Performance of the Work by Xxxxxxxx Sample Clauses

Performance of the Work by Xxxxxxxx. Upon approval of the Final Plans by Landlord and filing thereof with the appropriate governmental agencies, Landlord shall cause the Work to be bid to Xxxxx Construction. Landlord and Xxxxxx shall mutually negotiate the contract for the general contractor to perform the Work, and Landlord shall thereupon execute the contract with the general contractor. Upon execution of the general contractor contract, Landlord, at Xxxxxx's sole cost and expense (but subject to application of the Tenant Improvement Allowance provided in Section 30 of the Lease) shall cause such contractor to promptly commence to construct and install and pursue to completion in the Premises the Work. To the extent the costs of the Work exceed the Tenant Improvement Allowance, Tenant shall pay to Landlord the costs of the Work pursuant to the provisions of Paragraph 3 hereof.
