Common use of RIGHT TO STOP WORK/RIGHT TO CORRECT DEFICIENCIES Clause in Contracts

RIGHT TO STOP WORK/RIGHT TO CORRECT DEFICIENCIES. Should the CMR default, fail to perform the Work, or improperly perform the Work, the Owner has the right, after three (3) days written Notice, to correct the deficiencies. The CMR shall pay to the Owner the Owner’s cost of correcting the deficiencies, including but not limited to charges by the Architect, plus a markup of ten percent (10%) to cover administrative costs. The Owner's exercise of the right to correct deficiencies shall in no way prejudice or limit any other remedy that the Owner may have.
