Common use of Second Displacement Clause in Contracts

Second Displacement. Where an employee has displaced another employee pursuant to Article 22.8 (a) and, within the fifteen (15) working day evaluation period, either the Employer determines that the employee does not have the skills, ability and competence to perform the job, or the employee is not satisfied with the job, the Employer or the employee shall notify the other, in writing, and employee shall have one additional opportunity to exercise their rights pursuant to Article 22.4 (b), by advising the Employer, in writing, within two (2) working days after receiving or giving the said notice, of another job occupied by an employee to be displaced.
