Statutory Change Clause Samples

A Statutory Change clause defines how a contract will adapt if relevant laws or regulations change during the contract term. Typically, this clause allows for adjustments to the contract’s terms, pricing, or obligations if new statutes, regulations, or government directives impact the parties’ ability to perform as originally agreed. For example, if a new tax is imposed or a regulatory requirement changes, the parties may renegotiate affected terms or seek equitable adjustments. The core function of this clause is to allocate the risk of legal or regulatory changes, ensuring that neither party is unfairly disadvantaged by unforeseen statutory developments.
Statutory Change. If, due to a statutory change, the school district can count days school is closed for students due to inclement weather or other emergency causes as days of pupil instruction for state aid purposes, and/or if the school district is not required to make up days of student instruction without loss of state funding, secretaries, paraprofessionals, and computer technicians shall not be required to make up such days, and shall not lose pay or paid leave.
Statutory Change. ‌ 20.1 Mandatory changes in teacher benefits, which are included in this Agreement, which are brought about by the amendment of statutory provisions in California or federal law, shall be incorporated into this Agreement.
Statutory Change. 1. The Parties agree to work together in good faith to propose and lobby for legislation in the 2022 Minnesota legislative session to modify the distribution of the State’s Opiate Epidemic Response Fund under Minnesota Statutes section 256.043, subd. 3(d), so that “50 percent of the remaining amount” is no longer appropriated to county social services, as related to Opioid Settlement Funds that are ultimately placed into the Minnesota Opiate Epidemic Response Fund (“Legislative Modification”).1 Such efforts include, but are not limited to, providing testimony and letters in support of the Legislative Modification. 2. It is the intent of the Parties that the Legislative Modification would affect only the county share under section 256.043, subd. 3(d), and would not impact the provision of funds to tribal social service agencies. Further, it is the intent of the Parties that the Legislative Modification would relate only to disposition of Opioid Settlement Funds and is not predicated on a change to the distribution of the Board of Pharmacy fee revenue that is deposited into the Opiate Epidemic Response Fund.
Statutory Change. 19.1 Improvements in unit member benefits that are brought about by the amendment or addition of statutory guarantees now provided in California or federal law shall be incorporated into this Agreement. 19.2 Reduction or elimination of teacher benefits which are brought about by the amendment or repeal of statutory guarantees incorporated into this Agreement shall obligate the parties within ten (10) days of such amendment or repeal to negotiate for the purpose of restoring such benefits in this Agreement.
Statutory Change. Improvements in benefits included in this Agreement which are brought about by the amendment or addition of statutory guarantees now provided in California or federal law shall be incorporated into this Agreement.
