Common use of Vacation; Illness Clause in Contracts

Vacation; Illness. Where an employee's scheduled vacation is interrupted due to serious illness, which commenced prior to and continues into the scheduled vacation period, the period of such illness shall be considered sick leave. An employee making a claim pursuant to this provision shall provide a certificate indicating the nature and duration of the illness. Where an employee s scheduled vacation is interrupted due to a serious illness requiring the employee to be an inpatient in a hospital, the period of such hospitalization shall be considered sick leave. The portion of the vacation which is deemed to be sick leave under the above provision will not be counted against the employee's vacation credits.

Vacation; Illness. (a) It is understood that the Employer may, at its discretion, reschedule vacation for an employee whose vacation would be interrupted by a serious illness, occurring immediately prior to her scheduled vacation. (b) Where an employee's scheduled vacation is interrupted due to serious illness, which commenced prior to and continues into the scheduled vacation period, the period of such illness shall be considered sick leave. An employee making a claim pursuant to this provision shall provide a certificate indicating the nature and duration of the illness. Where an employee s ’s scheduled vacation is interrupted due to a serious illness requiring the employee to be an inpatient in-patient in a hospital, the period of such hospitalization shall be considered sick leaveleave provided that the employee provides satisfactory documentation of the illness and the hospitalization. The portion of the employee’s vacation which is deemed to be sick leave under the above sick leave provision will not be counted against the employee's ’s vacation creditscredit.

The portion of the employee’s vacation which is deemed to be sick leave under the above provision will not be counted against the employee's ’s vacation credits.
