Common use of Vacation and Sick Leave Clause in Contracts

Vacation and Sick Leave. During the Term of Employment, Executive shall be entitled to paid annual vacation periods and sick leave in accordance with the policies of NBTB as in effect as of the Commencement Date or as may be modified by NBTB from time to time as may be applicable to officers of Executive's rank employed by NBTB or its affiliates, but in no event less than four weeks of paid vacation per year.

Vacation and Sick Leave. During the Term of Employment, Executive shall be entitled during the Employment Period to vacation time for each calendar year and such paid annual vacation periods and sick leave as are in accordance with the normal Company policies of NBTB as and practices in effect as of the Commencement Date or as may be modified by NBTB from time to time as may be applicable to officers of Executive's rank employed by NBTB or its affiliates, for senior executives but in no event less than four (4) weeks' vacation; provided, however, that unless otherwise approved in writing by the Board, no more than two weeks of such vacation time may be used consecutively, and provided, further, that any accrued but unused vacation time and paid vacation per yearsick leave remaining at the end of each calendar year shall be forfeited unless otherwise agreed to in writing by the Company and Executive.

Vacation and Sick Leave. During the Term of EmploymentTerm, Executive shall be entitled to paid annual vacation periods and (a) sick leave in accordance with the Company’s policies of NBTB as in effect as applicable to similarly situated executive officers of the Commencement Date or as may be modified by NBTB Company from time to time as and (b) 4 weeks paid vacation each calendar year (up to 40 hours of which may be applicable carried forward to officers of Executive's rank employed by NBTB or its affiliates, but in no event less than four weeks of paid vacation per a succeeding year).

During the Term of EmploymentExecutive’s employment hereunder, Executive shall be entitled to paid annual vacation periods and (a) sick leave in accordance with the Company’s policies of NBTB as in effect as of the Commencement Date or as may be modified by NBTB applicable to its senior executives from time to time as and (b) up to five weeks paid vacation each calendar year (none of which may be applicable carried forward to officers of Executive's rank employed by NBTB or its affiliatesa succeeding year), but which shall be accrued, scheduled and taken in no event less than four weeks of paid accordance with the Company’s vacation per yearpolicy as in effect from time to time.

Vacation and Sick Leave. During the Term of Employment, The Executive shall be entitled to paid annual vacation periods and sick leave in accordance with the policies of NBTB as in effect as of the Commencement Date or as may be modified by NBTB from time to time as may be applicable to officers of Executive's rank employed by NBTB or its affiliates, but in no event less than eligible for four (4) weeks of paid vacation per yearcalendar year (as prorated for partial years). The number of vacation days for which the Executive is eligible shall accrue and be preserved in the manner stated in the Company’s Employee handbook. The Executive shall also be entitled to sick leave and all Company holidays as determined by the Board, on the same terms as similarly situated senior executives of the Company.

The Executive shall be entitled to sick leave each year in amounts consistent with the Company’s policy for all employees.

During the Term of Employment, The Executive shall be entitled to five (5) weeks paid annual vacation periods time per calendar year and such paid sick leave as is in accordance with the normal Company policies of NBTB as and practices in effect as of the Commencement Date or as may be modified by NBTB from time to time as for senior executives; provided, however, that no more than two weeks of such vacation time may be applicable to officers used consecutively, and provided, further, that any accrued but unused vacation time and paid sick leave remaining at the end of Executive's rank employed by NBTB or its affiliates, but in no event less than four weeks of paid vacation per yeareach calendar year shall be forfeited.

Executive will also be entitled to reasonable sick leave in accordance with the policies of NBTB as in effect as of the Commencement Date or as may be modified by NBTB Employer's policy for executives at Executive's grade level from time to time as may be applicable to officers of Executive's rank employed by NBTB or its affiliates, but in no event less than four weeks of paid vacation per yeartime.

The Executive is also entitled to sick leave (without loss of pay) in accordance with the Company’s policies as in effect as of the Commencement Date or as may be modified by NBTB from time to time as may be applicable to officers of Executive's rank employed by NBTB or its affiliates, but in no event less than four weeks of paid vacation per yeartime.

Vacation and Sick Leave. During the Term of EmploymentTerm, Executive shall be entitled to paid annual vacation periods and sick leave in accordance with the policies of NBTB as in effect as of the Commencement Date or as may be modified by NBTB from time to time as may be applicable to officers of Executive's rank employed by NBTB or its affiliates, but in no event less than four weeks of paid vacation per year, or such longer period as may be provided by the Company, in accordance with the plans, policies, programs and practices of the Company applicable to peer corporate executives of the Company generally. Executive shall be eligible for sick leave in accordance with the Company's most favorable practices generally applicable for executives.

Vacation and Sick Leave. During the Term of Employment, Executive shall be entitled to vacation time for each calendar year and such paid annual vacation periods and sick leave as is in accordance with the normal Company policies of NBTB as and practices in effect as of the Commencement Date or as may be modified by NBTB from time to time as may be applicable to officers of Executive's rank employed by NBTB or its affiliates, for senior executives but in no event less than four (4) weeks of vacation and ten (10) days of paid sick leave; provided, however, that unless otherwise approved in writing by the CFO, no more than two weeks of such vacation per yeartime may be used consecutively, and provided, further, that any accrued but unused vacation time and paid sick leave over and above four (4) weeks and ten (10) days, respectively, shall be forfeited unless otherwise agreed to in writing by the Company and Executive.

Vacation and Sick Leave. During the Term of Employment, Executive shall be entitled to paid annual vacation periods and sick leave in accordance with the vacation and sick leave policies of NBTB as in effect as of adopted by the Commencement Date or as may be modified by NBTB Company from time to time as may time, provided that the Executive shall be applicable entitled to officers of Executive's rank employed by NBTB or its affiliates, but in no event less than four five (5) weeks of paid vacation per each calendar year. Any vacation shall be at such times and for such periods as shall be mutually agreed upon between the Executive and the Company. Vacation and Sick Leave. During Employee will be entitled to paid vacation of four (4) weeks per year in accordance with the Term Employer’s vacation policy, with the timing and duration of Employmentspecific vacations mutually and reasonably agreed to by the parties hereto. Any accrued but unused vacation time at the expiration of this Agreement shall be payable to the Employee upon expiration of this Agreement at the then applicable base salary rate, Executive except as provided in Section 6(c) and (e) hereof. The Employee shall be entitled to paid annual vacation periods and sick leave in accordance with the policies of NBTB as in effect as of sick leave policy adopted by the Commencement Date or as may be modified by NBTB Employer from time to time as may be applicable to officers of Executive's rank employed by NBTB or its affiliates, but in no event less than four weeks of paid vacation per yearfor senior executives.

During the Term of Employment, Executive shall be entitled to paid annual vacation periods and sick leave in accordance with the policies of NBTB the Corporation as in effect as of the Commencement Date or as may be modified by NBTB the Corporation from time to time as may be applicable to typical for senior management officers of Executive's rank employed by NBTB or its affiliatesthe Corporation, but in no event less than four (4) weeks of paid vacation per year.

In addition, Employee shall be entitled to the same sick leave and holidays provided to other executive employees of paid vacation per yearEmployer of his level.

Without the Company's written consent, vacation must be taken in the year earned and Executive's rank employed vacation will be scheduled at times convenient to the Company's business. Executive shall be entitled to paid sick days and personal days in accordance with the policies established from time to time by NBTB or the Company for its affiliates, but in no event less than four weeks of paid vacation per yearsenior executive officers.

During his employment with the Term of EmploymentCompany, Executive shall be entitled to paid annual such vacation periods and sick leave in accordance as are consistent with the Company’s vacation and sick leave policies of NBTB as that are in effect as of the Commencement Date or as may be modified by NBTB from time to time as may be applicable to officers of Executive's rank employed by NBTB or its affiliatestime, but in no event shall Executive be entitled to less than four six (6) weeks paid vacation annually to be taken at such times and intervals as shall be reasonably determined by Executive, five (5) days of paid sick leave annually and ten (10) days of paid holiday leave annually. Executive shall be entitled to accrue, carry over or be paid for such vacation per yearand sick leave to the extent permitted by, and in accordance with, the Company’s vacation and sick leave policies in effect from time to time.

During the Term of EmploymentFor each year during which this Agreement is in effect, Executive shall be entitled to paid annual a vacation periods and sick leave benefits, without a deduction of salary or other compensation in accordance with the policies of NBTB as in effect as of the Commencement Date or as may be modified by NBTB from time to time as may be applicable to officers of ExecutiveCompany's rank employed by NBTB or its affiliatesstandard policies, but in no event shall the vacation be less than four (4) weeks. The Executive shall have up to four (4) weeks of paid vacation per year, provided the Executive works full time each year for the Company and under the terms of this Agreement. Such vacation shall be taken at such time or times during such year as may mutually be agreed upon by the Company and the Executive.

Vacation and Sick Leave. During the Term of Employment, Executive shall be entitled to vacation time for each calendar year and such paid annual vacation periods and sick leave as is in accordance with the normal Company policies of NBTB as and practices in effect as of the Commencement Date or as may be modified by NBTB from time to time as may be applicable to officers of Executive's rank employed by NBTB or its affiliates, for senior executives but in no event less than four (4) weeks’ vacation; provided, however, that unless otherwise approved in writing by the CEO or Board, no more than two (2) weeks of such vacation time may be used consecutively, and provided, further, that any accrued but unused vacation time and paid vacation per yearsick leave remaining at the end of each calendar year shall be forfeited unless otherwise agreed to in writing by the Company and Executive.

Any vacation shall be at such times and for such periods as shall be mutually agreed upon between the Executive and the Company. The Executive shall be entitled to sick leave each year in amounts consistent with the Company’s policy for all employees.

Vacation and Sick Leave. (a) During the Term term of Employmenthis employment under this Agreement, Executive shall be entitled to paid an annual vacation, without loss of pay, of 4 weeks. Unused vacation periods time shall not accrue to subsequent years, and sick leave in accordance with the policies upon any termination of NBTB as in effect as of the Commencement Date or as may his employment hereunder for any reason, all unused vacation time shall immediately be modified by NBTB from time to time as may be applicable to officers of Executive's rank employed by NBTB or its affiliates, but in no event less than four weeks of paid vacation per yearcanceled.

Vacation and Sick Leave. During the Term Period of Employment, ----------------------- Executive shall will be entitled to reasonable paid annual vacation periods each year, will be entitled to carry over to subsequent years unused vacation periods, and upon termination of employment will be entitled to be paid for unused vacation periods, in each case in accordance with Employer's policy for executives at Executive's grade level from time to time. Executive will also be entitled to reasonable sick leave in accordance with the policies of NBTB as in effect as of the Commencement Date or as may be modified by NBTB Employer's policy for executives at Executive's grade level from time to time as may be applicable to officers of Executive's rank employed by NBTB or its affiliates, but in no event less than four weeks of paid vacation per yeartime.

During For each 12-month period during the Term of EmploymentTerm, the Executive shall be entitled to paid annual vacation periods and sick leave in accordance with the policies of NBTB as in effect as of the Commencement Date or as may be modified by NBTB from time to time as may be applicable to officers of Executive's rank employed by NBTB or its affiliates, but in no event less than four weeks of paid vacation per without loss of compensation or other benefits to which she is entitled under this Agreement, to be taken at such times as the Executive may select and the affairs of the Company may permit. The Executive shall be entitled to sick leave each year.

Vacation and Sick Leave. During the Term of Employment, The Executive shall be entitled to annual paid annual vacation periods and sick leave other paid absences in accordance with the policies as periodically established by the Board for similarly situated executives of NBTB the Company, which shall in no event be less than four (4) weeks vacation, three (3) management personal days and ten (10) holidays in each calendar year and pro rata for part of a year. The Executive shall be entitled to sick leave (without loss of pay) in accordance with the Company’s policies as in effect as of the Commencement Date or as may be modified by NBTB from time to time as time. Executive may be applicable carry forward to officers the next year any unused portion (up to a maximum of 15 days) of Executive's rank employed by NBTB or its affiliates, but in no event less than four weeks of paid vacation per year’s vacation.

Vacation and Sick Leave. During the Term of Employment, The Executive shall be entitled to four weeks of vacation during each calendar year during which this Agreement is in effect, and to paid annual holidays given by the Company to its domestic employees generally, without reduction in salary or other benefits; provided, however, that Executive may take in excess of four weeks vacation periods and with the prior approval of the Chief Executive Officer, which approval shall not be unreasonably withheld, if it will not hinder the performance by Executive of his services under this Agreement or the operation of the Trade Products Division. The Executive shall also be entitled to sick leave in accordance with according to the policies of NBTB as in effect as of sick leave policy which the Commencement Date or as Company may be modified by NBTB adopt from time to time as may be applicable to officers of Executive's rank employed by NBTB or its affiliates, but in no event less than four weeks of paid vacation per yeartime.

Vacation and Sick Leave. During the Term of Employment, Executive shall be entitled to paid annual four (4) weeks of vacation periods and sick leave per annum during the Employment Term, in accordance with the DriverShield written policies concerning vacation and sick days, and shall be taken at such times as may be mutually agreed upon by the Company and Executive. The Executive shall be entitled to one (1) week of NBTB as in effect as of sick leave per annum during the Employment Term. Notwithstanding the above, should the Commencement Date or as may occur prior to September 3, 2002, any vacation taken by the Executive in August 2002 shall be modified by NBTB without pay and shall not be deducted from time to time as may be applicable to officers of the Executive's rank employed by NBTB or its affiliates, but in no event less than four weeks of paid annual vacation per yearentitlement.

Vacation and Sick Leave. During the Term of Employment, Executive shall be entitled to take up to three weeks (fifteen (15) working days) paid annual vacation periods during each calendar year. Executive shall be entitled to up to five (5) working days paid sick leave during each calendar year. Unused sick days will not accrue and the Company shall not be obligated to compensate Executive for any unused sick days at any time. Unless otherwise stated to the contrary within this section, vacation and sick leave will be governed in accordance with the terms of the applicable policies of NBTB as in effect as of the Commencement Date or as may be modified by NBTB from time to time as may be applicable to officers of Executive's rank employed by NBTB or its affiliatesCommerce Planet, but in no event less than four weeks of paid vacation per year.Inc.
