Common use of REPRESENTATIVE LEAVE Clause in Contracts

REPRESENTATIVE LEAVE. (a) Leave to attend trade union and union delegate courses/ seminars shall be as follows: (i) To a maximum of five (5) days per year (1 January to 31 December) for the totality of all applications of paid trade union, union delegate training leave, attendance at association conferences, meetings and courses provided that: 1. the scope, content and level of the courses are directed to the enhancement of the operation of the settlement of dispute procedures; 2. that two (2) weeks’ notice is provided to the Employer; 3. the approval of leave must have regard to the operational requirements of the Employer; and 4. this leave shall be paid at the ordinary time rate of pay. (b) Leave of absence granted pursuant to this clause 53 shall count as service for all purposes of this Agreement. (c) Leave that is not utilised in one calendar year may accumulate to be utilised the following year. Leave may be cumulative for a maximum period of two (2) years.

(b) The leave outlined at sub-clause (a) above is for the totality of all applications of paid trade union, union delegate training leave, attendance at association conferences, meetings and courses in the workplace provided that: (1. the ) The scope, content and level of the courses are directed to the enhancement of the operation of the settlement of dispute procedures; (2. that ) That at least two (2) weeks’ notice is provided to the Employer; (3. the ) The approval of leave must have regard to the operational requirements of the Employer; and; (4. this ) This leave shall be paid at the ordinary time rate of pay. (bc) Leave of absence granted pursuant to this clause 53 shall count as service for all purposes of this Agreement.
