Common use of Preemptive Clause Clause in Contracts

Preemptive Clause. Nothing contained in this Negotiation Agreement is intended to or shall conflict with, or abrogate the powers or duties and responsibilities vested in the legislature, State Board of Education, or the Moscow School District Board of Trustees by the laws of the State of Idaho and all federal laws. The Moscow School District Board of Trustees is entitled, without negotiation or reference to any Negotiated Agreement, to notify the Moscow Education Association President and to take immediate action that may be necessary to carry out its responsibility due to situations of emergency or force majeure (sometimes called acts of God). Nothing contained within this passage shall diminish the right of the Board of Trustees of the District to promulgate rules and regulations for the governance of the District as provided by the Idaho Code and federal law.
