Common use of Significant Changes in the Character of Work Clause in Contracts

Significant Changes in the Character of Work. The work or changes in quantities, significantly change the character of the work under the Contract, an adjustment, excluding anticipated profits for reduced or eliminated work, may be made to the Contract. The basis for the adjustment shall be agreed upon prior to the performance of the affected Work. If a basis cannot be agreed upon, an adjustment will be made either for or against the Contractor in such amount as the Engineer may determine to be fair and equitable. The Engineer may, at his option, direct the Contractor to accomplish the change or alteration on a force account basis when the circumstances meet the requirements for force account work under Section 109.05. If the Engineer’s changes or alterations do not result in a significant change in the character of the Work, the changed or altered work will be paid for at the Contract price for the actual quantities of work performed. The term significant change shall be construed to apply only to the following circumstances:
