Prohibition on Unauthorized Use or Disclosure. Business Associate will neither use nor disclose Company Protected Health Information, except as permitted or required by this Agreement or as permitted or directed by Company or as Required by Law. This Agreement does not authorize Business Associate to use or disclose Company Protected Health Information in a manner that would violate the Privacy Rule or the HITECH Act if done by Company, except as set forth in Section 1(a)(ii).
Prohibition on Unauthorized Use or Disclosure. Business Associate will neither use nor disclose PHI it creates or receives for or from Recipient, its Subsidiaries, or from another business associate of Recipient or its Subsidiaries, except as permitted or required by this Addendum or the Agreement that are not inconsistent with the provisions of this Addendum, or as required by law, or following receipt of prior written approval from whichever of the Recipient or its Subsidiary for which the relevant PHI was created or from which the relevant PHI was received.

Business Associate will neither use nor disclose PHI or electronic PHI except as permitted or required by this Agreement, as otherwise permitted in writing by Company, or as required by law. This Agreement does not authorize Business Associate to use or disclose PHI or electronic PHI in a manner that would violate the requirements of the Health Insurance Portability and Accountability Act of 1996 and its implementing regulations (45 C.F.R. Parts 160-64) or the HITECH Act and its implementing regulations, if done by Company, except as set forth in Section A(1)(b).

BUSINESS ASSOCIATE will neither use nor disclose COMPANY’s Protected Health Information, except as permitted or required by this Addendum or in writing by COMPANY or as Required by Law. This Addendum does not authorize BUSINESS ASSOCIATE to use or disclose COMPANY’s Protected Health Information in a manner that will violate the 45 C.F.R. Part 164, Subpart E “Privacy of Individually Identifiable Health Information” (“Privacy Rule”) if done by COMPANY, except as set forth in Section 1.1b of this Addendum.

Business Associate will neither use nor disclose any of Covered Entity’s Protected Health Information, except as permitted or required by this Agreement or in writing by Covered Entity. This Agreement does not authorize Business Associate to use or disclose any of Covered Entity’s Protected Health Information in a manner that would violate the Privacy Rule or the Texas Privacy Law if done by Covered Entity. Covered Entity shall not request Business Associate to use or disclose any of Covered Entity’s Protected Health Information in any manner that would not be permissible under the Privacy Rule or the Texas Privacy Law if done by Covered Entity.
Prohibition on Unauthorized Use or Disclosure. Broker shall neither use nor disclose Health Information or Personal and Health Information it collects, creates for or receives from the Company, except as permitted or required by this Agreement, or as permitted or required by law.

This BAA does not authorize Business Associate to use or disclose Participant’s Protected Health Information in a manner that will violate the 45 C.F.R. Part 164, Subpart E “Privacy of Individually Identifiable Health Information” (“Privacy Rule”) if done by Participant, except as set forth in Section 1(a)(ii) of this BAA.
Prohibition on Unauthorized Use or Disclosure i) TECHNOLOGY TOOL(S) will neither use nor disclose PHI except as permitted or required by this BA Contract or in writing by Covered Entity, or as Required By Law.
Prohibition on Unauthorized Use or Disclosure a. Data Recipient shall not use or disclose the “Limited Data Set” for any purpose other than as permitted by Section 2 of this Agreement unless otherwise permitted in writing by the Data Provider or as otherwise required by law.
