Common use of Program Definition Clause in Contracts

Program Definition. 17 During the term of this agreement, the County shall continue to participate in 18 the Public Employee’s Retirement System (PERS) and shall pick-up, assume 19 and pay the employer’s and the nurse’s contribution to PERS for members of 20 the bargaining unit participating in PERS. 22 The full amount of nurse contributions picked-up or paid by Xxxxxx County 23 on behalf of members of the bargaining unit shall be considered salary within 24 the meaning of ORS 238.005 (11) for the purposes of computing a nurse 25 final average salary pursuant to ORS 238.005 (15) but shall not be 26 considered salary for the purposes of determining the amount of nurse 27 contributions required to be contributed pursuant to ORS 238.200. Such 28 picked-up and paid nurse contributions shall be credited to the nurse 29 accounts pursuant to ORS 238.200 (2) and shall be considered to be nurse 30 contributions for the purposes of ORS Chapter 238. 32 In the event the laws controlling the above pick-up agreement are scheduled 33 to change in the future, the parties agree to bargain before implementation, 1 upon request, for the protection of the rights and obligations set forth in this 2 section.
