Television Programming. If you request the Television Service, w e w ill supply it to the best of our ability. How ever, television programme contents, packages of channels, programming schedules, broadcast hours of any channel, channel allocations and transmission times may change or channels or television programmes may no longer be available. This may occur for reasons beyond our control, including decisions of programme providers or technical difficulties, or for reasons that w e w ere not aw are of or could not have foreseen at the time the programme w as advertised or scheduled. We may also change the channels and packaging of channels if w e believe it w ill improve the Television Service provided to our customers. We shall not be liable to you for any such changes, lack of availability or failure to transmit any advertised television programme or channels or to do so at the advertised time.

This may occur for reasons beyond our control, including decisions of programme providers or technical difficulties, or for reasons that we were not aware of nor could not have foreseen at the time the programme was advertised or scheduled, or if we believe it will improve the Services or for commercial reasons. We shall not be liable to you for any such changes, lack of availability or failure to transmit any advertised television programme or channels or to do so at the advertised time.
Television Programming. Inmates and detainees who are deaf or hard of hearing will have equivalent access to captioned television programming as non-disabled inmates and detainees in the same classification level.
Television Programming. Inmates with Communication Disabilities will have access to captioned television programming that is equivalent to the access to television programming available to Inmates without disabilities in the same classification level.
Television Programming. At a time to be mutually agreed upon by SeaVision and Celebrity, but after the maiden voyage of the Ship, SeaVision will provide Celebrity two (2) channels of programming on and through the System for which Celebrity and its passengers will not be charged. SeaVision will provide two (2) channels of programming on and through the System for the crew of the Ship at no charge to Celebrity or the crew. The content of these channels shall be by mutual agreement, but they may include movies, documentaries, original programming and selections from leading cable television vendors. SeaVision reserves the right to market high-quality advertisements, program-length product videos and corporate endorsements on these channels, subject to mutual agreement with Celebrity. A portion of the Adjusted Gross Revenues generated from any such advertisements, program-length product videos and corporate endorsements will be paid to Celebrity pursuant to and in accordance with the terms of Section 3 of the Agreement. Revenue-Generating and Pay-Per-View Entertainment ------------------------------------------------- NOTE: Celebrity will be entitled to a portion of the Adjusted Gross Revenues generated by the following services, pursuant to and in accordance with the terms of Section 3 of the Agreement. . Video-on-Demand: Passengers will be able to purchase movies and other entertainment options such as taped concerts, on demand, using the System and their television remote-control. SeaVision shall determine the fee that will be levied for each such order and charged to such passengers' respective cabin accounts. Subject to Celebrity's approval, adult programming may be offered. . Gaming Options: Passengers will be able to view a casino channel which will promote the on-board casino operations and provide instructions for various casino games and the hours of operation for the on-board casino, as well as the opportunity to play video blackjack and poker on the System. Video slots may be offered on the System at a later date. Any additional games that SeaVision may desire to provide on the System shall be subject to the parties' mutual agreement. SeaVision will determine the value of each individual credit that passengers may purchase and charge to their cabin accounts. The SCDC will provide hearing aids to inmates who have a hearing disability and who have a medically demonstrated need for a hearing aid in order to effectively communicate while incarcerated. Hearing Aid and Cochlear Processor Batteries. The SCDC will supply appropriate types of hearing aid and cochlear processor replacement batteries as needed by inmates with hearing disabilities utilizing such hearing devices at no cost to the inmate. Replacement batteries will be provided to those requesting them and installed as soon as possible, but no later than 24 hours after such request, including weekends and holidays. Repair of Hearing Aids and Other Such Personal Devices. The SCDC will send inmates' hearing aids, cochlear processors, and other such devices to appropriate repair companies as soon as possible, but no later than 24 hours (excluding weekends and holidays) following a request for the repair of such device. The SCDC will inform the inmate when the device was sent for repair and when it is expected to be returned by the repair company. The SCDC will provide the inmate with written documentation of all such repairs, including detailed information regarding the date of the repair, and the specific repairs performed. The SCDC will take appropriate steps to ensure effective communication with the inmate during any period in which the inmate is without his or her hearing aid, cochlear processor, or other such device. Identification. The SCDC will offer inmates who have a hearing disability a special ID card which will provide notice of the disability and his or her preferred auxiliary aids and services to all personnel having contact with the inmate so that effective communication with the person may be achieved. Inmates may refuse to accept a special ID card. An inmate's identity as someone needing appropriate auxiliary aids and services for effective communication will not be treated as confidential medical information. Effective Communication Policy. Within 45 days, the SCDC will submit to the United States for review and approval a draft effective communication policy that incorporates the requirements of this Agreement.
