Common use of Serious and Willful Misconduct Clause in Contracts

Serious and Willful Misconduct. In the case of serious and willful misconduct ( eg: theft, assault ), the following procedure will apply: The Company shall have a discussion with the Employee in which it will advise him/her of the alleged serious and willful misconduct. The Employee shall be entitled to have an Employee representative in attendance to respond to the allegation. The Company will then have the sole discretion to either suspend the Employee for up to fifteen (15) working days with no pay or terminate his/her employment.
