Public Holidays. 63.1. An Employee (other than a casual Employee) shall be entitled to the following public holidays paid at ordinary time rates without deduction of pay including all appropriate shift loadings: • New Year’s Day; • Australia Day; • Good Friday; • Easter Saturday; • Easter Sunday (if gazetted in accordance with clause 63.2 below) • Easter Monday; • Anzac Day; • King’s Birthday; • Labour Day; • Grand Final Eve • Melbourne Cup Day; • Boxing Day; • Christmas Day; and • Any other day (including the gazetted substitution of public holidays when they coincide with a weekend) declared by or under a law of the State of Victoria to be observed generally within the State as a public holiday. 63.2. Except in the case of continuous shift workers, in which case the holiday shall fall on the actual day prescribed 63.3. 58.1.2 For a public holiday falling on a day which a part-time Employee would normally have been required to work under their regular hours roster model , such Employee will be entitled to a holiday, and will be paid at the base hourly rate and for the number of hours they would have normally worked.
63.258.1.3 If the employee does not have regular hours rostered to be work on the public holiday, the employee is not entitled to payment under this section. With For example, the exception employee is not entitled to payment if the employee is a casual employee who is not rostered on for the public holiday, or is a part-time employee whose part-time hours do not include the day of Easter Saturdaythe week on which the public holiday occurs, in or a full time employee whose regular roster does not include the event that any day of the week the public holiday falls during i.e.; Wednesday- Sunday rosters would not be entitled to a weekendpublic holiday that falls on Monday or Tuesday unless they have been required to work and are rostered on these days.
58.2 Public Holidays falling on Saturdays and Sundays
(a) When Christmas Day is a Saturday or Sunday, the first subsequent ordinary weekday a holiday in lieu thereof will be treated in lieu as observed on 27 December and those Full time and Part time employee whose ordinary hours are rostered on a Saturday or Sunday will be entitled to payment at based rate for the public holiday. Except
(b) When Boxing Day is a Saturday or Sunday, a holiday in lieu thereof will be observed on 28 December and those Full time and Part time employee whose ordinary hours are rostered on a Saturday or Sunday will be entitled to payment at based rate for the case of continuous shift workerspublic holiday
(c) When New Year’s Day or Australia Day is a Saturday or Sunday, a holiday in which case the holiday shall fall lieu thereof will be observed on the actual day prescribed
63.3. All work performed next Monday and those Full time and Part time employee whose ordinary hours are rostered on any of a Saturday or Sunday will be entitled to payment at based rate for the public holidays in this Agreement shall holiday
(d) Anzac Day is to be paid for at the rate of double time observed on 25 April and one half. An Employee required to work on a public holiday shall be afforded at least 8 hours’ work or paid for 8 hours at the appropriate rate.
63.4. The Company may request the Employee to work on a public holiday. The Employee may refuse the request if they have reasonable grounds to do so.
63.5. Shift Worker(s) (excluding casuals) will be paid their ordinary time earnings for the Employee’s wage rate for a Public Holiday they are rostered to work but are not required to work. This also includes payment for Public Holiday’s that fall on a day that the Employee is not rostered to work. This clause will only apply when the Public Holiday(s), as provided substituted for in clause 63.1, which another day if it falls on any day between Monday and FridaySaturday or Sunday.

63.2. With the exception of Easter Saturday, in the event that any public holiday falls during a weekend, on an employee’s rostered day off and the first subsequent ordinary weekday will be treated in lieu as employee does not work the public holiday. 63.3. All work performed on any of be entitled to payment for the public holidays in this Agreement holiday at the employee’s ordinary time rate for 7.2 ordinary hours. For example, if the employee has an RDO on Easter Friday and they do not work the day they shall be entitled to 7.2 ordinary hours pay at their ordinary time rate. This clause does not apply to Easter Saturday. An employee who does not work Easter Saturday is not entitled to payment. Any employee required to work on a public holiday nominated herein shall be paid for at the rate of double time and one halfa half for all time so worked. An Employee Employees may be required to work on public holidays. It will be available for the employer and a majority of the affected employees to substitute the nominated public holiday for another day and the prescriptions of this clause will apply to the substituted day. Provided, a weekly employee who has been employed continuously for two weeks and who: is terminated by the employer or stood down during December; and is re-employed by the employer at any time before the end of January in the following year; shall be afforded at least 8 hours’ work or paid for 8 hours at the appropriate ratepublic holidays of Christmas Day, Boxing Day and New Years Day when those days occur during the period of the termination or standing down.
63.4. The Company may request the Employee to work on a public holiday. The Employee may refuse the request if they have reasonable grounds to do so.

63.2. With the exception 9.9.6 If an Act of Easter Saturday, in the event that any public holiday falls during a weekend, the first subsequent ordinary weekday will be treated in lieu as the public holiday. 63.3. All work performed on for any of the above named public holidays, the special rates shall only be payable for work done on the day substituted.
9.9.7 Where an Employee is absent from their employment on the working day before, or the working day after a public holiday, they shall provide a Doctors Certificate or other acceptable evidence to support an application for such leave on the day.
9.9.8 Employees in receipt of pay for public holidays in this Agreement while receiving workers compensation benefits, shall be paid in accordance with Clause 10.1.2.
9.9.9 Public holidays may be substituted for at alternative days by agreement between the rate of double time Company and one halfan Employee. An Employee required to work on Where an alternative day is substituted for a public holiday shall in accordance with this clause, penalty rates will only be afforded at least 8 hours’ work or paid for 8 hours at payable if an Employee works on the appropriate ratealternative day.
63.4. 63.5. Shift Worker(s9.9.11 In the case where an Employee works in the circumstance described in clause 9.9.10 of this Agreement, it is further agreed in accordance with Section 115 of the FW Act that:
(a) (excluding casuals) Where an Employee agrees to work a full-day, that day will be regarded as a normal working day, and an additional one and a half days’ paid their ordinary time earnings leave during the Christmas – New Year period will be substituted for the Employee’s wage rate for a Public Holiday they are rostered public holiday; or
(b) Where an Employee agrees to work but are not required to work. This also includes payment a half-day, that half-day will be regarded as a normal working half-day and an additional days’ paid leave during the Christmas – New Year period will be substituted for Public Holiday’s that fall on a day that the Employee is not rostered to work. This clause will only apply when the Public Holiday(s), as provided for in clause 63.1, which falls on any day between Monday and Fridaypublic holiday.

63.4. The Company may request 19.3.2 Work performed in excess of ordinary rostered hours on a public holiday will be paid at the Employee to rate of 300% (triple time), with the exception of employees engaged under flat rates of pay.
19.4 Shift loading for work on a public holiday. The Employee may refuse the request if they have reasonable grounds to do so.
63.5. Shift Worker(s) (excluding casuals) 19.4.1 An employee engaged under clause 8.1.1 will be paid their ordinary time earnings the following additional shift penalties for the Employee’s wage rate working on a public holiday. 57.2 In a district in which a show holiday is not appointed under the State Holidays Act (QLD) 1983, the employee and Company must agree on an ordinary working day that is to be treated as a public holidayshow holiday for all purposes.
63.2. 57.5 Casual employees will only be paid for 8 hours at the appropriate ratepublic holidays on which they work.

57.11 When a full-time employee‟s rostered day off falls on a public holiday and cannot be moved to another day, they will be paid their ordinary time earnings rostered hours for the Employee’s wage rate for that day.
57.12 Where a Public Holiday they are rostered to work but are not required to work. This also includes payment for Public Holiday’s that fall public holiday falls on a Saturday or Sunday but is observed on a Monday or Tuesday, employees will be paid for working the Saturday or Sunday at the penalty rates for Saturdays and Sundays. Where employees work on the gazetted Monday or Tuesday public holiday, the employees will be paid in accordance with this clause.
57.13 Where overtime is worked on a public holiday either as a whole additional shift or as additional hours worked on the day above any ordinary hours, payment will be at double the overtime rate that would be applicable if the Employee is day was not rostered to work. This clause will only apply when the Public Holiday(s), as provided for in clause 63.1, which falls on any day between Monday and Fridaya public holiday.

63.4. The Company (e) Each may request the Employee require an employee to work on a public holiday. The Employee employee may refuse to work if the request requirement is unreasonable or if they have the refusal is reasonable grounds to do so(see clause 4.10).
63.5(f) An employee who works ordinary hours on a public holiday will receive public holiday pay rates as set out in this Agreement. Shift Worker(sEach and an employee may agree that the employee will take TOIL within four weeks of the public holiday instead of receiving public holiday pay rates.
(g) If an employee performs some, but not all, of their ordinary hours on a public holiday, they will be paid at public holiday pay rates for the time worked and ordinary pay rates for the time not worked.
(excluding casualsh) An employee who would not ordinarily work on a day that a public holiday falls will not receive payment or TOIL. Public holidays in lieu
(i) If Christmas Day, Boxing Day, New Year's Day or Australia Day falls on a Saturday or a Sunday, a holiday in lieu will be observed on the next business day as gazetted in the relevant state or territory. Substitution of public holidays
(j) Each and an employee may agree to substitute a recognised public holiday. This agreement must be recorded in writing.
(k) If Each and an employee agree to substitute a recognised public holiday, the employee must work on the recognised public holiday and will be paid their ordinary time earnings for the Employee’s wage hourly rate for a Public Holiday they are rostered on this day.
(l) If Each directs an employee to work but are not required to work. This also includes payment for Public Holiday’s that fall on a substituted public holiday, they will be paid as though that day that the Employee is not rostered to work. This was a public holiday (see clause will only apply when the Public Holiday(s4.10), as provided for in clause 63.1, which falls on any day between Monday and Friday.

71.2 For the purpose of this clause the following public holidays paid at ordinary time rates without deduction of pay including all appropriate shift loadings: • New Year’s Day; • Australia Day; • Good Friday; • Easter Saturday; • Easter Sunday days (if gazetted in accordance with clause 63.2 below) • Easter Monday; • Anzac Day; • King’s Birthday; • Labour Day; • Grand Final Eve • Melbourne Cup Day; • Boxing Day; • Christmas Day; and • Any other day (including the gazetted substitution of public holidays when they coincide with a weekend) declared unless substituted by or under a law of the State or Territory in which the relevant employee is principally engaged to perform work) shall be public holidays:
(a) New Year’s Day
(b) Australia Day
(c) Good Friday
(d) Easter Monday
(e) ANZAC Day
(f) Christmas Day
(g) Boxing Day
(h) Queen’s birthday holiday (on the day on which it is celebrated in a State or Territory or a region of Victoria a State or Territory in which the relevant employee is principally engaged to perform work)
(i) any other day declared to be observed generally within a public holiday by or under a law of the State as or Territory in which the relevant employee is principally engaged to perform work.
71.3 If an employee is absent from work on either or both the working day(s) immediately before or after a public holiday, the employee will be required to substantiate his/her absence(s) from work with evidence such as a medical certificate.
63.271.4 If an employee works ordinary hours (as it relates to their classification and employment status) on a public holiday, the employee will be paid a penalty rate as outlined. With the exception of Easter Saturday, in the event that any Dialysis Nurses and Nurses 200% for all hours worked on a public holiday falls during a weekend, the first subsequent ordinary weekday will be treated in lieu as the public holiday. Except in the case of continuous shift workers, in which case the holiday shall fall on the actual day prescribed
63.3. All work performed on any of the public holidays in this Agreement shall be paid for at the rate of double full time and one half. An Employee part time employees 225% for all hours worked on a public holiday for casual employees (includes casual loading) Employees other than Dialysis Nurses and Nurses 250% for all hours worked on a public holiday for full time and part time employees 275% for all hours worked on a public holiday for casual employees (includes casual loading)
71.5 If an employee is not required to work on a public holiday shall be afforded at least 8 hours’ work or paid and would have worked on that day but for 8 hours at the appropriate rate.
63.4. The Company may request the Employee to work on a public holiday. The Employee may refuse , the request if they have reasonable grounds to do so.
63.5. Shift Worker(s) (excluding casuals) employee will be paid their base rate of pay for their ordinary time earnings hours of work had they worked on that day.
71.6 If an employee is acting in higher duties during the period of a public holiday, the employee will receive the higher duties rate of pay.
71.7 The employer and an employee may agree to substitute another day for the Employee’s wage rate for a Public Holiday they are rostered to work but are not required to work. This also includes payment for Public Holiday’s that fall on a day that otherwise be a public holiday.
71.8 The employer and an employee may agree to substitute another part-day for a part-day that otherwise be a public holiday.
71.9 To support cultural diversity, an employee may request to substitute a public holiday for another day that bears meaning for them.
71.10 In addition to the Employee above, 11 November is not rostered recognised as a day that represents their commitment to work. This clause indigenous health and wellbeing and will only apply when the Public Holiday(s)allow employees to substitute Australia Day 26 January with 11 November Day.
71.11 In order to request a substitute day, as provided it must be applied for in clause 63.1, which falls on any day between Monday writing and Fridayapproved prior to the public holiday occurring.

Public Holidays. 63.1. 34.3 Payment for the holidays mentioned above which are taken and not worked, shall be at the normal rate of pay which would have applied to the employee concerned, when if it were not for such holiday, he/she had been at work.
34.4 Where an employee who is entitled to holidays as above is required to work on any public holiday falls during a weekendday of the holidays mentioned, either for part or the first subsequent ordinary weekday will be treated in lieu as the public holiday. Except whole of such day he/she shall in the case of continuous a day worker be paid at the overtime rate prescribed in clause 25 - Overtime.
34.5 Notwithstanding the various provisions of this agreement the following shall apply in relation to payment for public holidays for employees classified as shift workers, in .
34.5.1 For rostered shifts which case the holiday shall fall on a Public Holiday and the actual day prescribed
63.3. All work performed employee works on any of such holiday, the public holidays in this Agreement employee shall be paid for receive payment at the rate of double time and a half.
34.5.2 For full-time shift workers, where a Public Holiday falls on a rostered day off, employees shall receive one and a half days pay. This payment will be paid in the same pay for the pay period in which the Public Holiday falls.
34.5.3 For full-time shift workers, where a Public Holiday falls on an accrued day off, employees will be compensated for that Public Holiday by an amount equivalent to one day at the rate of time and a half. This payment will be paid in the same pay for the pay period in which the Public Holiday falls.
34.5.4 Shiftwork employees shall not have added to annual leave one day for each statutory holiday mentioned in this agreement.
34.6 Day workers shall not be rostered to work on public holidays.
34.7 An Employee employee required to work on any of the holidays mentioned above, where such holiday applies at his/her normal place of work but because his/her duties requires the employee to work at a public place where the holiday does not apply, shall have the time in lieu of such holiday added to his/her annual leave entitlement.
34.8 A part-time employee who receives pre-payment in lieu of sick leave, annual leave and Public Holidays shall be afforded at least 8 hours’ work or paid for 8 hours at the appropriate rate.
63.4. The Company may request rate of 1.7 times the Employee to relevant agreement rate for work on a public holiday. The Employee may refuse the request if they have reasonable grounds to do so.
63.5. Shift Worker(s) (excluding casuals) will be paid their ordinary time earnings for the Employee’s wage rate for a Public Holiday they are rostered to work but are not required to work. This also includes payment for Public Holiday’s that fall on a day that the Employee is not rostered to work. Public Holidays. 63.1(a) The following are NSW state declared Public Holidays: Easter Sat, Easter Sun and Labour Day and shall be observed in accordance with NES in addition to the prescribed Public Holidays: New Years Day, Australia Day, Good Friday, Easter Monday, Anzac Day, Queen's Birthday, Christmas Day and Boxing Day.

63.2. 63.5. Shift Worker(s(e) All work done by an Employee (excluding casualsother than casual Employees) during their ordinary shifts on a public holiday, including a substituted day, will be paid at double time and a half (250%) of their ordinary time earnings rate of pay.
(f) All work done by a casual Employee during their ordinary shifts on a public holiday will be paid at the rate of 250% (inclusive of casual loading).
(g) In addition to the public holidays prescribed under sub clause (a) of this clause, there shall be an extra public holiday each year. Such public holiday will occur on the 31st December, if this date falls on a weekend then it will move to the Friday before. This sub clause shall apply in substitution for the Employee’s wage rate for any additional local public holiday or half public holiday proclaimed in a local government area.
(h) Public Holiday they are rostered to work but are loading will be in substitution for and not required to work. This also includes payment for Public Holiday’s that fall on a day that cumulative upon the Employee is not rostered to work. 63.2. With the exception of Easter Saturday, in the event that any public holiday falls during a weekend9.5, the first subsequent ordinary weekday will Employee shall be treated granted an alternate day off in lieu as of the public holiday. Except in If the case of continuous shift workerspublic holiday falls on a Friday and the Employee’s RDO is a Friday, in which case then the Employee will be granted an alternate public holiday shall fall on the actual Thursday before the public holiday. 13.3 By agreement between the Company and an Employee, other days may be substituted for the holidays stated in clause 13.1 above.
13.4 An additional holiday (“Picnic Day”) will be granted and observed on the last working day prescribedprior to the King’s birthday long weekend in June for factory employees. Distribution employees will take the Picnic Day by mutual agreement with management.
63.3. 13.5 All work performed time worked on any of the public above holidays in this Agreement shall be paid for at the a rate of double time and one halfhalf with a minimum of four (4) hours pay.
13.6 For shift workers:
13.6.1 The rate in clause 13.5 is in substitution for, and not cumulative upon the shift premiums in clause 8.2.1;
(a) where shifts commence between 11.00 pm and midnight on a Sunday, the time so worked before midnight does not entitle the Employee to the public holiday rate for the shift. An However, the time worked by an Employee required to work on a shift commencing before midnight on the day preceding a public holiday shall and extending into the public holiday must be afforded at least 8 hours’ work or paid for 8 hours at regarded as time worked on the appropriate ratepublic holiday; and
(b) where shifts fall partly on a holiday, the shift which has the major portion falling on the public holiday must be regarded as the holiday shift. By agreement between the Company and the majority of Employees concerned, the shift which has the minor portion falling on the public holiday may be regarded as the holiday shift instead.
63.4. The Company may request the Employee 13.7 Employees only have an entitlement to work on a public holiday. The Employee may refuse the request if they have reasonable grounds to do so.
63.5. Shift Worker(s) (excluding casuals) will be paid their ordinary time earnings for the Employee’s wage rate for a Public Holiday if they are rostered to would normally work but on that day.
13.8 Casual Employees are not required entitled to work. This also includes payment be paid for Public Holiday’s that fall a public holiday (as they receive a casual loading in lieu) unless they perform work on a day that the Employee is not rostered to work. 36.3. Easter Saturday will be observed as a public holiday on that day for any employee who is required to work ordinary hours on that day.
36.4. The public holiday will be from 0001 hours to 2400 hours on the day observed for the holiday.
36.5. Where an employee works on a public holiday, the employee will be paid eight hours pay at the ordinary rate of pay plus 1.5 times the ordinary rate of pay for all hours worked on the public holiday.
63.236.6. With the exception of Easter Saturday, in the event that any Part-time employees are entitled to public holiday falls during a weekend, the first subsequent ordinary weekday will be treated in lieu as the public holiday. Except in the case of continuous shift workers, in which case holidays provided the holiday shall fall occurs on a day which the actual day prescribedemployee normally works.
63.336.7. All work performed on any of the public holidays in this Agreement shall be paid for at the rate of double time and one half. 36.9. Train Crew may have designated Rostered Time Off on a Public Holiday, including Easter Saturday, where that RTO falls on the public holiday in accordance with the Master Roster.
36.9.1. In such cases the employee shall be paid eight hours pay at the ordinary rate of pay and such payment will not count towards working time but may be used, to the extent necessary, toward payment of the ordinary hours.
36.9.2. An employee who works on RTO on a public holiday shall be paid eight hours pay at the ordinary rate of pay plus the stand alone payment provided for at clause 24.4.
36.10. If an employee is absent from work without pay on both sides of a public holiday the employee shall not be entitled to payment for that public holiday.
36.11. Where an employee is working on temporary transfer in a State / Territory other than South Australia or the Northern Territory, days proclaimed as public holidays in the other Sate or Territory may be observed, at the employer’s discretion, in substitution for the Employee’s wage rate for a Public Holiday they are rostered to work but are not required to work. This also includes payment for Public Holiday’s that fall on a day that the Employee is not rostered to work. This clause will only apply when the Public Holiday(s), as provided for equivalent holiday named in clause 63.1, which falls on any day between Monday and Fridaythis agreement.

31.3 The Company and an individual employee may agree to substitute another day for any prescribed in lieu as this clause.
31.4 Subject to the public holiday. Except exceptions prescribed in sub-clause 20.9 of the case of continuous shift workersAgreement, in a Continuous Shiftworker not rostered for ordinary hours, and a Dayworker required for essential maintenance or other essential work which case the holiday shall fall on the actual day prescribed
63.3. All cannot be reasonably postponed, may be requested to work performed on any of the public holidays days listed in this Agreement shall clause 31 if required by the Company and will be paid for at the rate of double time and one half. An Employee required half of the Overtime Hourly Rate.
31.5 Public Holiday during Leave A public holiday prescribed by this Agreement occurring during the taking of annual leave or long service leave shall be added to the period of such leave.
31.6 Requirement to work on a public holiday shall be afforded at least 8 hours’ work or paid for 8 hours at Public Holiday
31.6.1 An employee who accepts a request by the appropriate rate.
63.4. The Company may request the Employee to work on a public holiday. The Employee may refuse any of the request if they have reasonable grounds to do so.
63.5. Shift Worker(s) (excluding casuals) said Public Holidays will be paid their ordinary for a full day or shift. Provided that this sub-clause will not apply to:
(a) an employee who ceased work on the Public Holiday concerned without the authority of the Company; or
(b) work of not more than four hours duration and of which an employee has received at least twenty-four hours' notice that is performed by an employee immediately following or immediately preceding time earnings worked by the employee on the day before or the day after such holiday, as the case may be.
31.6.2 In the following circumstances an employee will be paid in respect of the relevant Public Holidays as though the employee had continued employment without interruption:
(a) If the Company closes down the Mill for a period which includes the Employee’s wage rate Easter or Christmas Public Holidays, and:
(i) the employee is discharged (other than for misconduct) by the Company less than fourteen days before the shut-down period, and
(ii) that employee is re-engaged by the Company not more than fourteen days after the shut-down period.
(b) Where the Company terminates the employment of an employee other than for misconduct within one week of a day on which a Public Holiday they occurs as in this agreement, the employee will be paid for such holiday, provided that such employee has been employed by the Company for a continuous period of at least one month.
(c) Where the shift roster prescribed in accordance with clause 17.4 of this agreement provides for the ordinary hours for a Continuous Shiftworker to commence after midnight on Sunday and finish after midnight on Friday, and the Company regularly treats any part of a Tuesday following a Monday which is a holiday prescribed by sub-clause 31.1 to be part of that holiday then the Company will be entitled to treat an equal part of any Friday which is a holiday prescribed by sub-clause 31.1 as part of ordinary working hours.
(d) Provided that an equal part of the following Saturday is regarded as part of that holiday; and provided further that, if the majority of the employees concerned so desire, the shift roster for the week concerned will be changed in accordance with clause 17.5 to commence at 12 midnight on the Sunday or such other time as may be mutually agreed between the Company, the employees and their representatives.
31.7 Public Holidays on a non-rostered week day
31.7.1 Except where the non-rostered day falls on a Saturday or a Sunday, where a full-time Dayworker’s ordinary hours of work are rostered structured to work but are include a day off and such day off falls on a Public Holiday, the employee is entitled to a substitute day off on an alternative week day agreed with the Company.
31.7.2 This provision does not required apply to work. This also includes Continuous Shiftworkers as payment for all Public Holiday’s that fall on a day that Holidays (worked and non-rostered) has been calculated in the Employee is not rostered to work. This clause will only apply when the Public Holiday(s), as provided for in clause 63.1, which falls on any day between Monday and FridayContinuous Shiftworker annualised salary.

15.3 An employee who is required to and does work on any public holiday falls during a weekend, the first subsequent ordinary weekday will be treated in lieu as the public holiday. Except in the case of continuous shift workers, in which case the holiday shall fall on the actual day prescribed
63.3. All work performed on any of the public holidays prescribed in this Agreement clause shall be paid for at in lieu of all other shift allowances (except broken shift allowances), weekend penalties, casual loading and part-time loading, the rate Basic Periodic Rate of double time and one half. An Employee Pay plus a Public Holiday loading of 150 percent.
15.4 If an employee is required to work on a public holiday, they can by agreement with the employer, exchange the rostered shift on the public holiday shall be afforded at least 8 hours’ with another willing employee. Any employee that exchanges rostered public holiday shifts and does not work or paid for 8 hours at the appropriate ratepublic holiday, will receive no remuneration.
63.415.5 This Agreement expressly contemplates that the employer will require work on public holidays, or particular public holidays, and the parties acknowledge that the nature of the work performed by the employee, the type of employment (for example, whether full-time, part-time, casual or shift work) and the nature of the employer’s workplace or enterprise (including its operational requirements) will require work on public holidays, or particular public holidays. The Company may request the Employee No employee shall unreasonably refuse a direction to work on a public holiday. The Employee may refuse the request if they have reasonable grounds to do so.
63.5. Shift Worker(s) (excluding casuals) will be paid their ordinary time earnings for the Employee’s wage rate for a Public Holiday they are rostered to work but are not required to work. (d) Where an employee is absent on the last working day prior to work the public holiday, or on a the first working day following the public holiday without authorisation from the Company, for reasons of illness, the Company requires a medical certificate to be provided upon the employees return to work.
(e) A public holiday for the purpose of this Agreement shall be afforded at least 8 hours’ work or paid for 8 hours at a 24 hour period midnight to midnight on the appropriate rate.

h. An Employee may request to work but are not required to work. (i) A full-time employee is entitled to either payment for each public holiday or a substituted day's leave;
(ii) A part-time employee is entitled to either payment for each public holiday or a substituted day's leave provided that the part-time employee would have been ordinarily rostered to work on that day had it not been a public holiday;
(iii) Where a public holiday would have fallen on a Saturday or a Sunday but is substituted for another day all employees who would ordinarily have worked on such Saturday or Sunday but who are not rostered to work on such day are entitled to payment for the public holiday or a substituted day's leave;
(iv) Where Christmas day falls on a Saturday or a Sunday and the public holiday is observed on another day an employee required to work on Christmas day (ie 25 December) is to be paid at the rate of double time;
(v) Nothing in clause 7.15 confers a right to any employee to payment for a public holiday shall be afforded at least 8 hours’ work or paid for 8 hours at the appropriate rateas well as a substituted day in lieu.

63.2. With the exception of Easter Saturday, in the event that any public holiday falls during a weekend, the first subsequent ordinary weekday will be treated in lieu as the public holiday. Except in the case of continuous shift workers, in which case the holiday shall fall on the actual day prescribed
63.3. All work performed on any of the public holidays in this Agreement shall be paid for at the rate of double time and one half. An Employee required to work on a public holiday shall be afforded at least 8 hours’ work or paid for 8 hours at the appropriate rate.
63.4. The Company may request the Employee to work on a public holiday. The Employee may refuse the request if they have reasonable grounds to do so.
63.5. Shift Worker(s) (excluding casuals) will be paid their ordinary time earnings for the Employee’s wage rate for a Public Holiday they are rostered to work but are not required to work. This also includes payment for Public Holiday’s that fall on a day that the Employee is not rostered to work. This clause will only apply when : ▪ Good Friday ▪ Christmas Day, 25 December ▪ Anzac Day, 25 April ▪ News Years Day, 1 January ▪ Boxing Day, 26 December ▪ Easter Saturday, ▪ Easter Monday, ▪ the Public Holiday(s)birthday of the Sovereign, ▪ Labour Day, ▪ the day gazetted as provided for in clause 63.1the local district Agricultural, which Horticultural and Industrial Show Day, ▪ Australia Day, 26 January; and ▪ any other day appointed as a Holiday under the Holidays Act 1983.
5.6.2 Where the actual public holiday falls on a weekend day and the following week day is substituted as a public holiday, the actual date of the public holiday will be treated as a public holiday for the purposes of this clause. The substituted public holiday will be worked as a normal day and will not attract overtime rates unless the Employee is required to work overtime as prescribed by clause 4.4.
5.6.3 However, where there is agreement between the Employer and the majority of employees concerned, the public holiday may be substituted for another day.
5.6.4 All work performed by permanent Employees on a public holiday listed in Clause 5.6.1 (or where substituted in accordance with clause 5.6.3) shall be paid at rate of Double Time and a half.
5.6.5 If a full time Employee is rostered off on a public holiday, he/she is entitled to eight hours pay at his/her ordinary time rate. Provided that an Employee who is normally rostered to work Monday to Friday only will not receive payment for any public holiday which is gazetted on a weekend.
5.6.6 Part-time Employees normally rostered to work on a public holiday (or where substituted in accordance with clause 5.6.3) shall, if not required to work on that holiday be paid for the actual number of hours that the Employee would normally work on such day between Monday at the appropriate rate.
5.6.7 Casual Employees shall be paid double time and Fridaya half for all work performed on a public holiday and such payment shall be for a minimum of four (4) hours.

50.2 In a district in which a show holiday is not appointed under the State Holidays Act (QLD) 1983, the employee and Company must agree on an ordinary working day that is to be treated as a public holidayshow holiday for all purposes.

50.8 When a full-time employee‟s rostered day off falls on a public holiday and cannot be moved to another day, they will be paid their ordinary time earnings rostered hours for the Employee’s wage rate for that day.
50.9 Where a Public Holiday they are rostered to work but are not required to work. This also includes payment for Public Holiday’s that fall public holiday falls on a Saturday or Sunday but is observed on a Monday or Tuesday, employees will be paid for working the Saturday or Sunday at the penalty rates for Saturdays and Sundays. Where employees work on the gazetted Monday or Tuesday public holiday, the employees will be paid in accordance with this clause.
50.10 Where overtime is worked on a public holiday either as a whole additional shift or as additional hours worked on the day above any ordinary hours, payment will be at double the overtime rate that would be applicable if the Employee is day was not rostered to work. This clause will only apply when the Public Holiday(s), as provided for in clause 63.1, which falls on any day between Monday and Fridaya public holiday.

26.5 A public holiday prescribed by this Agreement occurring during the taking of annual leave shall be added to the period of such leave.
26.6 An Employee employee required to work on a any of the said public holiday holidays shall be afforded at least 8 hours’ work or paid for 8 a full day or shift. Provided that this subclause shall not apply to an employee who ceased work on the holiday concerned without the authority of the employer.
26.7 In the following circumstances an employee shall be paid in respect of the relevant public holidays as though he had continued his employment without interruption, viz: If the employer closes down the plant at which the employee is employed for a period which includes the Easter or Christmas public holidays, and:_
26.7.1 the employee is discharged (other than for misconduct) by the employer less than fourteen days before the shut-down period, and
26.7.2 that employee is re-engaged by the employer not more than fourteen days after the shut-down period.
26.8 Where the shift roster prescribed in accordance with this Agreement provides for the ordinary hours for five-day shift workers to commence after midnight on Sunday and finish after midnight on Friday, and the employer regularly treats any part of a Tuesday following a Monday which is a holiday prescribed by this clause to be part of that holiday then the employer shall be entitled to treat an equal part of any Friday which is a holiday prescribed by this clause as part of ordinary working hours.
26.9 Provided that an equal part of the following Saturday is regarded as part of that holiday; and provided further that, if the majority of the employees concerned at the appropriate rateplace of work so desire, the shift roster for the week concerned shall be changed in accordance with the relevant clause of this Agreement to commence at 12 midnight on the Sunday or such other time as may be mutually agreed between the employer and the union or unions concerned.
63.4. The Company may request 26.10 For 12 hour shifts, if the Employee to work employees normal shift does not fall on a public holiday. The Employee may refuse the request if they have reasonable grounds to do so.
63.5. Shift Worker(s) (excluding casuals) will , then he/she shall be paid their ordinary time earnings for the Employee’s wage rate for a Public Holiday they are rostered to work but are not required to work. 63.3. All work performed on any of the public holidays in this Agreement shall be paid for at the rate of double time and one half. An Employee required d) Subject to Clause 26 g), unless employees are requested to work on a public holiday shall they are entitled to that day off.

63.2. With the exception of Easter Saturday, in the event that any public holiday falls during a weekend, the first subsequent ordinary weekday will be treated in lieu as the public holiday. Except in the case of continuous shift workers, in which case the holiday shall fall on the actual day prescribed
63.3. All work performed on any of the public holidays in this Agreement shall be paid for at the rate of double time and one half19.4. An Employee employee rostered to work and who is not required to work on a public holiday shall will be afforded paid at least 8 hours’ work or the Relevant Rate of Pay for the rostered Ordinary Hours the employee would have otherwise worked on the public holiday, except Transport Operations Employees who will be paid at the Ordinary Rate of Pay.
19.5. Casual employees will only be paid for 8 public holidays on which they work.

19.6.1. Who work Ordinary Hours on 1 January, ANZAC Day or 25 December will be paid at 1.5 times the Relevant Rate of Pay for the hours actually worked;
19.6.2. Who work Ordinary Hours on Labour Day will be paid at 2.5 times the Relevant Rate of Pay for the hours actually worked;
19.6.3. Who work stand-alone overtime on a public holiday, payment will be at the appropriate higher of the overtime rate or the public holiday rate.
63.419.7. The Company may request the Employee to Aggregate Wage Employees who work on a public holiday. The Employee may refuse the request if they have reasonable grounds to do so.
63.5. Shift Worker(s) (excluding casuals) holiday will be paid their ordinary at 200% x (Relevant Rate of Pay plus the aggregate allowance) for time earnings actually worked. All Ordinary Hours worked on a public holiday will be credited to cycle time.

(a) Permanent Full time and part-time hourly employees shall be paid at 225% of the base rate for all hours worked, with a minimum payment of four (4) hours

7.8.5 As an alternative to workpayment stated in cl. This clause will only apply when the Public Holiday(s7.8.4(a), as permanent full-time and part-time hourly employees may elect, with the agreement of the Employer, to receive payment for hours worked on a public holiday at the rate of 125% of the base rate, with an amount of paid time equivalent to the hours worked on the public holiday to be added to the employee’s annual leave balance.
7.8.6 Except for the circumstances provided for in clause 63.17.8.7, which salaried employees are not entitled to additional payment for time worked on a public holiday or time off as compensation for time worked on a public holiday.
7.8.7 Where the Christmas day holiday and Good Friday holiday falls on a salaried Employee’s rostered day off, the salaried Employee will receive a day in lieu to be taken within 6 months at a mutually agreed time.

8.2.1 The Employer is committed to providing equal opportunity for employees in all spheres of employment.
8.2.2 The Employer has an anti-discrimination policy that encompasses the zero-tolerance approach taken on matters including workplace discrimination, workplace bullying and/or sexual harassment in the workplace. All employees are required to comply with this policy.
8.2.3 The Employer will deal with any day between Monday allegations of any breach of this policy seriously, promptly and Fridayin confidence and will take all reasonable steps to protect from victimisation any employee who makes a complaint.

63.2. 63.3. All work performed on any receipt of the public holidays in this Agreement shall be paid for at the rate salary of double time and one half. An Employee required Level 5 or above, rostered to work on a public holiday shall be afforded at least 8 hours’ work or paid as follows:
53.4.1 time and a half for 8 the first eight hours and thereafter at the appropriate raterate of double time and a half.
63.4. 53.4.2 where a public holiday falls on a Saturday all time worked to be paid at the rate of double time and a half.
53.5 The Company may request payments prescribed in 53.4 shall be paid to an Employee Level 5 and above where such work is undertaken at the Employee to work direction of the Employer.
53.6 Time worked on a public holidayholiday on which a time and a half penalty is paid will be counted as part of the week's work for calculation of overtime on a weekly basis. The Employee may refuse the request if they have reasonable grounds to do soTime worked on a public holiday on which a double time and a half penalty is paid will stand alone and will not be counted for calculation of weekly overtime.
63.5. Shift Worker(s) (excluding casuals) 53.7 Penalties paid for working on a public holiday is in lieu of any other penalties which may be due for working on that day.
53.8 In addition to the penalties prescribed in 53.4, any Employee who works on a public holiday will be paid their ordinary time earnings for entitled to an additional day's pay unless the Employee elects to have a day added to the Employee’s wage rate for 's annual leave or agrees to take the day at some other time agreed time. Where an Employee works into a day which is a Public Holiday, but does not work later than 3:00 am on the Public Holiday, will be deemed not to have worked on a Public Holiday they are rostered for the purposes of this subclause.
53.9 A part-time employee is entitled to work but are not required to work. Public Holidays. 63.1. An Employee
8.01 The following Public Holidays shall be recognized:

(b) On days celebrated in lieu thereof, regardless of the day on which it falls, subject to the conditions in Article 8.02, 8.03.
(c) In addition to the above statutory holidays, effective June 5th, 2018 the employee will be entitled to one float holiday to be taken at a mutually convenient time within the following public holidays collective agreement year. 8.02 An employee will be paid for said holiday provided he/she,
(a) works all of his/her last regularly scheduled day of work before the public holiday or all of his/her first regularly scheduled day of work after the public holiday, unless he/she is absent for reasons satisfactory to the Employer;
(b) is on the active payroll of the Employer and not on a leave of absence, sick leave, Workers Safety Insurance or lay-off;
(c) has completed the probationary period specified in this Agreement.
8.03 If any employee works any of the said holidays, he/she shall be paid for all hours worked on the holiday at one and one-half (1.5) his/her regular straight-time rates without deduction hourly rate-of-pay in addition to his/her holiday pay as herein provided for.
8.04 Holiday pay will be equivalent to a normal shift at the employee’s regular basic rate of pay including all appropriate shift loadings: • pay.
8.05 For statutory holidays with the exception of Christmas Day and New Year’s Day; • Australia Day; • Good Friday; • Easter Saturday; • Easter Sunday , the Employer shall post a sign up sheet five (if gazetted 5) weeks in accordance with clause 63.2 below) • Easter Monday; • Anzac Day; • King’s Birthday; • Labour Day; • Grand Final Eve • Melbourne Cup Day; • Boxing Day; • Christmas Day; and • Any other day (including the gazetted substitution of public holidays when they coincide with a weekend) declared by or under a law advance of the State statutory holiday for those employees wishing to work. 63.4. The Company may request the Employee 19.6 Should an employee be required to work on a public holiday: Minimum Engagement
19.6.1 Where such work is not performed as part of a shift that: - commences on the day immediately prior to the public holiday, or - finishes on the day immediately after the public holiday, the minimum engagement shall be four hours. The Employee may refuse Employees Other than Casual Employees

With Where the project employs a large number of Non-Local Employees, with the exception of Easter SaturdayChristmas Day, Boxing Day and New Year’s Day, the Projects managing contractor may elect to keep the Site open for work on all Public Holidays.
(c) Employees may be required to work on a Public Holiday. Where the Employer requires an Employee to work on a Public Holiday, they will provide one week’s notice of such a requirement. Where an Employee does not wish to work on a Public Holiday, he or she must notify their Employer at least one (1) week before that Public Holiday falls.
(d) Payment for all time worked on a Public Holiday shall be at time and a half for the hours worked, except that any time worked after 8 hours on a Public Holiday shall be paid at three times the relevant Employee’s Base Hourly Rate. In addition, the Employee will receive payment for the Public Holiday (8 hours at the Employee’s Ordinary Hours Base Hourly Rate) in the event that any public holiday falls during Employee’s ordinary pay cycle.
(e) An Employee other than a weekend, the first subsequent ordinary weekday will be treated in lieu as the public holiday. Except in the case of continuous shift workers, in which case the holiday shall fall worker who works on the actual day prescribed

An Employee (other than a casual Employee) shall be entitled to the following 29.1 The recognised NSW State public holidays paid to be observed at ordinary time rates without deduction of pay including all appropriate shift loadings: • the Plant/s are New Year’s Day; • , Australia Day; • , Good Friday; • , Easter Saturday; • , Easter Sunday Sunday, Easter Monday, Anzac Day, King’s Birthday, Labour Day, Christmas Day and Boxing Day.
29.2 In addition to the recognised NSW State public holidays in clause 29.1, employees are entitled to an additional holiday (if gazetted to be taken and treated as a Public Holiday) on Easter Tuesday and any other day declared and observed as a Public ▇▇▇▇▇▇▇▇ throughout the whole of NSW.
29.3 The Company and employees may agree to observe an alternative day to the above Public Holidays. A majority of employees is needed and all employees are bound by the agreement. In cases of such agreement, Public Holiday conditions will apply to the alternative day, not to the Public Holiday being substituted.
29.4 Employees may be requested and required to work a Public Holiday in accordance with clause 63.2 below) • Easter Monday; • Anzac Day; • Kingthe NES. Employees rostered to work a Public Holiday as part of their normal shift arrangements will be paid double time for the ordinary hours worked in addition to the Public Holiday payment for the ordinary hours for the shift. All hours worked beyond the employee’s Birthday; • Labour Day; • Grand Final Eve • Melbourne Cup Day; • Boxing Day; • Christmas Day; and • Any other day (including ordinary hours for the gazetted substitution of public holidays when they coincide with a weekend) declared by or under a law of the State of Victoria to shift will be observed generally within the State as a public holidaypaid at triple time.
63.2. With 29.5 Employees not rostered to work a Public Holiday and who work the exception Public Holiday (after the Company requests them to do so), will receive payment of Easter Saturday, in triple time for the event time worked on that any public holiday falls during a weekend, the first subsequent ordinary weekday will be treated in lieu as the public holiday. Except in the case of continuous shift workers, in which case the holiday shall fall on the actual day prescribedPublic Holiday.
63.3. All work performed on any of the public holidays in this Agreement shall be paid for at the rate of double time 29.6 An employee who is not requested and one half. An Employee required to work on a public holiday shall be afforded at least 8 hours’ work or paid for 8 hours at the appropriate rate.
63.4. The Company may request the Employee to work on Public Holiday which would otherwise have been a public holiday. The Employee may refuse the request if they have reasonable grounds to do so.
63.5. Shift Worker(s) (excluding casuals) working day will be paid ordinary hours of their ordinary time earnings normal shift plus average bonus for that day.
29.7 The shift length and shift times for work on Public Holidays, is the Employee’s wage rate for normal shift length and shift time.
29.8 For weekend roster and seven (7) day rostered employees, if a Public Holiday they are falls on a non- rostered day the employee is paid seven (7) hours at ordinary rates.
29.9 If a Public Holiday falls on a day (Monday to Friday) on which an employee is not normally required to work but are and the employee is not requested and required to work, they are paid seven (7) hours at ordinary rates. 29.10 Employees working a weekend roster or seven (7) day roster shall be requested and required to work all Public Holidays that fall on a within their roster, except for two (2) Public Holidays. This clause will only apply when the Public Holiday(s), as provided for in clause 63.1, which falls five days per week and whose hours are worked on any day between Monday and Fridayof the week depending on the stage of the roster, will receive a day’s pay, when they miss out on a public holiday due to it falling on their day off due to the stage of the roster. This does not apply to employees who are not employed to work five days a week but do so at times due to working additional hours.

23.7 When a full-time employee’s rostered day off falls on a public holiday and cannot be moved to another day, they will be paid their ordinary time earnings rostered hours for the Employee’s wage rate for that day.
23.8 Where a Public Holiday they are rostered to work but are not required to work. This also includes payment for Public Holiday’s that fall public holiday falls on a Saturday or Sunday but is observed on a Monday or Tuesday, employees will be paid for working the Saturday or Sunday at the penalty rates for Saturdays and Sundays. Where employees work on the gazetted Monday or Tuesday public holiday, the employees will be paid in accordance with this clause.
23.9 Where overtime is worked on a public holiday either as a whole additional shift or as additional hours worked on the day above any ordinary hours, payment will be at double the overtime rate that would be applicable if the Employee is day was not rostered to work. This clause will only apply when the Public Holiday(s), as provided for in clause 63.1, which falls on any day between Monday and Fridaya public holiday.

Public Holidays. 63.1. 63.2. With the exception 10.7.6 If an Act of Easter Saturday, in the event that any public holiday falls during a weekend, the first subsequent ordinary weekday will be treated in lieu as the public holiday. 63.3. All work performed on for any of the above- named public holidays, the special rates shall only be payable for work done on the day substituted.
10.7.7 Where an Employee is absent from their employment on the working day before, or the working day after a public holiday, they shall provide a Doctors Certificate or other acceptable evidence to support an application for such leave on the day.
10.7.8 Employees in receipt of pay for public holidays in this Agreement while receiving workers compensation benefits, shall be paid in accordance with Clause 11.1.2.
10.7.9 Public holidays may be substituted for at alternative days by agreement between the rate of double time Company and one halfan Employee. An Employee required to work on Where an alternative day is substituted for a public holiday shall in accordance with this clause, penalty rates will only be afforded at least 8 hours’ work or paid for 8 hours at payable if an Employee works on the appropriate ratealternative day.
63.4. The 10.7.10 Where any day or half day, other than those listed in clause 10.9.5 of this Agreement, is gazetted as a public holiday in the area where the Employee is scheduled to work, the Company may request the Employee to work on a in the area where the public holidayholiday is being observed. The Employee may shall not unreasonably refuse a request to work in accordance with Section 114 of the request if they have reasonable grounds to do soFW Act.
63.5. Shift Worker(s10.7.11 In the case where an Employee works in the circumstance described in clause 10.9.10 of this Agreement, it is further agreed in accordance with Section 115 of the FW Act that:
(a) (excluding casuals) Where an Employee agrees to work a full-day, that day will be regarded as a normal working day, and an additional one and a half days’ paid their ordinary time earnings leave during the Christmas – New Year period will be substituted for the Employee’s wage rate for a Public Holiday they are rostered public holiday; or
(b) Where an Employee agrees to work but are not required to work. This also includes payment a half-day, that half-day will be regarded as a normal working half-day and an additional days’ paid leave during the Christmas – New Year period will be substituted for Public Holiday’s that fall on a day that the Employee is not rostered to work. This clause will only apply when the Public Holiday(s), as provided for in clause 63.1, which falls on any day between Monday and Fridaypublic holiday.
