Common use of Public Holidays Clause in Contracts

Public Holidays. (a) The Project recognises the following gazetted Public Holidays: (1) New Year’s Day (2) Australia Day (3) Good Friday (4) Easter Saturday (5) Easter Monday (6) ANZAC Day (7) May Day (8) Queen’s Birthday (9) Picnic Day (10) Darwin Show day (11) Christmas Day (12) Boxing Day (13) or a day declared in lieu of any such day or days above other than Christmas Day and Boxing Day (14) any additional day gazetted by the relevant Northern Territory Minister. (b) Employees, other than casual Employees, are entitled to observe these days as holidays without deduction of Ordinary Hours’ pay. Where the project employs a large number of Non-Local Employees, with the exception of Christmas Day, Boxing Day and New Year’s Day, the Projects managing contractor may elect to keep the Site open for work on all Public Holidays. (c) Employees may be required to work on a Public Holiday. Where the Employer requires an Employee to work on a Public Holiday, they will provide one week’s notice of such a requirement. Where an Employee does not wish to work on a Public Holiday, he or she must notify their Employer at least one (1) week before that Public Holiday falls. (d) Payment for all time worked on a Public Holiday shall be at time and a half for the hours worked, except that any time worked after 8 hours on a Public Holiday shall be paid at three times the relevant Employee’s Base Hourly Rate. In addition, the Employee will receive payment for the Public Holiday (8 hours at the Employee’s Ordinary Hours Base Hourly Rate) in the Employee’s ordinary pay cycle. (e) An Employee other than a shift worker who works on a Public Holiday shall be paid for at least four (4) hours at the applicable rate. (f) Where a Public Holiday occurs during a period of R&R leave, Employees shall receive payment for eight (8) Ordinary Hours at the relevant Employee’s Base Hourly Rate.

Where the project employs a large number of Non-Local Employees, Public Holidays will be paid in accordance with the exception of Christmas DayEmployment Standards Act, Boxing Day and New Year’s Day2000, the Projects managing contractor may elect as amended time to keep the Site open for work on all Public Holidaystime. (c) Employees may An employee who is required to work on any of the foregoing holidays shall be paid at the rate of one and one half (1 ½) times her regular straight time pay for all hours worked on such holiday, in addition to the Public Holiday Pay for that day in accordance with the Employment Standards Act, 2000, as amended from time to time. 17.02 Subject to staffing exigencies, a nurse who works Christmas/ Boxing Day shall not be required to work New Year’s Eve Day/New Year’s Day. The Employer will endeavour to rotate the requirement to work Christmas/Boxing Day with New Year’s Eve Day/New Year’s Day on a Public Holidayalternate years. Where Time off at Christmas shall be shall be defined as being off December 24th ,25th ,26th and time off at New Years shall be defined as being off December 31 and January 1st. Request for time off at Christmas or New Years shall be submitted in writing to the Employer requires an Employee by November 15th. The master schedule may be adjusted to work on a Public Holidayallow for scheduling requests over the Christmas/New Year’s period, they will provide one week’s notice of such a requirement. Where an Employee does not wish between December15th to work on a Public Holiday, he or she must notify their Employer at least one (1) week before that Public Holiday fallsJanuary 15th. (d) Payment for all time 17.03 Time worked on a Public Holiday the holidays listed in 17.01 (a) between 0001 hours and 2400 hours shall be at time deemed to be work performed on the holiday and a half for the hours worked, except that any time worked after 8 hours on a Public Holiday all work shall be paid at three times the relevant Employee’s Base Hourly Rate. In addition, rate of time and one half the Employee will receive payment for the Public Holiday (8 hours at the Employee’s Ordinary Hours Base Hourly Rate) in the Employee’s ordinary pay cyclestraight time hourly rate of pay. (e) An Employee other than 17.04 Where a shift worker who works holiday falls during a full-time nurse’s scheduled vacation period, her vacation shall be extended by one day unless mutually agreed to schedule a different day off. Where a holiday falls on a Public Holiday shall full-time nurse’s scheduled day off, an additional day off may be paid for at least four (4) hours at the applicable ratescheduled. (f) Where a Public Holiday occurs during a period of R&R leave, Employees shall receive payment for eight (8) Ordinary Hours at the relevant Employee’s Base Hourly Rate.

Public Holidays. All five-day gazetted workers shall be allowed every public holiday prescribed by the relevant Northern Territory Ministerthis subclause without loss of pay. (b) EmployeesIn addition to those public holidays prescribed in subclause (a) of this clause, other than casual Employees, employees are entitled to observe these days as holidays without deduction of Ordinary Hours’ payan extra public holiday each year. Where In respect of the Employer requires an Employee to work time worked on a Public Holidaypublic holiday, they will provide one week’s notice payment shall be made for a minimum of such four hours‘ work, and any balance of the day or shift not worked shall be paid at ordinary rates. (ii) Where a requirement. Where an Employee does not wish to work public holiday falls on a Public Holidayrostered day off of a full-time shift worker as defined in Clause 11 - Definitions, he or she must notify their Employer at least who receives four weeks annual leave in accordance with paragraph (ii) of subclause (a) of Clause 22 - Annual Leave and Leave Loading, such shift worker shall be paid one day‘s pay in addition to the appropriate ordinary weekly rate. In addition, the Employee will receive payment for the Public Holiday (8 hours at the Employee’s Ordinary Hours Base Hourly Rate) in the Employee’s outside ordinary pay cyclehours. (e) An Employee other than a shift worker who works on a Public Holiday shall be paid for at least four (4) hours at the applicable rate. (f) Where a Public Holiday occurs during a period of R&R leave, Employees shall receive payment for eight (8) Ordinary Hours at the relevant Employee’s Base Hourly Rate.

Public Holidays. (ai) The Project recognises the following gazetted Public Holidays: (1) New Year’s Day (2) Australia Day (3) Good Friday (4) Easter Saturday (5) Easter Monday (6) ANZAC Day (7) May Day (8) Queen’s Birthday (9) Picnic Day (10) Darwin Show day (11) Christmas Day (12) Boxing Day (13) or For full time and part time employees, where a public holiday falls on a day declared in lieu that the employee would have ordinarily been rostered to work, that employee shall be allowed such Public Holiday without loss of any such day or days above other than Christmas Day and Boxing Day (14) any additional day gazetted by Base Rate of Pay, for the relevant Northern Territory Ministertime they would have worked, had it not been a Public Holiday. (bii) EmployeesThe following days shall be public holidays, other than casual EmployeesNew Year's Day, are entitled to observe these days as holidays without deduction of Ordinary Hours’ pay. Where the project employs a large number of Non-Local EmployeesAustralia Day, with the exception of Good Friday, Easter Saturday, Easter Sunday, Easter Monday, Anzac Day, Queen's Birthday, Eight Hour Day, Christmas Day, Boxing Day and any other day or part thereof proclaimed and observed as a public holiday within the area in which the facility is situated. (iii) In each calendar year, where no additional public holiday (or part thereof) in accordance with subclause (i) above is proclaimed and observed, the Employer shall grant an extra public holiday, to be observed on the August Bank Holiday, or on a day between Christmas Day and New Year’s Day, the Projects managing contractor may elect to keep the Site open for work on all Public Holidays. (civ) Employees The Employer may be required request an employee to work on a public holiday. (v) The employee may refuse the request (and instead have a Public HolidayHoliday off without loss of Base Rate of Pay) if the employee has reasonable grounds for doing so. Where the Employer requires In determining whether an Employee employee has reasonable grounds for refusing a request to work on a Public Holidaypublic holiday, they will provide one week’s notice regard must be had to the matters set out in Section 114 of such a requirement. Where an Employee does not wish to work on a Public Holiday, he or she must notify their Employer at least one (1) week before that Public Holiday fallsthe Act. (dvi) Payment This Agreement expressly contemplates that the Employer will require work on public holidays and the parties acknowledge that the nature of the work performed by the employee, the type of employment of the employee (for all example, whether full-time, part-time, casual or shift work) and the nature of the Employer’s business, will require work on public holidays, from time worked to time. (vii) An employee who is required to and does work on a Public Holiday shall be at time and a half for the hours worked, except that any time worked after 8 hours on a Public Holiday public holiday prescribed in this clause shall be paid at three times in lieu of all other shift allowances and weekend penalties as follows: a) Full-time Employees and Part time employees: In addition to the relevant Employee’s Base Hourly RateRate of Pay of Pay, time and one half (150%) for all nominal hours worked. In additionAlternatively, if the Employee will receive payment for employee elects, in addition to the Public Holiday Base Rate of Pay of Pay, half-time extra (8 hours at 50%), plus the Employee’s Ordinary Hours Base Hourly Rate) time of in the Employee’s ordinary pay cycle. (e) An Employee other than a shift worker who works lieu on a Public Holiday time-for-time basis. Such time shall be taken as mutually agreed between the employer and employee and in any case no more than 9 months after the accrual. Where the leave is not taken it shall be paid for at least four (4) hours at the applicable rateout. (f) Where a Public Holiday occurs during a period of R&R leave, Employees shall receive payment for eight (8) Ordinary Hours at the relevant Employee’s Base Hourly Rate.

Public Holidays. (a) The Project recognises Public holidays shall be allowed to employees on full pay. Where an employee is required to and does work on any of the holidays set out in this subclause, whether for a full shift or not, the employee shall be paid one and one-half day's pay in addition to the weekly rate, such payment to be in lieu of weekend or shift allowances which would otherwise be payable had the day not been a public holiday. Provided that, if the employee so elects, he/she may be paid one half day's pay in addition to the weekly rate and have one day added to his/her period of annual leave for each holiday worked in lieu of the provisions of the preceding paragraph. (b) For the purpose of this clause the following gazetted Public Holidaysshall be deemed public holidays, viz, New Year's Day, Australia Day, Good Friday, Easter Saturday, Easter Monday, Anzac Day, Queen's Birthday, local Labour Day, Christmas Day, Boxing Day, and any other day proclaimed and observed as a public holiday within the area in which the hospital or health institution is situated. (c) Shift workers rostered off duty on a public holiday shall: (1) New Year’s Daybe paid one day's pay in addition to the weekly rate; or if the employees so elect, (2) Australia Day (3) Good Friday (4) Easter Saturday (5) Easter Monday (6) ANZAC Day (7) May Day (8) Queen’s Birthday (9) Picnic Day (10) Darwin Show day (11) Christmas Day (12) Boxing Day (13) or a have one day declared in lieu added to their period of any such day or days above other than Christmas Day and Boxing Day (14) any additional day gazetted by the relevant Northern Territory Minister. (b) Employees, other than casual Employees, are entitled to observe these days as holidays without deduction of Ordinary Hours’ pay. Where the project employs a large number of Non-Local Employees, with the exception of Christmas Day, Boxing Day and New Year’s Day, the Projects managing contractor may elect to keep the Site open for work on all Public Holidays. (c) Employees may be required to work on a Public Holiday. Where the Employer requires an Employee to work on a Public Holiday, they will provide one week’s notice of such a requirement. Where an Employee does not wish to work on a Public Holiday, he or she must notify their Employer at least one (1) week before that Public Holiday fallsannual leave. (e) An Employee other than a shift worker Provided that an employee who works on a Public Holiday shall has accrued additional leave referred to in paragraph (a) and (c) of this subclause can elect at any time to be paid an amount equivalent to the value of the accrued additional leave in lieu of taking additional leave, provided that the amount is a minimum of one week’s accrued additional leave and that the salary for at least four (4) hours at the applicable rateperiod of additional leave and that the salary for the period of additional leave paid out will be calculated as if the period was actually taken. (fii) Where In addition to those public holidays prescribed in paragraph (b) of subclause (i) of this clause, employees are entitled to an extra public holiday each year. Such public holiday will occur on a Public Holiday occurs during day in the Christmas-New Year period as determined by the employer following consultation with the Employees and the Union, or other elected representative as nominated by the employee, or other suitable day as agreed between the employer and the Employees and the Union, or other elected representative as nominated by the employee. For the purposes of this Agreement and in accordance with the NSW Public Holidays Act, 2010, the following gazetted Public Holidays: (1) shall be deemed to be public holidays for employees working in NSW: ▪ New Year’s Day (2) Day ▪ Australia Day (3) Day ▪ Good Friday (4) Friday ▪ Easter Saturday (5) Saturday ▪ Easter Monday (6) ANZAC Day (7) May Day (8) Sunday ▪ Easter Monday ▪ Anzac Day ▪ Queen’s Birthday (9) Picnic Day (10) Darwin Show day (11) Christmas Day (12) Boxing Day (13) or a day declared in lieu of any such day or days above other than Birthday ▪ Labour Day ▪ Christmas Day ▪ Boxing Day ▪ CPA Day* and Boxing Day (14) any other day duly proclaimed and observed as a public holiday for the State. *This additional day gazetted by public holiday will occur on a date in the relevant Northern Territory Minister. (b) Employees, other than casual Employees, are entitled to observe these days as holidays without deduction of Ordinary Hours’ pay. Where the project employs a large number of Non-Local Employees, with the exception of Christmas Day, period between Boxing Day and New Year’s Day, the Projects managing contractor may elect to keep the Site open which is not a gazetted public holiday and will be regarded for work on all Public Holidayspurposes of this clause as any other public holiday. (c) Employees may b. In accordance with the ACT Holidays Act, 1958, employees working in the ACT receive the following public holidays: ▪ New Year’s Day ▪ Australia Day ▪ Canberra Day ▪ Good Friday ▪ Easter Saturday ▪ Easter Sunday ▪ Easter Monday ▪ Anzac Day ▪ Queen’s Birthday ▪ Labour Day ▪ Family & Community Day ▪ Christmas Day ▪ Boxing Day and any other day that the Minister declares to be required a holiday in the ACT. c. Where a public holiday falls on a day that a full or part-time employee is normally rostered to work, they shall be entitled to the day off and be paid for their normal rostered hours at their base rate of pay. d. Where a public holiday falls on a day that a full or part-time employee is not normally rostered to work, there is no entitlement to payment for that Public Holiday. e. If CPA requests an employee to work on a Public Holiday. Where public holiday, the Employer requires an Employee employee may refuse the request if they have reasonable grounds, as defined by the NES. f. The allowances applicable to work on a Public Holiday, they will provide one week’s notice of such a requirement. Where an Employee does not wish to work on a Public Holiday, he or she must notify their Employer at least one (1) week before that Holidays are set out in clause 8.4 Public Holiday fallsPenalties. (d) Payment for all time worked on a Public Holiday shall be at time and a half for the hours worked, except that any time worked after 8 hours on a Public Holiday shall be paid at three times the relevant Employee’s Base Hourly Rate. In addition, the Employee will receive payment for the Public Holiday (8 hours at the Employee’s Ordinary Hours Base Hourly Rate) in the Employee’s ordinary pay cycle. (e) An Employee other than a shift worker who works on a Public Holiday shall be paid for at least four (4) hours at the applicable rate. (f) Where a Public Holiday occurs during a period of R&R leave, Employees shall receive payment for eight (8) Ordinary Hours at the relevant Employee’s Base Hourly Rate.

Public Holidays. (a) The Project recognises ‌ Section 18.01 Permanent, Part-time and Seasonal employees shall be entitled to the following gazetted Public Holidays: (1) holidays without loss of pay. ⮚ New Year’s Years Day ⮚ Good Friday ⮚ Easter Monday ⮚ Christmas Day ⮚ Australia Day ⮚ Anzac Day ⮚ Queen's Birthday ⮚ Labour Day ⮚ Boxing Day ⮚ Melbourne Cup Day (2) Australia DaySection 18.02 And any other day which by act of Parliament or proclamation may be created a public holiday or may be substituted for those holidays in the State of New South Wales. (3) Good Friday (4) Section 18.03 During the term of this Agreement the Monday prior to Melbourne Cup Day will be taken as a public holiday. Upon expiry of this Agreement the Melbourne Cup Holiday will cease to be observed as a Public Holiday in lieu of Easter Saturday, at the Buronga Hill Winery site. (5) Easter Monday (6) ANZAC Day (7) May Day (8) Queen’s Birthday (9) Picnic Day (10) Darwin Show day (11) Christmas Day (12) Boxing Day (13) or a Section 18.04 By agreement between an employee and the employer an alternative day declared may be taken as the Public Holiday in lieu of any such day or of the days above other than Christmas listed in section 18.01. All ordinary time worked on the actual Public Holiday, if substituted, will be paid at ordinary time rates. All time worked on the substituted Public Holiday will be paid at double time and a half. Section 18.05 Section 18.04 does not apply to Good Friday, Anzac Day and Boxing Christmas Day. (14) Section 18.06 Permanent employees wanting to celebrate any additional Public Holiday on the designated day gazetted will need to apply for leave without pay, annual leave or rostered day off if it has been agreed to substitute the Public Holiday as in section 18.04. Section 18.07 If the employee is required by the relevant Northern Territory Minister. (b) Employees, other than casual Employees, are entitled to observe these days as holidays without deduction of Ordinary Hours’ pay. Where the project employs a large number of Non-Local Employees, with the exception of Christmas Day, Boxing Day and New Year’s Day, the Projects managing contractor may elect to keep the Site open for work on all Public Holidays. (c) Employees may be required employer to work on a Public Holidaypublic holiday or on a substituted day, they shall be granted time off in lieu, or paid double time and a half. Where the Employer requires an Employee An employee may refuse to work on the designated day if the employee has reasonable grounds for doing so. Section 18.08 Should any public holiday prescribed in this agreement fall on a Public Holidayday which an employee is rostered for availability, they will provide one week’s notice of such employee shall upon mutual agreement receive time in lieu, or double time and a requirementhalf. Public Holidays. (a) 17.01 The Project recognises the following gazetted Public Holidays: (1) days will be observed as public holidays during each calendar year: New Year’s 's Day (2) Australia Day (3) , Good Friday (4) Easter Saturday (5) Easter Monday (6) ANZAC , Victoria Day (7) May , Canada Day (8) Queen’s Birthday (9) Picnic , Saskatchewan Day (10) Darwin Show day (11) Christmas , Labour Day (12) Boxing , Thanksgiving Day (13) or a day declared in lieu of any such day or days above other than Christmas Day and Boxing , Remembrance Day (14) any additional day gazetted by the relevant Northern Territory Minister. (b) Employees, other than casual Employees, are entitled to observe these days as holidays without deduction of Ordinary Hours’ pay. Where the project employs a large number of Non-Local Employees, with the exception of Christmas Day, Boxing Day, Family Day and New Year’s Daya floating statutory holiday. i. For those employees working on continuous shift work schedules, the Projects managing contractor may elect to keep holidays will be observed on the Site open for work dates on which the holiday falls; ii. For all Public Holidaysother employees, when any such holiday falls on a Saturday, the preceding Friday shall be considered as the holiday and where such holiday falls on a Sunday, the following Monday shall be considered as the holiday. When Christmas day falls on a Sunday, then the Monday following will be observed as Christmas Day and the Tuesday following as Boxing Day. When Boxing Day falls on a Saturday, then the preceding Friday will be observed as Boxing Day and the preceding Thursday will be observed as Christmas Day. (c) iii. Employees may who are regularly scheduled to work 12 hour shifts on Family Day will be required to work as scheduled and paid in accordance with the provisions of Article 17. 17.02 The following public holiday provisions shall apply to all employees: i. Work performed on a Public Holidaypublic holiday shall be voluntary. ii. Where Employees working on a public holiday on a voluntary basis shall be paid two (2) times their base hourly rate for all hours worked, in addition to the Employer requires an Employee eight (8) hours public holiday pay. iii. Employees working a compressed work week who are scheduled to work on a Public Holiday, they will provide one week’s notice of such a requirement. Where an Employee does public holiday but are not wish required to work by the Company will receive their scheduled hours pay provided that they meet the conditions outlined in 17.04. iv. It is agreed by both parties that certain essential services will have to be maintained during such public holidays. For the purposes of this Article “essential services” will be Powerhouse Operators. v. Powerhouse Operators will be required to be present at work during the time of a public holiday. Overtime will be paid as per the CBA but will not be considered as voluntary overtime if the employee is scheduled to work the shift on which a Public Holiday, he or she must notify their Employer at least one (1) week before that Public Holiday public holiday falls. (d) Payment for all time worked on a Public Holiday shall be at time and a half for the hours worked, except that any time worked after 8 hours on a Public Holiday shall be paid at three times the relevant Employee’s Base Hourly Rate. In addition, the Employee will receive payment for the Public Holiday (8 hours at the Employee’s Ordinary Hours Base Hourly Rate) in the Employee’s ordinary pay cycle. (e) An Employee other than a shift worker 17.03 Any employee who works on a Public Holiday shall public holiday will be paid given the option of another day off without pay in lieu of the public holiday, subject to the mutual agreement of the employee and the Company and provided such agreement is in advance of the day off. The employee must notify the Company of the intention to elect this option prior to the public holiday in question. Absence on either the qualifying day before a holiday or the qualifying day after the holiday for reasons of the employee's sickness, accident, or authorized leave of absence shall not disqualify the employee for payment for the holiday. Absence due to sickness or accident must be proved by a doctor's certificate if required by the Company. Absence on both qualifying days for any reason other than death in the immediate family shall disqualify the employee for payment for the holiday. ii. An employee who is required to work a shift (other than Christmas Day and Boxing Day (14a day shift) any additional day gazetted by the relevant Northern Territory Ministerwhich falls on a public holiday must work that shift. 1) The employee must be paid in addition to the rates applicable for that day, an additional rate of time and one-half for all work performed on that shift (bi.e., on rostered workday - ordinary rates, plus appropriate shift penalty, plus time and one-half); or 2) Employees, other than casual Employees, are at the employee’s election be paid at the rate of time and one-half for the work performed and be then entitled to observe these days an alternative paid day off (i.e., known as holidays without deduction Leave-in-Lieu). (c) Employees may employee be paid? An employee who is not required to work on a Public Holidaypublic holiday must be paid: 1) a full shift’s salary for that day; or 2) at the employee’s election, be entitled to a paid day off (i.e., known as Leave-in-Lieu). Where Who is eligible? All employees (other than casual employees). How is Leave-in-Lieu managed? Unless otherwise agreed between the Employer requires employee and MTC, an Employee to work on a Public Holiday, employee must give MTC four weeks notice in writing of when they will provide one week’s notice of such a requirement. Where an Employee does not wish to work on a Public Holidaytake that alternative day off. Approval of Leave-in-Lieu will be subject to operational requirements but will not be unreasonably withheld. The employee must be provided with written notification of the alternative day off being approved or not approved within 14 days of the application being received by MTC. Application must be made prior to the 30 November each year and if not taken and an alternative day off cannot be agreed between MTC and the employee by March 30th of the following year, he or she must notify their Employer then the employee will be paid out at least one the employee’s ordinary rate of pay. What should the employee be paid? The alternative day off (1i.e., known as Leave-in-Lieu day) week before that Public Holiday falls. (d) Payment for all time worked on a Public Holiday shall be at time and a half for the hours worked, except that any time worked after 8 hours on a Public Holiday shall will be paid at three times the relevant Employee’s Base Hourly Rate. In addition, the Employee will receive payment for the Public Holiday (8 hours at the Employee’s Ordinary Hours Base Hourly Rate) in the Employeeemployee’s ordinary pay cyclerate of pay. (e) An Employee other than a shift worker who works on a Public Holiday shall be paid for at least four (4) hours at the applicable rate. (f) Where a Public Holiday occurs during a period of R&R leave, Employees shall receive payment for eight (8) Ordinary Hours at the relevant Employee’s Base Hourly Rate.

Public Holidays. 14.01 Public Holidays are New Year's Day, Family Day, Good Friday, Easter Monday, Victoria Day, Canada Day, Civic Holiday, Labour Day, Thanksgiving Day, Remembrance Day (awhen it falls on Monday to Friday inclusive), Christmas Day, Boxing Day, plus three (3) Floating Holidays per contract year. The Project recognises Floating Holidays must be taken within the contract year they are granted, are at the request of the employee and subject to the convenience of the Corporation. If a new employee terminates prior to completion of the probationary period and one or more Floating Holiday has been taken, the Corporation shall recover such overpayment. The parties agree that these holidays and the manner in which they are provided are at least an equal benefit to any provided by legislation. When employees are not working on a rotating shift schedule and when Christmas, New Year's Day or Canada Day fall on a Saturday or Sunday, the following gazetted Monday shall be observed as the Public Holidays:Holiday. When Christmas falls on a Saturday or Sunday, the following Tuesday shall be observed as the Boxing Day Public Holiday. When Christmas falls on a Friday, the following Monday shall be observed as the Boxing Day Public Holiday. Employees on lay-off are not entitled to those public holidays that fall during the period of their lay-off. As well the three Floating Holidays will be pro- rated in accordance with the number of months worked per year by such employees. 14.02 An employee is allowed 8 hours* at straight time pay for the day upon which a Public Holiday is observed, regardless of whether or not such a day is a scheduled working day. An employee scheduled to work on any observed Public Holiday shall have the option of receiving 8 hours* at straight time pay as provided above or shall be allowed one day in lieu at straight time pay. Employees working on a rotating schedule (1as per Article 12.01(a)(ii) are entitled to twelve (12) hours for the following public holidays: New Year’s Day (2) Australia Day (3) , Good Friday (4) Easter Saturday (5) , Easter Monday , Remembrance Day (6) ANZAC Day (7) May Day (8) Queen’s Birthday (9) Picnic Day (10) Darwin Show day (11) Christmas Day (12) Boxing Day (13) or when it falls on a day declared in lieu of any such day or days above other than Monday through Friday inclusive), Christmas Day and Boxing Day (14) . Lieu days should be taken within 12 months of date earned, subject to management approval. Monetary equivalent to lieu days may be taken at employee's option. This provision is subject to any additional lieu day gazetted by plan that the relevant Northern Territory Ministerparties are able to agree upon. (b) Employees, other than casual Employees, are entitled to observe these days as holidays without deduction of Ordinary Hours’ pay. Where the project employs a large number of Non-Local Employees, with the exception of Christmas Day, Boxing Day and New Year’s Day, the Projects managing contractor may elect to keep the Site open 14.03 Employees will be paid double their hourly rate for work on all Public Holidays. (c) Employees may be required to work scheduled hours worked on a Public Holiday. Where the Employer requires an Employee to work on a Public Holiday, they will provide one week’s notice of such a requirement. Where an Employee does not wish to work on a Public Holiday, he or she must notify their Employer at least one (1) week before that Public Holiday falls. (d) Payment for all time worked on a Public Holiday shall be at time and a half for the hours worked, except that any time worked after 8 hours on a Public Holiday shall be paid at three times the relevant Employee’s Base Hourly Rate. In addition, the Employee will receive payment for the Public Holiday (8 hours at the Employee’s Ordinary Hours Base Hourly Rate) in the Employee’s ordinary pay cycle. Public Holidays. ‌ 12.1 The following days shall be observed as public holidays: New Year's Day 2 January Waitangi Day Good Friday Easter Monday ANZAC Day Sovereign's Birthday Labour Day Christmas Day Boxing Day Otago Anniversary Day Matariki 12.2 In order to maintain essential services, the employer may require an employee to work on a public holiday when the public holiday falls on a day which, but for it being a public holiday, would otherwise be a working day for the employee. 12.3 An employee required to work on a public holiday as part of the normal roster (i.e., not as overtime) shall be paid at ordinary time in addition to normal salary, and is also to be granted a day’s leave on pay at a later date agreed between the employee and employer. 12.4 An employee required to be on call on a public holiday shall be granted a day in lieu at a later date agreed between the employee and employer. 12.5 Employees agree that the employer will have a close down over the Christmas- early January period. 12.6 Mercy Hospital will observe Otago Anniversary Day on the Tuesday after Easter. Otago Anniversary Day will be a normal working day for staff, who are rostered to work. 12.7 Off duty day upon which the employee does not work: (a) The Project recognises the following gazetted Public Holidays: (1) New Year’s Day (2) Australia Day (3) Good Friday (4) Easter Saturday (5) Easter Monday (6) ANZAC Day (7) May Day (8) Queen’s Birthday (9) Picnic Day (10) Darwin Show day (11) Christmas Day (12) Boxing Day (13) or Where a day declared in lieu of any such day or days above public holiday is observed on other than Christmas Day and Boxing Day (14) any additional day gazetted by the relevant Northern Territory Ministera Saturday or Sunday please reference conditions as Clause 12.3. (b) EmployeesPart-time employees – Where a part-time employee’s days of work are fixed, other than casual Employees, are the employee shall only be entitled to observe these public holiday provisions if the day would otherwise be a working day for that employee. Where a part-time employee’s days as holidays without deduction are not fixed, the employee shall be entitled to public holiday provisions if they worked on the day of Ordinary Hours’ the week that the public holiday falls more than 40 % of the time over the last three months. Payment will be relevant daily pay. (a) The Project recognises 3.3.1 Subject to the provisions of this Agreement, unless you are required to work, Five Day Roster Employees will be entitled to the following gazetted Public Holidays: (1) New Year’s Day (2) Australia Day (3) Good Friday (4) Easter Saturday (5) Easter Monday (6) ANZAC Day (7) May Day (8) Queen’s Birthday (9) Picnic Day (10) Darwin Show day (11) Christmas Day (12) Boxing Day (13) public holidays or a day declared in lieu of any such day or days above other than Christmas Day and Boxing Day (14) any additional day gazetted by the relevant Northern Territory MinisterQueensland State Government to be observed in lieu of such public holidays, without loss of pay: New Year’s Day Australia Day Good Friday Easter Saturday Easter Sunday Easter Monday Anzac Day Labour Day Queen’s Birthday Clermont Show Day Christmas Eve (part day) Christmas Day Boxing Day 3.3.2 Any of these days may be moved to another day by agreement between ▇▇▇▇▇▇▇▇▇ and the majority of directly affected Employees. In those circumstances the agreed day becomes the Public Holiday and the former day becomes an ordinary working day. 3.3.3 If you are working shift work (seven day roster) and you are required to work on a public holiday no additional payments apply as the remuneration provided under clause 2.7 and/or the additional annual leave entitlement in clause 3.1 comprehends such work. 3.3.4 If you are working shift work (seven day roster) and an additional public holiday, or a second public holiday for one of the public holidays listed in clause 3.3.1, is gazetted by the Queensland State Government, you will be entitled to the following payment in addition to your Total Remuneration: (a) If you are not rostered to work on the public holiday, you will be paid your Base Hourly Rate multiplied by the ordinary hours per shift under your roster; (b) EmployeesIf you are rostered to work on the public holiday, other than casual Employees, are entitled to observe these days as holidays without deduction of Ordinary Hours’ pay. Where you will be paid your Base Hourly Rate multiplied by the project employs a large number of Nonrostered hours of the shift. 3.3.5 For the purposes of clause 3.3.4, if a rostered shift spans both a public holiday and a non-Local Employees, with the exception of Christmas Day, Boxing Day and New Year’s Daypublic holiday, the Projects managing contractor may elect shift will be considered to keep have been worked on the Site open for public holiday if the majority of the hours are rostered on the public holiday. If an equal amount of hours are rostered on the public holiday and non-public holiday, the shift will be considered to have been worked on the public holiday if it ends on the public holiday. 3.3.6 If you are working day work (five day roster) and you are required to work on all Public Holidaysany public holiday in addition to the payment in Clause 2.7, you will receive an additional credit to your annual leave entitlement as follows: (a) Up to and including four (4) hours work, a credit of half a day; (b) More than four (4) hours work, a credit of one (1) day. (c) 3.3.7 Five Day Roster Employees may can only be required to work on a Public Holidaypublic holiday if Grosvenor and the Union agree that such Employees can be required to work on that public holiday. Where Grosvenor will, if practicable, give one (1) weeks’ notice of the Employer requires an Employee requirement to work on a Public Holidaypublic holiday. 3.3.8 Notwithstanding clause 3.3.2, they you will provide one week’s notice of such a requirement. Where an Employee does not wish be required to work on a two (2) of the Public Holiday, he or she must notify their Employer at least one (1) week before that Public Holiday fallsholidays nominated in 3. 3.1. These two (d2) Payment days will be as agreed between ▇▇▇▇▇▇▇▇▇ and the majority of Employees. Where either of those days is Christmas Day or Boxing Day, those days must be observed on 25 and 26 December respectively. The start times for all time these holidays will be the end of Christmas Eve day shift with work commencing again on Boxing Day night shift. Any shift worked on a Public Holiday shall be at time Christmas and a half for the hours worked, except that any time worked after 8 hours on a Public Holiday shall Boxing Day will be paid at three times the relevant Employee’s Base Hourly Rate. In addition, the Employee will receive payment for the Public Holiday (8 hours at the Employee’s Ordinary Hours Base Hourly Rate) in the Employee’s double time on ordinary pay cycletime. (e) An Employee other than a shift worker who works on a Public Holiday shall be paid for at least four (4) hours at the applicable rate. (f) Where a Public Holiday occurs during a period of R&R leave, Employees shall receive payment for eight (8) Ordinary Hours at the relevant Employee’s Base Hourly Rate.

Public Holidays. Entitlement - The public holidays for the purpose of this Project shall be: • Christmas Day • Boxing Day • New Years Day • Australia day • Good Friday • Easter Saturday • Easter Monday • Anzac Day • Labour Day • Queens Birthday • Gladstone Show Holiday (aas gazetted) The Project recognises the following gazetted All full time Employees shall be entitled to payment for these Public HolidaysHolidays without loss of ordinary pay, except where: (1) New Year’s DayAn employee is absent without the consent of the Company or absent without reasonable cause (termination of employment; or (2) Australia Day (3) Good Friday (4) the Public holidays falls on a Rostered Day Off. Where a public holiday falls on an Employee’s Rostered Day Off and the Employee does not work the public holiday, the Employee shall be entitled to payment for the public holiday at the Employee’s ordinary time rate for 7.6 ordinary hours. For example, if the Employee has an RDO on Easter Friday and they do not work the day they shall be entitled to 7.6 ordinary hours pay at their ordinary time rate. This clause does not apply to Easter Saturday . An Employee who does not work Easter Saturday is not entitled to payment. Employees may be required to work on public holidays. Any Employee required to work on a public holiday nominated herein shall be paid at the rate of double time and half for all time so worked (5) Easter Monday (6) ANZAC Day (7) May Day (8) Queen’s Birthday (9) Picnic Day (10) Darwin Show with a minimum payment of four hours). It will be available for the Employer and a majority of the affected employees to substitute the nominated public holiday for another day (11) Christmas Day (12) Boxing Day (13) or a day declared in lieu , and the prescriptions of any such day or days above other than Christmas Day this clause will apply to the substituted day. A weekly employee who has been employed continuously for two weeks and Boxing Day (14) any additional day gazetted who is terminated by the relevant Northern Territory Minister. (b) EmployeesEmployer or stood down during December, other than casual Employees, are entitled to observe these days as and is re-employed by the Employer at any time before the end of January in the following year; shall be paid for the public holidays without deduction of Ordinary Hours’ pay. Where the project employs a large number of Non-Local Employees, with the exception of Christmas Day, Boxing Day and New Year’s Day, Years Day when those days occur during the Projects managing contractor may elect to keep the Site open for work on all Public Holidays. (c) Employees may be required to work on a Public Holiday. Where the Employer requires an Employee to work on a Public Holiday, they will provide one week’s notice of such a requirement. Where an Employee does not wish to work on a Public Holiday, he or she must notify their Employer at least one (1) week before that Public Holiday falls. (d) Payment for all time worked on a Public Holiday shall be at time and a half for the hours worked, except that any time worked after 8 hours on a Public Holiday shall be paid at three times the relevant Employee’s Base Hourly Rate. In addition, the Employee will receive payment for the Public Holiday (8 hours at the Employee’s Ordinary Hours Base Hourly Rate) in the Employee’s ordinary pay cycle. (e) An Employee other than a shift worker who works on a Public Holiday shall be paid for at least four (4) hours at the applicable rate. (f) Where a Public Holiday occurs during a period of R&R leave, Employees shall receive payment for eight (8) Ordinary Hours at the relevant Employee’s Base Hourly Ratetermination or standing down.

Public Holidays. (a) The Project recognises the following gazetted Public Holidays: (1) New Year’s DayA Caregiver (other than a casual caregiver, store person, gardener, driver or maintenance person) shall be entitled to 2 weeks public holiday leave in respect of each year of continuous service. (2) Australia DayPublic holiday leave shall accrue on an hourly basis in respect of each ordinary hour worked. (3) Good FridayPublic holiday leave shall be paid at ordinary rates only, and shall be taken at a time or times agreed between the Employer and the Caregiver or at the direction of the Employer in accordance with sub- clause (7) of this Agreement. (4) Easter SaturdayWhere a Caregiver is rostered to work on a public holiday or day observed in lieu thereof, he or she shall be entitled to ordinary rates of pay and a loading of 50% for the actual time worked. (5) Easter MondayIn lieu of the provision contained at sub clause (4) above where a gazetted public holiday falls on a Sunday and the caregiver is required to work on this day they shall be entitled to ordinary rates of pay and a loading of 75% for the actual time worked. (6) ANZAC DayIf a Public Holiday falls on a day that a Caregiver is not rostered to work then no additional payment or day in lieu will be provided. (7) May DayWhere a Caregiver is not required to work on a public holiday or a day observed in lieu thereof and as a result works fewer than his/her contracted hours in that fortnight the deficit will be deducted from the Caregiver’s public holiday leave entitlements and paid to the Caregiver. Provided that where a Caregiver has insufficient accrued public holiday leave entitlements to cover the deficit then either: (a) a deduction will be made from another form of paid leave (other than annual leave); or (b) if the Caregiver has insufficient accrued paid leave (other than annual leave), the Caregiver will be deemed to be on leave without pay. (8) QueenThe Employer recognises Caregivers’ entitlement to be absent on a public holiday as per s.114 of the Act, and entitlements for payment for absence on a public holiday as per s.116 of the Act; and will ensure that no Caregiver’s Birthdayminimum entitlements to public holidays under the NES will be reduced through the operation of this clause. (9) Picnic DayAt any time public holiday leave may be: (a) cashed out; or (b) taken as leave, whether or not in conjunction with other leave types (10) Darwin Show dayAccrued public holiday leave will be paid out on termination. (11) Christmas DayA Caregiver employed regularly as a store person, gardener, driver or maintenance person: (12a) Boxing Day (13) who is not required to work on a public holiday, or a day declared observed in lieu thereof, shall be paid the caregiver’s ordinary rate for the caregiver’s ordinary hours of any such work they would have received on that day or days above other than Christmas Day and Boxing Day (14) any additional day gazetted by the relevant Northern Territory Ministerhad it not been a public holiday. (b) Employees, other than casual Employees, are entitled to observe these days as holidays without deduction of Ordinary Hours’ pay. Where the project employs a large number of Non-Local Employees, with the exception of Christmas Day, Boxing Day and New Year’s Day, the Projects managing contractor may elect to keep the Site open for work on all Public Holidays. (c) Employees may be who is required to work on a Public Holidaypublic holiday, or day observed in lieu thereof, shall be entitled to ordinary rates of pay and a loading of 150% for the actual time worked. Where Provided that the Employer requires Caregiver may elect to receive in lieu of the loading of 150% a loading of 50% together with an Employee to work on a Public Holiday, they will provide one week’s notice equivalent period of such a requirement. Where an Employee does not wish to work on a Public Holiday, he or she must notify their Employer at least one (1) week before that Public Holiday falls. (d) Payment time off for all the actual time worked on the public holiday to be taken at a Public Holiday shall be at time and a half for convenient to the hours worked, except that any time worked after 8 hours on a Public Holiday shall be paid at three times the relevant Employee’s Base Hourly Rate. In addition, the Employee will receive payment for the Public Holiday (8 hours at the Employee’s Ordinary Hours Base Hourly Rate) in the Employee’s ordinary pay cycleEmployer. (e) An Employee other than a shift worker who works on a Public Holiday shall be paid for at least four (4) hours at the applicable rate. (f) Where a Public Holiday occurs during a period of R&R leave, Employees shall receive payment for eight (8) Ordinary Hours at the relevant Employee’s Base Hourly Rate.

(b) Employees, other than casual Employees, are entitled to observe these days as holidays without deduction of Ordinary Hours’ pay. Where the project employs a large number of Non-Local Employees, with the exception of paid public holidays: Christmas Day, Boxing Day, New Year's Day, 2nd January, Good Friday, Easter Monday, Easter Tuesday, the birthday of the reigning sovereign, Matariki, Labour Day, Provincial Anniversary, Waitangi Day and New Year’s Day, the Projects managing contractor may elect to keep the Site open for work Anzac Day when they fall on all Public Holidaysa Monday-Friday working day. 42.2 The employer shall pay the employee’s relevant daily pay (cor average daily pay where appropriate) Employees may for the above holidays to all permanent employees performing work coming within the scope of this agreement who have been employed by the employer at any time during the fortnight ending on the day on which the holiday occurs. Except that where a permanent employee is employed part-time, they shall not be paid for any such holidays, which fall on a day of the week on which they would not otherwise work. 42.3 A part year early childhood teacher whose ordinary hours of work fall on a public holiday shall be paid for the number of hours usually worked on that day. For holidays that fall outside their work period but on a day normally worked during their work period, they shall be paid on a pro-rata basis calculated in relation to the number of weeks actually worked, or to be worked, in the relevant calendar year as a percentage of 52 for statutory holidays falling outside their work period on a day that they otherwise would normally have worked. 42.4 The provisions of the Holidays Act 2003 shall apply where an employee is required to work on a Public Holidayany part of public holiday. Where the Employer requires an Employee to work employee works on a Public Holidaypublic holiday, they whether or not that day would otherwise be a working day for the employee, s/he will provide one week’s notice be paid the portion of such a requirement. Where an Employee does not wish his/her relevant daily pay (or average daily pay where appropriate) that relates to work on a Public Holiday, he or she must notify their Employer at least one (1) week before that Public Holiday falls. (d) Payment for all the time actually worked on a Public Holiday shall be at that day, plus half that amount again (time and a half half). Where the day would otherwise have been a working day for the hours workedemployee, except that any time worked after 8 hours on a Public Holiday shall s/he will also be entitled to an alternative holiday to be paid at three times his/her relevant daily pay (or average daily pay where appropriate) irrespective of the relevant Employee’s Base Hourly Rate. In addition, number of hours that s/he worked on the Employee will receive payment for the Public Holiday (8 hours at the Employee’s Ordinary Hours Base Hourly Rate) in the Employee’s ordinary pay cyclepublic holiday. (e) An Employee other than a shift worker who works on a Public Holiday 42.5 Any alternative holiday to which the employee becomes entitled shall be paid for taken at least four (4) hours at a time agreed between the applicable rateparties. If the parties cannot reach agreement as to when an alternative holiday is to be taken the employer may give the employee 14 days’ written notice of the requirement to take the alternative holiday. (f) Where a Public Holiday occurs during a period of R&R leave, Employees shall receive payment for eight (8) Ordinary Hours at the relevant Employee’s Base Hourly Rate.

Public Holidays. (Should the company determine not to work then Public Holidays shall be taken in accordance with those days listed in clause 52. Should the company determine to work then the company shall notify employees at least seven days prior to the public holiday date. The company will first ask personnel on the rostered shifts if they are willing to work. If there is insufficient number of employees from that rostered shift then employees rostered off will be asked to work that shift. If finally there are not enough volunteers then those employees rostered on will be required to work to ensure continuity of supply. Payment I hours accumulated for Public Holidays shall be determined on the following basis; a) The Project recognises Employees rostered to work on a Public Holiday and who; i. take the following gazetted Public Holidays: (1) New Year’s Day (2) Australia Day (3) Good Friday (4) Easter Saturday (5) Easter Monday (6) ANZAC Day (7) May Day (8) Queen’s Birthday (9) Picnic Day (10) Darwin Show holiday because the company has determined not to work that day (11) Christmas Day (12) Boxing Day (13) or a day declared in lieu of any such day or days above other than Christmas Day and Boxing Day (14) any additional day gazetted by , will accumulate Normal Hours for the relevant Northern Territory Ministercycle equal to their daily rostered hours of work at that time. ii. work will accumulate Normal Hours equal to the scheduled rostered hours of work for that day and will receive additional payment for the actual hours worked (bsubject to the provisions of Clause 25) Employeescalculated at the employee's hourly rate of pay plus 10%, other than casual Employeesexcept, are entitled to observe these days for the holiday designated as holidays without deduction of Ordinary Hours’ pay. Where the project employs a large number of Non-Local Employees, with the exception of Christmas Day, Boxing Day and New Year’s Day, the Projects managing contractor may elect to keep additional payment for hours worked shall be calculated at the Site open for work on all Public Holidaysemployees hourly rate of pay plus 50%. (c) Employees Where a Public Holiday falls during the employee's rostered days off the number of hours equal to the employee's scheduled rostered hours for that day, had the employee been rostered to work, shall be accrued to the employee's annual leave hours bank. Such additional leave may be taken at a time agreed by the individual employee and the Company or paid in cash in accordance with the provisions of clause 29. Where an, employee is required to work on a Public Holidaypublic holiday failing during the employee's rostered days off, the employee will accumulate Normal Hours equal to the actual hours worked for that day (subject to the provisions of Clause 25) and will receive in addition payment for such hours calculated at the employee's hourly rate of pay plus 10% except, for the holiday designated as Christmas Day, the additional payment for hours worked shall be calculated at the employees hourly rate of pay plus 50%. Where the Employer requires an Employee Provisions for 31 above shall not apply to work on a Public Holiday, they will provide one week’s notice of such a requirement. Where an Employee does not wish to work on a Public Holiday, he or she must notify their Employer at least one (1) week before that Public Holiday falls. (d) Payment for all time worked on a Public Holiday shall be at time and a half for the hours worked, except that any time worked after 8 hours failing on a Public Holiday shall be paid at three times the relevant EmployeeSaturday or Sunday for employees who’s Base Hourly Rate. In addition, the Employee will receive payment for the Public Holiday (8 hours at the Employee’s Ordinary Normal Hours Base Hourly Rate) in the Employee’s ordinary pay cycleare rostered Monday to Friday. (e) An Employee other than a shift worker who works on a Public Holiday shall be paid for at least four (4) hours at the applicable rate. (f) Where a Public Holiday occurs during a period of R&R leave, Employees shall receive payment for eight (8) Ordinary Hours at the relevant Employee’s Base Hourly Rate.

Public Holidays. Where the project employs a large number of Non-Local Employees, Public Holidays will be paid in accordance with the exception of Christmas DayEmployment Standards Act, Boxing Day and New Year’s Day2000, the Projects managing contractor may elect as amended time to keep the Site open for work on all Public Holidaystime. (c) Employees may An employee who is required to work on any of the foregoing holidays shall be paid at the rate of one and one half (1 ½) times the nurse’s regular straight time pay for all hours worked on such holiday, in addition to the Public Holiday Pay for that day in accordance with the Employment Standards Act, 2000, as amended from time to time. 17.02 Subject to staffing exigencies, a nurse who works Christmas/ Boxing Day shall not be required to work New Year’s Eve Day/New Year’s Day. The Employer will endeavour to rotate the requirement to work Christmas/Boxing Day with New Year’s Eve Day/New Year’s Day on a Public Holidayalternate years. Where Time off at Christmas shall be defined as being off December 24th, 25th, 26th and time off at New Years shall be defined as being off December 31 and January 1st. Request for time off at Christmas or New Years shall be submitted in writing to the Employer requires an Employee by November 15th. The master schedule may be adjusted to work on a Public Holidayallow for scheduling requests over the Christmas/New Year’s period, they will provide one week’s notice of such a requirement. (d) Payment for all time 17.03 Time worked on a Public Holiday the holidays listed in 17.01 (a) between 0001 hours and 2400 hours shall be at time deemed to be work performed on the holiday and a half for the hours worked, except that any time worked after 8 hours on a Public Holiday all work shall be paid at three times the relevant Employee’s Base Hourly Rate. In addition, rate of time and one half the Employee will receive payment for the Public Holiday (8 hours at the Employee’s Ordinary Hours Base Hourly Rate) in the Employee’s ordinary pay cyclestraight time hourly rate of pay. (e) An Employee other than 17.04 Where a shift worker who works holiday falls during a full-time nurse’s scheduled vacation period, their vacation shall be extended by one day unless mutually agreed to schedule a different day off. (d) Payment Effective April 3rd, 2023 or with the implementation of the new HR Information System, WorkDay, whichever comes first, at a time mutually agreeable to the employee and the Employer, a day that is substituted for all a public holiday shall be taken no more than three (3) months after the paid holiday. If not taken with three (3) months the Employer will revert to the payment of the holiday pay. 17.02 Request for time off at Christmas or New Year shall be submitted in writing to the Employer by October 15th. The schedule for the Christmas/New Year period shall be approved and posted by November 15th. The master schedule may be adjusted to allow for said scheduling requests over the Christmas /New Year period, between December 15th to January 15th. 17.03 Time worked on a Public Holiday the holidays listed in 17.01 (a) between 0001 hours and 2400 hours shall be at time deemed to be work performed on the holiday and a half for the hours worked, except that any time worked after 8 hours on a Public Holiday all work shall be paid at three times the relevant Employee’s Base Hourly Rate. Public Holidays. 38.1. The Company will observe Easter Saturday and the public holidays and part-day public holidays provided for by the NES. Where you live and work in a different State, Territory or locality, you will be entitled to the public holidays and part-day public holidays in the State, Territory or locality where you usually work. 38.2. Public holiday conditions will apply on these days or part-days. If you work in South Australia, you will not be entitled to public holiday conditions on Sundays unless the Sunday is one of the public holidays noted above. 38.3. If you work (not live) in a place in which a public holiday or part day public holiday has been declared or prescribed, you can have the day or part-day off and be paid; or, if you are required to work, you will receive the prescribed penalty or overtime rates where you are eligible. 38.4. You will usually be entitled to a paid day or part-day off on days or part days declared as public holidays. However, we may ask you to work so long as the request is reasonable. You can refuse to work if our request is not reasonable or if you have reasonable grounds to refuse to work. Some of the things that we will take into account when considering what’s reasonable will include: TELSTRA CORPORATION LIMITED (ABN 33 051 775 556) TELSTRA INFRACO FIXED ENTERPRISE AGREEMENT 2022-2024 a) The Project recognises what work you do; b) the Company’s business requirements; c) your personal circumstances, including any family or carer responsibilities; and d) how much notice the Company gives you. 38.5. Public holidays for employees on particular hours arrangements a) If you work full-time under one of the following gazetted Public Holidaysarrangements: (1i) New Year’s Daya scheduled hours arrangement; (2ii) Australia Daya shiftwork arrangement; (3iii) Good Fridaythe Flexible Working Hours Scheme; or (4iv) Easter Saturday (5) Easter Monday (6) ANZAC Day (7) May Day (8) Queen’s Birthday (a 9) Picnic Day (10) Darwin Show day (11) Christmas Day (12) Boxing Day (13) or -day fortnight; and a public holiday falls on a day declared when you could have been scheduled to work ordinary hours but were not scheduled to work, you will receive either: v) an additional day’s pay, or vi) a day off in lieu to be taken within 4 weeks of any such day or days above other than Christmas Day and Boxing Day (14) any additional day gazetted by the relevant Northern Territory Ministerpublic holiday. (b) EmployeesIf this day off in lieu is not possible, other than casual Employees, are entitled to observe these days as holidays without deduction of Ordinary Hours’ we will pay you an additional day’s pay. Where the project employs The calculation of an additional day’s pay will be based on your average daily hours excluding penalties. Payment will be adjusted proportionately where only part of your ordinary hours fall on a large number of Non-Local Employees, with the exception of Christmas Day, Boxing Day and New Year’s Day, the Projects managing contractor may elect to keep the Site open for work on all Public Holidayspublic holiday. (c) Employees may be required to If you ordinarily work between Monday and Friday only, public holidays that fall on a Public Holiday. Where the Employer requires an Employee to work on a Public Holiday, they will provide one week’s notice of such a requirement. Where an Employee does not wish to work on a Public Holiday, he Saturdays or she must notify their Employer at least one (1) week before that Public Holiday fallsSundays are excluded. (d) Payment for all time worked on a Public Holiday shall be at time and a half for the hours worked, except that any time worked after 8 hours on a Public Holiday shall be paid at three times the relevant Employee’s Base Hourly Rate. In addition, the Employee will receive payment for the Public Holiday (8 hours at the Employee’s Ordinary Hours Base Hourly Rate) in the Employee’s ordinary pay cycle. Where the project employs a large number of Non-Local Employees, with the exception of Christmas Day, Boxing Day and public holidays: New Year’s Day, Australia Day, Good Friday, Easter Saturday, Easter Monday, Anzac Day, Queen’s Birthday, Labour Day, Christmas Day, Boxing Day, August bank Holiday or any holiday duly proclaimed and observed as a public holiday within the Projects managing contractor may elect area in which the service is situated. 42.2 Gazetted public holidays shall be allowed to keep the Site open for full time, part time and fixed term employees on full pay on those days on which they are normally required to work. 42.3 Where an employee who is not a shift worker is required to and does work on all Public Holidays.a public holiday, the employee shall: (a) choose to be paid and in such case the employee would receive their ordinary pay for the day plus payment for actual time worked at single time; or (b) choose to take the equivalent time off and in such case the employee would receive their ordinary pay for the day and the equivalent time off for the actual time worked; or (c) Employees may be subject to mutual agreement between the employee and the employer, aggregate the equivalent time off with annual leave entitlements. 42.4 Where an employee who is a shift worker and is required to and does work an ordinary rostered shift on a Public Holiday. Where public holiday, the Employer requires an Employee to work on a Public Holiday, they will provide one week’s notice of such a requirement. Where an Employee does not wish to work on a Public Holiday, he or she must notify their Employer at least one (1) week before that Public Holiday falls. (d) Payment for all time worked on a Public Holiday employee shall be at paid double time and a half for the hours worked, except that any time worked after 8 hours on a Public Holiday shall be paid at three times the relevant Employee’s Base Hourly Rate. In addition, the Employee will receive payment for the Public Holiday (8 hours at the Employee’s Ordinary Hours Base Hourly Rate) in the Employee’s ordinary pay cyclesuch shift. (e) An Employee other than 42.5 Where an employee, who is a shift worker whose shift includes a gazetted public holiday, who works is then not required by the employer to work that gazetted public holiday, shall have a day added to their annual holidays, or be paid a days pay additional to their weekly wage. 42.6 In addition One (1) day of cultural/religious significance (e.g. National Aboriginal Day) to the employee may be deemed a public holiday by mutual agreement between the employer and employee. Thisis to be negotiated with the Coordinator in the first three (3) months of employment. Any additional cultural/religious days requested by the employee must be traded off against the centre's nominated public holidays listed under Clause 42.1. 42.7 For those workers employed for 28 hours or more per week, when a public holiday falls on their regular weekly day off or during annual leave, another day can be taken off at a time mutually agreed upon by the employee and the Centre Coordinator. 42.8 Part –Time employees regardless of their normal days of work will not be disadvantaged by where specified public holidays fall. Where specified public holidays fall on an employee’s usual day of work they are entitled to their usual rate of pay for that day. Where specified public holidays fall on a Public Holiday shall weekday that is not a usual day of work for that employee they are entitled to accrue overtime on a pro- rata hour for hour basis. This will be paid for at least four (4) hours at recorded as a time –in-lieu accrual and the applicable rateprovisions of Clause 14 apply. (f) Where a Public Holiday occurs during a period of R&R leave, Employees shall receive payment for eight (8) Ordinary Hours at the relevant Employee’s Base Hourly Rate.

(b) Employees, other than casual Employees, are entitled to observe these days as holidays without deduction of Ordinary Hours’ pay. Where the project employs a large number of Non-Local Employees, with the exception of Christmas Day, period between Boxing Day and New Year’s Day, the Projects managing contractor may elect to keep the Site open which is not a gazetted public holiday and will be regarded for work on all Public Holidayspurposes of this clause as any other public holiday. (c) Employees may b. Where a public holiday falls on a day that a full or part-time employee is normally rostered to work, they shall be entitled to the day off and to be paid for their normal rostered hours at their ordinary rate of pay. d. Where a public holiday falls on a day that a full or part-time employee is not normally rostered to work, there is no entitlement to payment for that public holiday. e. If CPA requests an employee to work on a Public Holiday. Where public holiday, the Employer requires an Employee employee may refuse the request if they have reasonable grounds, as defined by the NES f. The allowances applicable to work on a Public Holiday, they will provide one week’s notice of such a requirement. Where an Employee does not wish to work on a Public Holiday, he or she must notify their Employer at least one (1) week before that Holidays are set out in clause 8.2 Public Holiday fallsPenalties. (d) Payment for all time worked on a Public Holiday shall be at time and a half for the hours worked, except that any time worked after 8 hours on a Public Holiday shall be paid at three times the relevant Employee’s Base Hourly Rate. In addition, the Employee will receive payment for the Public Holiday (8 hours at the Employee’s Ordinary Hours Base Hourly Rate) in the Employee’s ordinary pay cycle. (c) Employees may be such days. In addition, employees who are required to work on the above public holidays shall be entitled to an alternative holiday for working on these days if it would have otherwise been a Public Holidayworking day. 17.2. Where the Employer requires an Employee employee is not required to work on one of the holidays referred to in 17.1, it being a Public Holidayday that would otherwise have been a working day for the employee, the employee shall be paid their relevant hourly/daliy rate of pay for that day. In the case of part time employees who do not work a regular pattern or fixed shifts they will provide one week’s notice must have worked on that day fifty percent or more of such a requirementthe time in the last six weeks for the day to be considered an otherwise working day. 17.3. Where an Employee does any of the holidays specified in 17.1 of this clause occur during the currency of the full time employees’ annual holiday, these employees shall have these public holidays paid and not wish to work taken from their annual holiday entitlement. 17.4. Where Christmas Day (25 December) and New Year Day (01 January) fall on a Public HolidaySaturday or Sunday the following shall apply: (a) An employee who works on the Saturday or Sunday which would otherwise be a working day for the employee on which Christmas Day and/or New Year’s Day falls shall be paid double their relevant hourly rate (T2) for all hours worked, he or she must notify their Employer at least one (1) week before that Public Holiday fallsand will have entitlement to an alternative holiday for working on these days. (db) Payment for all time worked An employee who works on the officially recognised Christmas Day and/or New Year day i.e. the transferable day, which would otherwise be a Public Holiday shall be at time and a half working day for the hours workedemployee, except that any time worked after 8 hours on a Public Holiday shall be paid at three times double their relevant hourly rate (T2) for all hours worked and will have entitlement to an alternative holiday for working on these days. 17.5. The parties agree that alternative days shall be taken within six months following the relevant Employeepublic holiday. An alternative day is to be taken by the employee on a day that is agreed between the Employer and employee. 17.6. If both parties cannot agree on when an alternative holiday is to be taken, then the day may be taken: (a) on a date determined by the employee, taking into account the Employer’s Base Hourly Rate. In addition, the Employee will receive payment view as to when it is convenient for the Public Holiday (8 hours at employee to take the Employee’s Ordinary Hours Base Hourly Rate) in the Employee’s ordinary pay cycleday. (eb) An Employee other than a shift worker who works on a Public Holiday shall be paid for at least four (4) hours at within 12 months of the applicable rateemployee’s entitlement to the alternative holiday having arisen. (f) Where a Public Holiday occurs during a period of R&R leave, Employees shall receive payment for eight (8) Ordinary Hours at the relevant Employee’s Base Hourly Rate.

Public Holidays. (b) Employees, other than casual Employees, are entitled to observe these days as holidays without deduction of Ordinary Hours’ pay. Where the project employs a large number of Nonco-Local Employees, with the exception of Christmas Day, Boxing Day and New Year’s Dayworker works on a gazetted public holiday, the Projects managing contractor may elect to keep public holiday penalty rates will apply. Work on a public holiday will only be worked within the Site open for work on all Public Holidaysspread of ordinary hours that would have applied if the day was not gazetted as a public holiday. (g) Days where IKEA is prohibited from trading, and the day has not been declared a public holiday, will be rostered as a non-working day and additional hours will be rostered on other days during the fortnightly cycle for all permanent co-workers. A co-worker who regularly works on a period day IKEA is prohibited from trading may request to their direct manager to: (i) Take annual leave instead of R&R leave, Employees shall receive payment for eight having the day rostered as a non-working day; or (8) Ordinary Hours at ii) Work additional hours rostered on other days during the relevant Employee’s Base Hourly Ratefortnightly cycle.

Public Holidays. (b) Employees, other than casual Employees, are entitled to observe these days as holidays without deduction of Ordinary Hours’ pay. Where the project employs a large number of Non-Local Employees, Public Holidays will be paid in accordance with the exception of Christmas DayEmployment Standards Act, Boxing Day and New Year’s Day2000, the Projects managing contractor may elect as amended time to keep the Site open for work on all Public Holidaystime. (c) Employees may An employee who is required to work on any of the foregoing holidays shall be paid at the rate of one and one half (1 ½) times her regular straight time pay for all hours worked on such holiday, in addition to the Public Holiday Pay for that day in accordance with the Employment Standards Act, 2000, as amended from time to time. 17.02 Subject to staffing exigencies, a nurse who works Christmas/ Boxing Day shall not be required to work New Year’s Eve Day/New Year’s Day. The Employer will endeavour to rotate the requirement to work Christmas/Boxing Day with New Year’s Eve Day/New Year’s Day on a Public Holidayalternate years. Where Time off at Christmas shall be defined as being off December 24th ,25th ,26th and time off at New Years shall be defined as being off December 31 and January 1st. Request for time off at Christmas or New Years shall be submitted in writing to the Employer requires an Employee by November 15th. The master schedule may be adjusted to work on a Public Holidayallow for scheduling requests over the Christmas/New Year’s period, they will provide one week’s notice of such a requirement. Where an Employee does not wish between December15th to work on a Public Holiday, he or she must notify their Employer at least one (1) week before that Public Holiday fallsJanuary 15th. (d) Payment for all time 17.03 Time worked on a Public Holiday the holidays listed in 17.01 (a) between 0001 hours and 2400 hours shall be at time deemed to be work performed on the holiday and a half for the hours worked, except that any time worked after 8 hours on a Public Holiday all work shall be paid at three times the relevant Employee’s Base Hourly Rate. In addition, rate of time and one half the Employee will receive payment for the Public Holiday (8 hours at the Employee’s Ordinary Hours Base Hourly Rate) in the Employee’s ordinary pay cyclestraight time hourly rate of pay. (e) An Employee other than 17.04 Where a shift worker who works holiday falls during a full-time nurse’s scheduled vacation period, her vacation shall be extended by one day unless mutually agreed to schedule a different day off. Where a holiday falls on a Public Holiday shall full-time nurse’s scheduled day off, an additional day off may be paid for at least four (4) hours at the applicable ratescheduled. (f) Where a Public Holiday occurs during a period of R&R leave, Employees shall receive payment for eight (8) Ordinary Hours at the relevant Employee’s Base Hourly Rate.

Public Holidays. Where the project employs a large number of Non-Local Employees, with the exception of Employees who work on Christmas Day, Boxing Day and Day, New Year’s Day, the Projects managing contractor may elect to keep day following New Year’s Day, Waitangi Day, Good Friday, Easter Monday, Anzac Day, the Site open birthday of the reigning Sovereign, Labour Day, Anniversary Day (or a day in lieu thereof) shall be paid the penal rates specified in the Schedule of Wages and Allowances for work all hours worked on all Public Holidays. (c) Employees may be such days. In addition, employees who are required to work on a Public Holidaythe above public holidays shall be entitled to an alternative holiday for working on these days. 17.2. Where the Employer requires an Employee employee is not required to work on one of the holidays referred to in 17.1, it being a Public Holidayday that would otherwise have been a working day for the employee, they will provide one week’s notice the employee shall be paid their relevant hourly/daily rate of such a requirementpay for that day. 17.3. Where an Employee does any of the holidays specified in 17.1 of this clause occur during the currency of the full time employees’ annual holiday, these employees shall have these public holidays paid and not wish to work taken from their annual holiday entitlement. 17.4. Where Christmas Day (25 December) and New Year Day (01 January) fall on a Public HolidaySaturday or Sunday the following shall apply: (a) An employee who works on the Saturday or Sunday which would otherwise be a working day for the employee on which Christmas Day and/or New Year’s Day falls shall be paid double their relevant hourly rate (T2) for all hours worked, he or she must notify their Employer at least one (1) week before that Public Holiday fallsand will have entitlement to an alternative holiday for working on these days. (b) Employees, other than casual Employees, are entitled to observe these days as holidays without deduction of Ordinary Hours’ pay. Where the project employs a large number of Non-Local Employees, with the exception of Christmas Day, Boxing Day and shall be New Year’s Day, Good Friday, Easter Monday, Victoria Day, July Civic Holiday, Labour Day, Thanksgiving Day, Christmas Day, Boxing Day, Heritage Day if proclaimed. Each regular employee shall be entitled to three additional days holiday with pay during the Projects managing contractor may elect calendar year and such day(s) shall be mutually agreed to keep by the Site open for work Supervisor and employee. However, a request to take such a holiday on all Public Holidays. (c) Employees Remembrance Day will be granted. These days may be required taken in half days. For employees working other than an eight hour day, the number of hours scheduled for the day on which the absence occurs shall be considered one day for the purpose of this clause. One of the above additional days will be designated by the Employer by December of the previous year. This designated day will be immediately before or after a Public Holiday unless otherwise determined subsequent to consultation at the Labour/Management Committee. Should this day not be designated by the Employer the day may be taken subject to the convenience of the Department and applies only to employees who have completed three months of continuous service. The benefit of the second and third additional days must be taken within the calendar year it is granted, applies only to employees who have completed three months’ continuous employment service, and is taken at the request of the employee and subject to the convenience of the department. When Christmas, New Year’s Day or July 1 falls on a Saturday or Sunday, the following Monday shall be observed as the Public Holiday. When Christmas falls on a Saturday or Sunday, the following Tuesday shall be observed as the Boxing Day Public Holiday. When Christmas falls on a Friday, the following Monday shall be observed as the Boxing Day Public Holiday. When a Public Holiday occurs during a vacation period, that day shall be charged to “Public Holiday” and not to employee’s vacation time. A shift employee scheduled to work on any observed Public Holiday shall be allowed one day in lieu for the Public Holiday except when permitted to take the day off as a Public Holiday. Where When a shift employee’s scheduled day off falls on an observed Public holiday the Employer requires an Employee employee shall receive one day in lieu. A shift employee shall be allowed to accumulate lieu days for a period of twelve months from date earned. Afternoon shift employees in the Fleet and Equipment Operation Department scheduled to work on a Public Holiday, they will provide one week’s notice of such a requirement. Where an Employee does not wish to work on a Public Holiday, he or she must notify their Employer at least one (1) week before that Public Holiday falls. (d) Payment for all time worked on a Public Holiday shall be at time and a half for ten hour shift who observe the hours worked, except that any time worked after 8 hours on a Public Holiday shall be paid at three times the relevant Employee’s Base Hourly Rate. In addition, the Employee will receive payment for the Public Holiday (8 hours at the Employee’s Ordinary Hours Base Hourly Rate) in the Employee’s ordinary pay cycle. (e) An Employee other than a shift worker who works on a Public Holiday shall be paid for at least four (4) hours at the applicable rate. (f) Where ten hour day. Employee required by schedule to work on a Public Holiday occurs during but unable to do so because of illness shall be paid at straight time rate from her/his sick pay credit for the Public Holiday and shall be allowed the lieu day as in Article Employee is not allowed pay for Public Holiday when absent without pay on either the work day before or the work day after the Public Holiday except in cases of employee granted leave for Union business. For all employees working a period twelve hour, seven day rotating schedule, in lieu of R&R leaveobserved Public Holidays, Employees each employee shall receive payment for eight (8) Ordinary Hours be entitled to an equal number of days off each year plus three additional days per calendar year, at normal straight time pay. These days shall be taken in conjunction with scheduled vacation. For these employees on an hourly basis unused accumulated lieu time, in lieu of observed Public Holidays, can be cashed out, at straight time, at the relevant Employeeend of the calendar year. Payment will be at the employee’s Base Hourly Ratecurrent rate of pay.

Public Holidays. ‌ 3.3.1 The following days are declared public holidays: New Year’s Day Australia Day Good Friday Easter Saturday Easter Sunday Easter Monday Anzac Day Labour Day or May Day King’s Birthday Clermont Show Day Christmas Eve (6pm to midnight) Christmas Day Boxing Day Any other day or part day declared or prescribed by or under a law of the State of Queensland to be observed generally within Queensland, or a region of Queensland, as a public holiday 3.3.2 Any of these days may be moved to another day by agreement between the Employer and the majority of directly affected Employees. In those circumstances the agreed day becomes the Public Holiday and the former day becomes an ordinary working day. 3.3.3 The provisions of the FW Act will apply to Employees working on a public holiday. 3.3.4 If the Employee is working shift work, shifts may be rostered on public holidays. If an Employee works a shift on a public holiday in accordance with their roster, no additional payments apply as the remuneration provide under Clause 2.8 and/or the additional annual leave entitlement in Clause 3.1 comprehends such work. 3.3.5 If a new public holiday not listed in clause 3.3.1 is gazetted by the Queensland State Government in any year: (a) The Project recognises the following gazetted Public Holidays: (1) New Year’s Day (2) Australia Day (3) Good Friday (4) Easter Saturday (5) Easter Monday (6) ANZAC Day (7) May Day (8) Queen’s Birthday (9) Picnic Day (10) Darwin Show day (11) Christmas Day (12) Boxing Day (13) or Employees working shift work who are rostered to work a day declared shift on that new public holiday will receive an additional payment at their Normal Annual Salary for that shift in lieu of any such day or days above other than Christmas Day and Boxing Day (14) any additional day gazetted by the relevant Northern Territory Ministerto their normal pay for that shift. (b) EmployeesEmployees working shift work who are not rostered to work a shift on that new public holiday (and who do not subsequently work on the day) will receive an additional payment at their Base Salary for the Employee’s normal shift length. 3.3.6 Under clause 3.3.5, other than casual Employees, are entitled a shift which commences on the new public holiday but finishes on another day will be considered a shift rostered on that new public holiday. A shift that finishes on the new public holiday but commenced on another day will not be considered a shift rostered on that new public holiday. 3.3.7 If the Employee is working a Monday to observe these days as holidays without deduction of Ordinary Hours’ pay. Where the project employs a large number of Non-Local Employees, with the exception of Christmas Day, Boxing Day and New Year’s DayFriday day work roster, the Projects managing contractor may elect to keep the Site open for work on all Public Holidays. Employer will, if practicable, give one (c1) Employees may be required months’ notice of any request to work on a Public Holidaypublic holiday. Where If the Employee works on any public holiday they will receive payment at the rate of double time for work performed during ordinary hours and triple pay from there on. 3.3.8 Notwithstanding clause 3.3.4, an Employee’s roster cannot contain rostered shifts on Christmas Day and Boxing Day (from Night Shift commencing on the evening of 24 December until the commencement of Night Shift on 26 December). However the Employer requires can seek Employees to volunteer to work shifts during this period. 3.3.9 If an Employee to work works on a Public HolidayChristmas and/ or Boxing Day, they will receive payment at the rate of 300% of their Normal Annual Salary rate for all hours worked in addition to the Employee’s normal pay. 3.3.10 Employees who have undertaken and provide one week’s notice evidence of such a requirement. Where an Employee does not wish recognised active service in the Australian Defence Forces shall be permitted to work on a Public Holiday, he or she must notify their Employer at least access one (1) week before that Public Holiday falls. day of paid leave to attend the local (di.e. Middlemount/Tieri) Payment for all time worked on a Public Holiday shall be at time and a half for the hours worked, except that Anzac Day commemoration without any time worked after 8 hours on a Public Holiday shall be paid at three times the relevant Employee’s Base Hourly Ratededuction to their leave accruals. Where the project employs a large number of Non-Local Employeeshours scheduled for the day on which the absence occurs shall be considered one (1) day for the purpose of this clause. For those employees working a compressed work week the number of hours deducted when using an additional day shall be the number of hours scheduled to be worked. One of the above additional days will be designated by the Employer by December 1st of the previous year. This designated day will be immediately before or after a Public Holiday unless otherwise determined subsequent to consultation at the Labour/Management Committee. Should this day not be designated by the Employer the day may be taken subject to the convenience of the Department and applies only to employees who have completed three (3) months of continuous service. The benefit of the second and third additional days must be taken within the calendar year it is granted, with applies only to employees who have completed three (3) months' continuous employment service, and is taken at the exception request of the employee and subject to the convenience of the department. 19.02 When Christmas, New Year's Day or July 1st falls on a Saturday or Sunday, the following Monday shall be observed as the Public Holiday. When Christmas Dayfalls on a Saturday or Sunday, the following Tuesday shall be observed as the Boxing Day and New Year’s DayPublic Holiday. When Christmas falls on a Friday, the Projects managing contractor may elect following Monday shall be observed as the Boxing Day Public Holiday. 19.03 When a Public Holiday occurs during a vacation period, that day shall be charged to keep the Site open for work on all "Public HolidaysHoliday" and not to employee's vacation time. (ca) Employees may be required A shift employee scheduled to work on any observed Public Holiday shall be allowed one day in lieu for the Public Holiday except when permitted to take the day off as a Public Holiday. Where the Employer requires When a shift employee's scheduled day off falls on an Employee to work on a Public Holiday, they will provide one week’s notice of such a requirement. Where an Employee does not wish to work on a Public Holiday, he or she must notify their Employer at least one (1) week before that observed Public Holiday fallsthe employee shall receive one day in lieu. A shift employee shall be allowed to accumulate lieu days for a period of twelve (12) months from date earned. (db) Payment for all time worked on a Public Holiday shall be at time and a half for the hours worked, except that any time worked after 8 hours on a Public Holiday shall be paid at three times the relevant Employee’s Base Hourly Rate. In addition, the Employee will receive payment for the Public Holiday (8 hours at the Employee’s Ordinary Hours Base Hourly Rate) Afternoon shift employees in the Employee’s ordinary pay cycle. Public Holidays. 18.01 The following Public Holidays shall be considered as paid holidays for Employees, subject to the qualifications hereinafter set out: New Year's Day Thanksgiving Day Good Friday Christmas Eve Day Victoria Day Christmas Day Canada Day Boxing Day Labour Day August Civic Holiday 18.02 The Public Holiday shall be deemed to commence at 24:00 hours of the day preceding and to terminate at 08:00 hours of the day following the Public Holiday. 18.03 To qualify to receive holiday pay an employee must work their last scheduled shift before and their first scheduled shift after the holiday, if so called. 18.04 An exception to 18:03 above shall be made by the Foundation if an Employee is absent from work because of personal illness or accident verified by a medical certificate, death in the immediate family for which bereavement provisions in this Agreement apply, or if the Employee has been granted leave of absence where the Employee's date of return is scheduled for the day after the holiday. (a) The Project recognises Each Employee entitled to receive holiday pay shall receive the following gazetted Public Holidays: (1) New Year’s Day (2) Australia Day (3) Good Friday (4) Easter Saturday (5) Easter Monday (6) ANZAC Day (7) May Day (8) Queen’s Birthday (9) Picnic Day (10) Darwin Show day (11) Christmas Day (12) Boxing Day (13) or a day declared total amount of regular wages earned and vacation pay payable to the employee in lieu of any such day or days above other than Christmas Day and Boxing Day (14) any additional day gazetted the four weeks before the work week in which the public holiday occurred, divided by the relevant Northern Territory Minister20. (b) Employees, other than casual Employees, are entitled These monies will be equivalent to observe these days as holidays without deduction 8 hours for full time and 4 hours for part time employees in the calculation of Ordinary Hours’ pay. Where the project employs a large number of Non-Local Employees, with the exception of Christmas Day, Boxing Day and New Year’s Day, the Projects managing contractor may elect to keep the Site open for work on all Public Holidaystheir weekly guarantee. (c) Employees may These monies can not be used in the calculation of overtime for the work week for any purpose whatsoever. 18.06 An Employee required to work on any of the above-named holidays shall be paid as follows; two times the base rate for work between 8:00 and 24:00 and two and one half times the base rate for work between 00:01 and 7:59. If the Employee is entitled to holiday pay, the hours worked will be paid in addition to the Employee's holiday pay. 18.07 If an Employee has agreed to work on a Public Holiday. Where Holiday and who, without reasonable cause, fails to report for and perform the Employer requires an Employee to work work, shall not receive any holiday pay. 18.08 Notwithstanding the above, where a legal public holiday falls on a Public Holidaynormal day off as defined by the Foundation, they will provide one week’s notice of such a requirement. Where an Employee does not wish to work on a Public Holiday, he or she must notify their Employer at least one (1) week before that Public Holiday falls. (d) Payment for all time worked on a the day following the Public Holiday shall be at time and a half for the hours worked, except that any time worked after 8 hours on a Public Holiday shall be paid at three times the relevant Employee’s Base Hourly Rate. In addition, the Employee will receive payment for the Public Holiday (8 hours at the Employee’s Ordinary Hours Base Hourly Rate) in the Employee’s ordinary pay cycledesignated day off. (e) An Employee other than a shift worker who works on a Public Holiday shall be paid for at least four (4) hours at the applicable rate. (f) Where a Public Holiday occurs during a period of R&R leave, Employees shall receive payment for eight (8) Ordinary Hours at the relevant Employee’s Base Hourly Rate.

Public Holidays. (b) Employees, other than casual Employees, are entitled shall be deemed to observe these days as be public holidays without deduction of Ordinary Hours’ pay. Where the project employs a large number of Non-Local Employees, with the exception of Christmas Day, Boxing Day and : New Year’s Day, Australia Day, Good Friday, Easter Saturday, Easter Monday, Anzac Day, Queen’s Birthday, Labour Day, Christmas Day, and Boxing Day. 19.2 In addition to those public holidays specified in subclause 19.1, employees shall be entitled to an extra public holiday each year. Such public holiday shall occur between Christmas and New Year within the Projects managing contractor days Monday to Friday inclusive and shall not coincide with a date that is already a gazetted public holiday. The date of the extra public holiday shall be nominated by the employer before 1 July each year. This extra public holiday shall apply in substitution for any local public holidays proclaimed eg Race Day/Show Day and in substitution for any Bank holiday proclaimed in New South Wales. This subclause shall take effect from 1 January 2005. 19.3 Employees wishing to be absent from duties on Race or Show day may elect arrange for annual leave or leave without pay to keep the Site open for be taken subject to agreement being reached with his/her manager. 19.4 Public holidays shall be allowed to employees without loss of ordinary pay. 19.5 An employee who is required to and does work on any public holiday prescribed in this clause, shall be paid in lieu of all Public Holidays.other shift allowances, weekend penalty rates, casual loading and part-time loading, as follows: 19.5.1 Full-time employees: (ca) Employees may be required to work on a Public Holiday. Where the Employer requires an Employee to work on a Public Holiday, they will provide one week’s notice of such a requirement. Where an Employee does not wish to work on a Public Holiday, he or she must notify their Employer at least one (1) week before that Public Holiday falls. (d) Payment half time extra for all time worked plus one day’s pay in addition to the weekly rate; (b) alternatively, if the employee so elects – one half time extra for all time worked in addition to the weekly rate and have one ordinary working day added to the period of annual leave. 19.5.2 Permanent part-time employees who are contracted to work 30 or more hours per week on a Public Holiday shall be at regular basis and who are regularly rostered on a particular day and a public holiday happens to fall on such day: (a) time and a one-half extra for the hours all time worked, except that any in addition to the weekly rate; (b) alternatively, if the employee so elects – one half extra for all time worked after 8 and the equivalent number of hours worked added to annual leave; 19.5.3 Permanent part-time employees who are contracted to work less than 30 hours per week on a Public Holiday shall be paid at three times the relevant Employee’s Base Hourly Rate. In addition, the Employee will receive payment for the Public Holiday (8 hours at the Employee’s Ordinary Hours Base Hourly Rate) in the Employee’s ordinary pay cycle.regular basis and who are regularly rostered on a particular day and a public holiday happens to fall on such day: (ea) An Employee other than a shift worker who works on a Public Holiday shall be paid time and one-half extra for at least four (4) hours at all time worked, in addition to the applicable weekly rate.; (fb) Where a Public Holiday occurs during a period alternatively, if the employee so elects – one half extra for all time worked and the equivalent number of R&R hours worked added to annual leave, Employees shall receive payment for eight (8) Ordinary Hours at the relevant Employee’s Base Hourly Rate.;

Public Holidays. (a) The Project recognises If an additional statutory holiday should be proclaimed during the following gazetted Public Holidays: term of this Agreement, such additional holiday shall be added to the list in Article below. New Year's Day Labour Day Good Friday Thanksgiving Day Victoria Day Christmas Day Canada Day Boxing Day An elect to work employee who is required by the Employer to work on any of the holidays set out above shall receive time and one-half (1%) New Yearher applicable visit rate or hourly rate for all visits (or hours worked, as the case may be) on the holiday. Elect to work employees are not eligible for holiday pay. Guaranteed Hours Employees Guaranteed hourly employees are eligible for holiday pay provided that an employee must have worked all of her last regularly scheduled day of work before the public holiday and her first regularly scheduled day of work after the holiday unless reasonable cause for not doing so, is shown. The pay for a holiday be paid on the average of the employee’s Day daily hours, exclusive of overtime hours, worked in the thirteen (213) Australia Day (3weeks preceding the holiday, calculated by dividing the number of daily hours worked, exclusive of overtime, by the number of days worked in the thirteen ( I3) Good Friday weeks preceding the holiday. Where an employee qualifies for holiday pay in accordance with the provisions of this agreement, the employee shall receive credit for seniority on the basis of an average of the service hours worked during the four (4) Easter Saturday (5) Easter Monday (6) ANZAC Day (7) May Day (8) Queen’s Birthday (9) Picnic Day (10) Darwin Show day (11) Christmas Day (12) Boxing Day (13) or a day declared in lieu of any such day or days above other than Christmas Day and Boxing Day (14) any additional day gazetted by work weeks preceding the relevant Northern Territory Minister. (b) Employees, other than casual Employees, are entitled to observe these days as holidays without deduction of Ordinary Hours’ payholiday. Where the project employs a large number of Non-Local Employees, with the exception of Christmas Day, Boxing Day and New Year’s Day, the Projects managing contractor may elect to keep the Site open for work on all Public Holidays. (c) Employees may be If an employee is required to work on a Public Holiday. Where the Employer requires an Employee to work on a Public Holidayany paid holiday, they will provide one week’s notice of such a requirement. Where an Employee does not wish to work on a Public Holiday, he or she must notify their Employer at least one (1) week before that Public Holiday falls. (d) Payment for all time worked on a Public Holiday shall be at time and a half for the hours worked, except that any time worked after 8 hours on a Public Holiday shall be paid at three times the relevant Employee’s Base Hourly Rate. In addition, the Employee will receive payment for the Public Holiday (8 hours at the Employee’s Ordinary Hours Base Hourly Rate) in the Employee’s ordinary pay cycle. (e) An Employee other than a shift worker who works on a Public Holiday shall be paid for at least four the holiday in accordance with (4provided she otherwise qualifies), and in addition will receive one and one half (1 times her regular hourly rate of pay for all hours worked on the holiday. Alternatively, the employee may choose to receive one and one-half (1%) times her regular hourly rate of pay for all hours worked on the holiday and choose a lieu day paid in accordance with and scheduled in accordance with O. When a paid holiday falls during an employee’s vacation, she shall, at the applicable rateoption of the employee, either be paid for the holiday in addition to her scheduled vacation, or may take an extra day off at a time mutually agreeable to the employee and the Employer, paid in accordance with Should an employee qualify for holiday pay and not scheduled to work on the holiday, such employee shall be paid for the holiday or shall be entitled to take an alternative day off with pay, in accordance with at a time mutually agreeable to between the employee and the Employer. At a time mutually agreeable to the employee and the Employer, a day that is substituted for a public holiday shall be taken no more than three (3) months after the paid holiday or if the employer and employee agree, no more than twelve (12) months after the public holiday. (f) Where a Public Holiday occurs during a period of R&R leave, Employees shall receive payment for eight (8) Ordinary Hours at the relevant Employee’s Base Hourly Rate.

Public Holidays. (a) 30.1 Where a public holiday falls on a day that an employee would have ordinarily been rostered to work, that employee shall be allowed such Public Holiday without loss of their Base Rate of Pay for the time they would have worked, had it not been a Public Holiday. 30.2 The Project recognises the following gazetted Public Holidays: (1) days shall be public holidays, New Year’s 's Day (2) , Australia Day (3) , Good Friday (4) , Easter Saturday (5) , Easter Sunday, Easter Monday (6) ANZAC , Anzac Day (7) May , Queen's Birthday, Labour Day (8) Queen’s Birthday (9) Picnic Day (10) Darwin Show day (11) Christmas Day (12) Boxing Day (13) or a day declared in lieu of any such day or days above other than Christmas Day and Boxing Day (14) any additional day gazetted by the relevant Northern Territory Minister. (b) Employees, other than casual Employees, are entitled to observe these days as holidays without deduction of Ordinary Hours’ pay. Where the project employs a large number of Non-Local Employees, with the exception of Christmas Day, Boxing Day and any other day or part thereof proclaimed and observed as a public holiday within the area in which the residence is situated. 30.3 In each calendar year, in addition to those Public Holidays referred to above at subclause 30.2, where no “Additional Public Holiday” is proclaimed and observed, the employer shall grant an extra Public Holiday or “Picnic Day”, to be observed on a day between Christmas Day and New Year’s Day. Please note, “Additional Public Holiday” as granted by the State or Federal Government, is not to be confused with “Substitute Public Holiday”. 30.4 This Agreement expressly contemplates that the employer will require work on public holidays and the parties acknowledge that the nature of the work performed by the employee, the type of employment of the employee (for example, whether full-time, part- time, casual or shift work) and the nature of the employer’s business, will require work on public holidays, from time to time. 30.5 The employer may request an employee to work on a public holiday. 30.6 An employee who is required to and does work on New Year’s Day, the Projects managing contractor may elect to keep the Site open for work on all Public Holidays. (c) Employees may be required to work on a Public Holiday. Where the Employer requires an Employee to work on a Public HolidayAustralia Day, they will provide one weekGood Friday, Easter Saturday, Easter Sunday, Easter Monday, Anzac Day, Queen’s notice of such a requirement. Where an Employee does not wish to work on a Public HolidayBirthday, he Labour Day, Christmas, Boxing Day or she must notify their Employer at least one (1) week before that Public Holiday falls. (d) Payment for all time worked on a Public Holiday shall be at time and a half for the hours worked, except that any time worked after 8 hours on a Additional Public Holiday shall be paid in lieu of all other shift allowances, weekend penalties, casual loading and part-time loading, double time and a half of their Base Rate of Pay. Alternatively, the employee may elect payment at three one and a half times the relevant Employee’s Base Hourly Rate. In additionRate of Pay plus time off in lieu, equivalent to the Employee will receive payment for duration of the Public Holiday (8 hours at the Employee’s Ordinary Hours Base Hourly Rate) in the Employee’s ordinary pay cycleshift completed. (e) An Employee other than a shift worker who works on a Public Holiday shall be paid for at least four (4) hours at the applicable rate. (f) Where a Public Holiday occurs during a period of R&R leave, Employees shall receive payment for eight (8) Ordinary Hours at the relevant Employee’s Base Hourly Rate.

Public Holidays. (a) The Project recognises parties to this Agreement acknowledge that the following gazetted Public Holidays: (1) New Yearnature of the industry and commitment to the organisation’s Day (2) Australia Day (3) Good Friday (4) Easter Saturday (5) Easter Monday (6) ANZAC Day (7) May Day (8) Queen’s Birthday (9) Picnic Day (10) Darwin Show day (11) Christmas Day (12) Boxing Day (13) or a day declared clients, make it necessary to provide service over 7 days each week and the employee in lieu recognition of any such day or days above other than Christmas Day and Boxing Day (14) any additional day gazetted by the relevant Northern Territory Minister. (b) Employees, other than casual Employees, are entitled to observe these days as holidays without deduction of Ordinary Hours’ pay. Where the project employs a large number of Non-Local Employees, with the exception of Christmas Day, Boxing Day and New Year’s Day, the Projects managing contractor may elect to keep the Site open for work on all Public Holidays. (c) Employees may be required this agrees to work on Public Holidays if required by the employer to do so in accordance with a Public Holidayroster or otherwise. Where The employer undertakes to provide the Employer requires an Employee to work on a Public Holiday, they will provide one week’s employee with as much notice as practicable of such a requirement. Where an Employee . a) This clause does not wish apply to work on casual employees. When a Public Holiday, he or she must notify their Employer at least one (1) week before that Public Holiday falls. (d) Payment for all time worked on a Public Holiday shall be at time and a half for the hours worked, except that any time worked after 8 hours on a Public Holiday shall be paid at three times the relevant Employee’s Base Hourly Rate. In addition, the Employee will receive payment for the Public Holiday (8 hours at the Employee’s Ordinary Hours Base Hourly Rate) in the Employee’s ordinary pay cycle. (e) An Employee other than a shift worker who casual employee works on a Public Holiday (excluding Waitangi Day and Anzac Day) she/he shall be paid double time plus one tenth. When a casual employee works on Waitangi and or Anzac Days she/he shall be paid time and one half plus one tenth. Alternative days do not apply to casual employees. b) Public holidays shall be as specified in the ▇▇▇▇▇▇▇▇ ▇▇▇ ▇▇▇▇ i.e: New Year's Day — 1st day of January Day after New Year's Day —2nd day of January Waitangi Day —6th February Good Friday Easter Monday ANZAC Day — 25th April Queen's Birthday — First Monday in June South Canterbury Anniversary Labour Day Christmas Day — 25 December Boxing Day — 26 December c) Where a public holiday is observed on a day when an employee is normally employed, and the employee works, they shall be paid: 25th day of December - double time plus a paid alternative day Other days - Time and one half plus a paid alternative day d) The alternative day will be paid at the amount the employee would ordinarily have earned on the day taken. Alternative days are to be taken within twelve months of accrual at a time mutually agreed between the employer and employee. Where the employee has not taken the alternative day after 12 months, the employer and employee may agree to replace the holiday with a payment. e) Should any of the holidays specified in sub-clause (b) of this clause occur on an employee’s normal work day during the currency of the employee’s annual holiday, then such annual holiday may be extended by one day for every such holiday and the employee shall be paid for at least four (4) hours at the applicable rateevery such day. (f) Where an employee is rostered to work on a Public Holiday occurs during public holiday and willfully defaults, the employee shall not be entitled to any payment. g) If a period public holiday falls on the rostered day off of R&R leavea full-time employee or an employee who works 5 normal days per week, Employees they shall receive payment be paid an ordinary day’s pay. h) The public holiday for eight (8) Ordinary Hours at ANZAC Day and Waitangi Day will be “Mondayised” if they fall on a Saturday or Sunday. i) An employee who is normally employed to work Monday to Friday and where the 25th of December, 26th of December, 1st day of January, 2nd day of January falls on a Saturday or Sunday, these days will be transferred to the next working day. j) Where a part-time employee’s days are not fixed ie: rotating rostered duties, the employee shall be entitled to public holiday provisions if they have worked on the day of the week that the public holiday falls on more than 40% of the time over the last three months. Payment is relevant Employee’s Base Hourly Ratedaily pay.

Public Holidays. (a) The Project recognises Permanent team members shall be entitled to, without loss of pay, the following gazetted Public Holidays: (1) Holidays as observed in Victoria as follows: * New Year’s Day (2) Years Day * Anzac Day * Australia Day (3) Day * Queens Birthday * Good Friday (4) Friday * Labour Day * Easter Saturday (5) Saturday * Christmas Day * Easter Monday (6) ANZAC Day (7) May Day (8) Queen’s Birthday (9) Picnic Day (10) Darwin Show day (11) Christmas Day (12) Monday * Boxing Day (13b) The following days shall be taken in addition to the days named above: Melbourne Cup Provided that where a local day is proclaimed or gazetted in a day declared Day: locality outside the Metropolitan area and Melbourne Cup Day is not proclaimed or gazetted in the locality, then the local Day shall be taken as a Public Holiday in lieu of any such day or days above other than Christmas Day and Boxing Melbourne Cup Day (14) any additional day gazetted by the relevant Northern Territory Minister. (b) Employees, other than casual Employees, are entitled to observe these days as holidays without deduction of Ordinary Hours’ pay. Where the project employs a large number of Non-Local Employees, with the exception of Christmas Day, Boxing Day and New Year’s Day, the Projects managing contractor may elect to keep the Site open for work on all Public Holidays. (c) Employees Where in Victoria a Public Holiday is declared or prescribed on any other days, these days shall constitute additional Public Holidays for the relevant team members. Provided that by Agreement between Bunnings and the SDA, a Public Holiday may be required celebrated on an agreed date in Victoria. (d) Work done on any of the Public Holidays shall be voluntary and be paid at the rate of 250% for permanent team members and 272.5% for casual team members with a minimum payment for three hours. (e) Where a Public Holiday falls on a day on which a permanent team member would otherwise be Rostered to work and the team member does not work, the team member shall be entitled to the day off without loss of pay. (f) If a team member fails to attend for a rostered shift on either side of a Public Holiday they shall forfeit wages for the day of the absence as well as the Public Holiday. Where Bunnings is satisfied that the Employer requires an Employee team member's absence was caused through illness or other reason, wages shall not be forfeited for the holiday. Provided that a team member absent either before or after a group of holidays, shall forfeit wages for only one Public Holiday as well as the period of absence. (g) Where a store does not open for trade on a Public Holiday and a team member would have been rostered to work on such a day, they shall be entitled to payment for the day based upon their ordinary time earnings for the hours normally Rostered to work. (h) Where a store opens for trade on a Public Holiday, they will provide one week’s notice of such a requirement. Where an Employee does not wish team members who would normally be Rostered to work on a Public Holiday, he may elect to work their regular Roster for the day or she must notify their Employer at least one (1) week before that part thereof and be paid the Public Holiday falls. (d) Payment penalty for all time worked on so worked. Subject to 6.3(e), where a Public Holiday shall be at time and a half for the hours worked, except that any time worked after 8 hours on a Public Holiday team member chooses not to work they shall be paid at three times the relevant Employee’s Base Hourly Rate. In addition, the Employee will receive payment for the Public Holiday (8 hours at the Employee’s Ordinary Hours Base Hourly Rate) in the Employee’s their ordinary pay cyclerate of pay. (e) An Employee other than a shift worker who works on a Public Holiday shall be paid for at least four (4) hours at the applicable rate. (f) Where a Public Holiday occurs during a period of R&R leave, Employees shall receive payment for eight (8) Ordinary Hours at the relevant Employee’s Base Hourly Rate.

Public Holidays. (a) The Project recognises the following gazetted Public Holidays: (1) New Year’s 's Day (2) , Australia Day (3) , Good Friday (4) , Easter Saturday (5) , Easter Monday (6) , ANZAC Day (7) May , Queen's Birthday, Labour Day (8) Queen’s Birthday (9) Picnic Day (10) Darwin Show day (11) Christmas Day (12) Boxing Day (13) or a day declared in lieu of any such day or days above other than Christmas Day and Boxing Day (14) any additional day gazetted by the relevant Northern Territory Minister. (b) Employees, other than casual Employees, are entitled to observe these days as holidays without deduction of Ordinary Hours’ pay. Where the project employs a large number of Non-Local Employees, with the exception of Christmas Day, Boxing Day and New Year’s Day, any days proclaimed and generally observed as public holidays throughout the Projects managing contractor State of New South Wales and MSDA Picnic Day will be public holidays for the purpose of this agreement. All holidays falling on a usual working day will be counted as time worked and paid for as such. "Holiday" for employees on night shift means the day on which the majority of ordinary hours of the shift are worked. An employee who without reasonable cause is absent without leave on the working day immediately preceding or the working day immediately following a holiday will not be entitled to payment for such holiday. Subject to this clause, the employee will be credited with a total of 83.6 hours payment at ordinary time for holidays in each calendar year, or on a pro-rata basis for part of a calendar year, equivalent to 7.6 hours payment at ordinary time in respect of 11 holidays ("total annual entitlement"). The treatment of holidays will be as follows: If a holiday falls when an employee is rostered on duty and the employee not be required to work, then the employee will have that day off without loss of ordinary pay, and 12 hours will be deducted from their total annual entitlement in respect of the day off. If a holiday falls when an employee is rostered off duty, then the employee will have no deduction from their total annual entitlement in respect thereof, and where the employee has sufficient total annual entitlement, the employee may elect to keep take time off of one 12 hour day at a time mutually agreed with MSDA within 6 months of the Site open for work on all Public Holidays. (c) Employees may holiday occurring, in which case 12 hours will then be required deducted from the total annual entitlement. MSDA will make reasonable efforts to work on a Public Holiday. Where manage the Employer requires an Employee to work on a Public Holiday, they will provide one weekarrangements in this clause such that the number of hours deducted from the employee’s notice of total annual entitlement under such a requirement. Where an Employee arrangements does not wish to work on a Public Holiday, he or she must notify exceed their Employer at least one (1) week before that Public Holiday falls. (d) Payment for all time worked on a Public Holiday shall be at time and a half for the hours worked, except that any time worked after 8 hours on a Public Holiday shall be paid at three times the relevant Employee’s Base Hourly Ratetotal annual entitlement. In additionthe event such deductions do exceed the total annual entitlement, the Employee employee will receive not owe MSDA hours or payment for the Public Holiday (8 hours at the Employee’s Ordinary Hours Base Hourly Rate) in the Employee’s ordinary pay cyclelieu. (e) An Employee other than a shift worker who works on a Public Holiday shall be paid for at least four (4) hours at the applicable rate. (f) Where a Public Holiday occurs during a period of R&R leave, Employees shall receive payment for eight (8) Ordinary Hours at the relevant Employee’s Base Hourly Rate.

Public Holidays. Entitlement The public holidays for the purpose of this Project shall be: • Christmas Day • Boxing Day • New Years Day • Australia Day • Good Friday • Easter Saturday • Easter Monday • Anzac Day • Labour Day • Queens birthday • Dalby & District Annual Show Day All full-time Employees shall be entitled to payment for these Public Holidays without loss of ordinary pay except where: 1) An Employee is absent without the consent of the Employer or absent without reasonable cause (atermination of employment not being reasonable cause);or 2) Public Holidays that fall on RDOs Where a public holiday falls on an employee’s rostered day off and the Employee does not work the public holiday, the Employee shall be entitled to payment for the public holiday at the Employees ordinary time rate for 7.2 hours ordinary hours. For example, if the Employee has an RDO on Easter Friday and they do not work the day they shall be entitled to 7.2 ordinary hours pay at their ordinary rate. This clause does not apply to Easter Saturday. An Employee who does not work Easter Saturday is not entitled to payment. The Project recognises employee shall be entitled to an RDO the immediate working day following a public holiday if the public holiday falls on an RDO day. Any employee required to work on a public holiday nominated herein shall be paid at the rate of double time and a half for all time so worked. Employees may be required to work on public holidays. It will be available for the Employer and a majority of the affected Employees to substitute the nominated public holiday for another day and the prescriptions of this clause will apply to the substituted day. Provided a weekly Employee who has been employed continuously for two weeks and who is terminated by the Employer or stood down during December, and is re-employed by the Employer at any time before the end of January in the following gazetted Public Holidays: (1) New Year’s Day (2) Australia Day (3) Good Friday (4) Easter Saturday (5) Easter Monday (6) ANZAC Day (7) May Day (8) Queen’s Birthday (9) Picnic Day (10) Darwin Show day (11) Christmas Day (12) Boxing Day (13) or a day declared in lieu of any such day or days above other than Christmas Day and Boxing Day (14) any additional day gazetted by year shall be paid for the relevant Northern Territory Minister. (b) Employees, other than casual Employees, are entitled to observe these days as public holidays without deduction of Ordinary Hours’ pay. Where the project employs a large number of Non-Local Employees, with the exception of Christmas Day, Boxing Day and New Year’s Day, Years Day when those days occur during the Projects managing contractor may elect to keep the Site open for work on all Public Holidays. (c) Employees may be required to work on a Public Holiday. Where the Employer requires an Employee to work on a Public Holiday, they will provide one week’s notice of such a requirement.
