Software Version Changes. If a Version change to the Product addresses an identified Customer problem that has not been previously resolved by a Fix or Update, LSI shall, provide NCR with the new Version of the Product to affected customers. LSI hereby grants to NCR a [*], non- exclusive, worldwide, license to reproduce, use and distribute the new Version to Customers. NCR will not knowingly provide the new Version to Customers who have not licensed the corresponding Product. All copies will contain any copyright, trademark, disclaimer or patent notices that appear on or in the original provided by the LSI Logic LSI reserves the right to charge an upgrade fee at a mutually agreed upon amount if the Version change is a Major Release with the exception of Firmware changes.
