Common use of Return to Bargaining Unit Clause in Contracts

Return to Bargaining Unit. A. Promotion to Corrections Sergeant or a Non-Union Administrative Position: In the event that a bargaining unit member is promoted to Corrections Sergeant or a Non- Union Administrative Position, and within twelve (12) months of the promotion, the employee requests to return to the Corrections or Court Officer classification, or is demoted by the Sheriff, the employee will be permitted to return to the bargaining unit and shall retain as classification seniority all time spent as a Corrections or Court Officer and as a Corrections Sergeant. B. Freezing of Classification Seniority: After completion of the twelve (12) month period in section A, the employee’s classification seniority within this bargaining unit shall be “frozen” at the date of promotion. Employees promoted prior to January 1, 2003 will receive credit for all time spent within the bargaining unit prior to that date in determination of their “frozen” classification seniority. Any employee who requests to return to the Corrections Officer, Court Officer, or Animal Control classification, or is demoted by the Sheriff, will be permitted to return to the bargaining unit with classification seniority as “frozen” on the date of their promotion, or January 1, 2003. Any loss of seniority under the provisions of Article 11, section 1 of this agreement shall include the loss of all “frozen” seniority.
