PREVALENCE OF AGREEMENT. Unless otherwise specified, in the event of any conflict between any provisions in this Terms and Conditions, the Contract Form and the Privacy Policy, the Contract Form shall take precedence, followed by the Privacy Policy, and finally this Terms and Conditions.
PREVALENCE OF AGREEMENT. In the event of any inconsistency or conflict between the provisions of this Agreement and the provisions of the Articles, the provisions of this Agreement shall as between the Shareholders prevail.
PREVALENCE OF AGREEMENT. In the event of any inconsistency or conflict between the provisions of this Agreement and the provisions of the Articles, the provisions of this Agreement shall as between the Shareholder Parties prevail and the Shareholder Parties shall, so far as they are able, cause such necessary alterations to be made to the Articles as are required to remove such conflict or otherwise give effect to the provisions of this Agreement.
PREVALENCE OF AGREEMENT. This Agreement shall prevail over the Memorandum and Articles of Association for the time being of the Company to the extent of any inconsistencies that may arise between this Agreement and the Memorandum and Articles of Association. In the event of any inconsistency arising, the Parties shall forthwith cause such necessary alterations to be made to the Articles of Association as required to resolve such inconsistency.
PREVALENCE OF AGREEMENT. In the event of any inconsistency or conflict between the provisions of this Agreement and the provisions of the Constitution, the provisions of this Agreement shall as between the Shareholders prevail and the Company shall, and the Shareholders shall procure that the Company shall, make such necessary alterations to the Constitution to the extent necessary to permit the Company and its affairs to be regulated as provided in this Agreement and as are required to remove such conflict.
PREVALENCE OF AGREEMENT. In the event of any ambiguity or conflict arising between the terms of this Agreement and those of the Amended Articles, as may be amended from time to time, the terms of this Agreement shall prevail, except as otherwise provided by applicable law, provided however, that the Shareholders shall cause the Amended Articles (and any amendments thereof) to be consistent with this Agreement.
PREVALENCE OF AGREEMENT. In the event of any ambiguity or conflict ----------------------- arising between the terms of this Joint Venture Agreement and those of the Memorandum of Association of the Company, the terms of this Joint Venture Agreement shall prevail as between the Parties except as otherwise provided by applicable law.
