Common use of Professional Concerns Clause in Contracts

Professional Concerns. A member or group of members who have a professional concern have the right to seek resolution by first bringing it to the attention of the building principal on an informal basis. If resolution is not reached at the building level then the member(s) has the right to place this professional concern in writing to the appropriate central office administrator. The Administrator shall respond to the member(s) in writing of his/her decision within ten (10) days. If resolution is not reached at this level, the member(s) has the right to place this professional concern in writing to the Superintendent within ten (10) days of receipt of the administrator's response. The Superintendent shall respond in writing to the member(s) professional concern within ten (10) days. If resolution is not reached at this level, the member(s) has the right to place this professional concern in writing to the Board of Education not less than ten (10) days before the next regularly scheduled board meeting. To the extent that the Board may lawfully do so, it will hear the concern in executive session and respond to the member(s) within twenty (20) days. If no written response is received by the member(s) in the specified ten (10) day period or in the event of an unsatisfactory response, the member(s) has the right to proceed to the next level. If the concern is not advanced within the time levels provided it will be deemed withdrawn. The Association President or his/her designee will be notified of any professional concern not resolved at the building principals' level when the member(s) proceed past this level. There shall be no appeal after the Board level and concerns presented under this provision are not subject to the grievance procedure.
