RESERVATION OF MANAGEMENT FUNCTIONS. 5.1 The Association acknowledges that it is the exclusive function of the Employer to: (a) Maintain order, discipline and efficiency; (b) hire, discharge, direct, transfer, promote, demote, lay-off and suspend or otherwise discipline Nurses provided that a claim of discharge or discipline without just cause may be the subject of a grievance; (c) make and alter from time to time written reasonable rules and regulations to be observed by the nurses; (d) generally to manage the Home and direct the work of the nurses and, without restricting the generality of the foregoing, to determine the number of nurses required and the methods, procedures, and equipment to be used, and all other matters concerning the Employer's operation. 5.2 The Home will exercise these rights in a manner consistent with the Collective Agreement and apply the provisions of the Collective Agreement in a reasonable manner.
