Common use of Return of Previously Held Rank Clause in Contracts

Return of Previously Held Rank. If a member of the bargaining unit is promoted or voluntarily transfers to a position outside of the bargaining unit, he/she shall retain seniority in his/her highest bargaining unit-covered rank. If the Township does not wish to retain the member in the non-covered position, the member shall be returned to the highest previously held rank in the bargaining unit.

If a member of the bargaining unit is promoted or voluntarily transfers to a position outside of the bargaining unitunit within the Department of Public Safety, he/she shall retain seniority in his/her highest bargaining unit-unit covered rank. If the Township does not wish to retain the member in the non-covered positionposition within the first year, the member shall be returned to the highest previously held rank in the bargaining unit, and activate a bump-down process within the bargaining unit.
