are defined in California Education Code section 44237(h), unless despite the employee’s conviction of a violent or serious felony, he or she has met the criteria to be eligible for employment pursuant to California Education Code section 44237 (i) or (j). Contractor shall certify to LEA that they have successful background checks and enrolled in subsequent arrest notification service for all employees who may come into contact with students. Notwithstanding the restrictions on sharing and destroying criminal background check information, CONTRACTOR, upon demand, shall make available to the LEA evidence of a successful criminal background check clearance and enrollment in subsequent arrest notice service, as provided, for each owner, operator, and employee of the NPS/A. CONTRACTOR is required to retain the evidence on-site, as specified, for all staff, including those licensed or credentialed by another state agency. Background clearances and proof of subsequent arrest notification service as required by California Penal Code section 11105.2 for all staff shall be provided upon request.

Clearance certification shall be submitted to the LEA. In addition, CONTRACTOR shall make a request for subsequent arrest service from the CDOJ as required by California Penal Code section 11105.2.

In addition, CONTRACTOR shall make a request for subsequent arrest service from the CDOJ as required by California Penal Code section 11105.2.

Such CDOJ and FBI clearance shall include a determination that any such person has not been convicted of a violent or serious felony as those terms are defined in California Education Code section 44237(h), unless despite such person’s conviction of a violent or serious felony, he or she has met the criteria to be eligible for employment pursuant to California Education Code section 44237 (i) or (j). In addition, CONTRACTOR shall make a request for subsequent arrest service from the CDOJ as required by California Penal Code section 11105.2 with respect to each such person. CONTRACTOR shall certify in writing to SCUSD that CONTRACTOR has at all times complied with this section of the Master Contract. CONTRACTORS employing or staffing current SCUSD or other school district’s employees must obtain clearance from the CDOJ verified with CONTRACTOR’S ORI (Originating Reporting Agency Identification) number.
CLEARANCE REQUIREMENTS. All employees, volunteers and contract/vendor personnel who work within the department or have access to departmental facilities, staff, clients, systems or confidential and/or financial information are required to undergo a background investigation. CLEARANCE REQUIREMENTS. ‌ It is the customer’s responsibility to know the required clearances for Xxxxx XXX’s secondary conductors and construct the service entrance in order to maintain the these clearances over the life of the service connection. Additional height may be required depending upon the location and type of structure or terrain. If an Engineering Technician is assigned to the project, he can assist in the design and clearance requirements for the service connection. Figures 5 and 6 illustrate other minimum clearances that must be maintained. The Service Expediter can help answer questions regarding clearances as well.

CLEARANCE REQUIREMENTS. Providers are required to adhere to all state and federal laws and regulations pertaining to criminal background checks and child abuse clearances, including, but not limited to, the Pennsylvania Child Protective Services Act, 23 P.S. § 6301 et seq. Providers must complete the attached Criminal Background Check/Child Abuse Clearance Certification Form attached to this agreement. A copy of applicable clearances and checks must be retained by the provider, as OVR expressly reserves the right to review said criminal background checks and/or child abuse clearances at any time throughout the duration of this agreement.
CLEARANCE REQUIREMENTS. Prior to the commencement of instruction the CONTRACTOR shall file with the DISTRICT an affidavit in the form appended to this contract as EXHIBIT B. The affidavit signed under penalty of perjury, that the following procedures have taken place: the CONTRACTOR, each employee, and volunteer of the CONTRACTOR has passed a background check (a)and fingerprint analysis by the California Department of Justice (hereinafter referred to as CDOJ) and, (b) obtained tuberculosis clearance. It is mandated that no person may have contact with students until a clearance from the CDOJ has been obtained. CONTRACTOR shall comply with the requirements of California Education Code sections 44237, 35021.1, 35021.2, Title 5, and California Code of Regulations section 13075(J), unless CONTRACTOR determines that the employees, volunteers, and CONTRACTOR’S will have no physical contact with DISTRICT students. Such CDOJ clearance shall include a determination that any such person has not been convicted of a violent or serious felony as those terms are defined in California Education Code section 44237 (h), unless despite such person’s conviction of a violent or serious felony, he or he has met the criteria to be eligible for employment pursuant to California Education Code section 44237 (i) or (j). In addition, CONTRACTOR shall make a request for subsequent arrest service from the CDOJ as required by California Penal Code section 1105.2 with respect to each such person. CONTRACTOR shall certify in writing to DISTRICT that CONTRACTOR has at all times complied with this section of the AGREEMENT.
CLEARANCE REQUIREMENTS. Staff Members and Immediate Family Members are required to pre-clear all personal securities transactions except for personal securities transactions in Free Trading Securities (notwithstanding, Staff Members should contact the compliance department before trading in any ETF that has a high concentration of Sands Capital-related holdings), those pursuant to an automatic investment plan (including dividend reinvestment plans), and those made within a non-discretionary account. Staff Members must submit pre-clearance requests through Sands Capital’s compliance management system and obtain written Compliance approval prior to engaging in relevant personal securities transactions. Compliance has the discretion to approve or decline any pre-clearance request. Any Compliance pre-approval, if granted, is valid until the end of the day when the pre-clearance request is approved plus the following trading day, unless determined otherwise by the CCO. Pre-clearance requests may be denied for various reasons, including but not limited to, the existence of conflicts of interest or the appearance of conflicts of interest, the security being listed on the Sands Capital restricted list (a confidential list of securities for which personal trading is not permitted), and/or Sands Capital’s possession of material, nonpublic information. Open Windows. Sands Capital allows personal securities transactions during “Open Windows,” which occur monthly, and permits Staff Members to buy and sell equities for the duration of the Open Window. Compliance will communicate the dates of Open Windows to all Staff Members in advance.
