The 'Return to Bargaining Unit' clause establishes the conditions under which an employee who has left a bargaining unit position—often for a temporary assignment or promotion outside the unit—may return to their previous bargaining unit role. Typically, this clause outlines eligibility criteria, such as time limits for return and whether the employee retains their former seniority or benefits upon reentry. Its core function is to provide job security and clarity for employees transitioning in and out of bargaining unit positions, ensuring both the employer and employee understand the process and rights involved.
Return to Bargaining Unit. Any employee transferring out of the bargaining unit but remaining in the employ of the Employer shall retain his/her seniority rights, with no accumulation of seniority during the period of such employment out of the bargaining unit.
Section 1 - Definition
Return to Bargaining Unit. A. Promotion to Sergeant/Detective Sergeant or a Non-Union Administrative Position: In the event that a bargaining unit member is promoted to Sergeant or Detective Sergeant or a Non-Union Administrative Position, and within twelve (12) months of the promotion, the employee requests to return to the Deputy classification, or is demoted by the Sheriff, the employee will be permitted to return to the bargaining unit and shall retain as classification seniority all time spent as a Deputy and as a Sergeant or Detective Sergeant, or in a Non-Union Administrative Position.
B. Freezing of Classification Seniority: After completion of the twelve (12) month period in section A only members who have been promoted to the Law Enforcement Command Unit will have their classification seniority within this bargaining unit “frozen” at the date of promotion. Employees promoted prior to January 1, 2003 will receive credit for all time spent within the bargaining unit prior to that date in determination of their “frozen” classification seniority. Any member of the Law Enforcement Command Unit who requests to return to the Deputy classification, or is demoted by the Sheriff, will be permitted to return to the bargaining unit with classification seniority as “frozen” on the date of their promotion, or January 1, 2003. Any loss of seniority under the provisions of Article 11, section 1 of this agreement shall include the loss of all “frozen” seniority.
Return to Bargaining Unit. Where an employee is promoted or transferred from a bargaining unit position to a non-bargaining unit position and is subsequently unable to perform satisfactorily in the non-bargaining unit position (whether by reason of disability or skill considerations), within ninety (90) calendar days from the date of promotion or transfer, the University shall return such employee to the bargaining unit classification previously held, without complying with the posting and bidding requirements of Article 18. Upon such return, the employee's wage rate and seniority shall be as if he/she had never left the bargaining unit classification. In the event that the ninetieth (90th) calendar day probationary period has passed, the University may return such employee to any vacant position which is the same as, or lower than, the classification the employee previously held. The employee shall be paid at the current rate of pay for that classification according to that employee's seniority.
Return to Bargaining Unit. (a) An employee who accepts a position with the District outside the Unit shall have the option to revert to the employee’s former position for a period of 6 months without loss of seniority or other fringe benefits.
(b) An employee who accepts a position with the District outside the bargaining unit who is rejected pursuant to Article 17.7(b), except by reason of discharge for just cause, shall have the option to revert to the position most recently occupied prior to the promotion, without loss of seniority or other fringe benefits.
(c) In the event of (a) or (b) above if the previously held position is occupied, dislocation of employees shall be made in the reverse order of appointments which were made as a consequence of the original promotion. If the previously held position has been abolished, the employee shall have bumping rights based on seniority to a position within the highest classification previously held and dislocations which result thereby shall be treated in the same manner.
(d) Any employee who has been employed in a District position outside the Unit for a period of more than 6 months may be placed in a position for which the employee meets the minimum qualifications. No current employee shall be transferred, demoted or terminated to create a vacancy for the returning employee.
Return to Bargaining Unit. If the employee returns to the bargaining unit, reinstatement will be in the same job classification with the group classification held prior to leaving the bargaining unit, provided the employee has the seniority to hold the job and there is a vacancy. The employee may also assume the first position available in a lower classification, provided seniority allows. The time spent out of the bargaining unit will not be counted toward seniority within the unit.
Return to Bargaining Unit. When bargaining unit members accept positions outside the bargaining unit but still within the College, they can apply for bargaining unit positions as external applicants if such application occurs within six (6) months of the date of leaving the bargaining unit. If such individuals accept an offer of a bargaining unit position, they will return at the pay level applicable to the position. The pay step is determined as follows:

Return to Bargaining Unit. (a) An employee who terminates service with the BCGEU and subsequently returns shall be considered a new employee from the date of re-entering the unit for the purpose of determining seniority credit, except that a regular employee who resigns their position and within 90 days is re- employed as a regular employee shall be granted leave of absence without pay covering those days absent and shall retain, effective the date of re-employment, all provisions and rights in relation to seniority and other fringe benefits, provided they have not withdrawn their pension benefit contributions.
(b) An employee who accepts a position with the BCGEU which is outside the COPE 378 bargaining unit and who returns to the unit within one year shall be placed in their former position or in a position of equal rank and basic pay and shall retain previous seniority, provided the COPE 378 minimum dues have been paid. The one year period may be extended by mutual agreement between the Union and the BCGEU.
(c) The BCGEU agrees to notify an employee who accepts a position outside of the COPE bargaining unit that, upon their return to the bargaining unit, their former position may not be available to them.
Return to Bargaining Unit. Any Sergeant who is laid off may return to this bargaining unit replacing the Police Officer having the least departmental seniority, provided that his own department seniority is greater and that he is otherwise qualified for the position. This section shall apply only to those Employees who held the rank of Police Officer in this department.

Promotion to Corrections Sergeant or a Non-Union Administrative Position: In the event that a bargaining unit member is promoted to Corrections Sergeant or a Non- Union Administrative Position, and within twelve (12) months of the promotion, the employee requests to return to the Corrections or Court Officer classification, or is demoted by the Sheriff, the employee will be permitted to return to the bargaining unit and shall retain as classification seniority all time spent as a Corrections or Court Officer and as a Corrections Sergeant.
