Common use of Performance Based Bonus Clause in Contracts

Performance Based Bonus. As additional compensation, the Executive shall be entitled to receive a bonus (“Bonus”) for each year during the Term of the Executive’s employment by the Company, and based upon the Company’s executive bonus plan as adopted and amended from time-to-time by the Company’s Board of Directors. The amount any Bonus shall be determined based upon performance targets set annually by the Company’s Compensation Committee.”

Performance Based Bonus. As additional compensation, the Executive shall be entitled to receive a bonus (“Bonus”) for each year during the Term of the Executive’s employment by the Company, and based upon Company equal to up to 30% of the CompanyExecutive’s executive bonus plan as adopted and amended from time-to-time by the CompanyBase Salary at said year’s Board of Directorsend. The amount any Bonus shall be determined based upon performance targets set annually by the Company’s Compensation Committeecompensation committee of the Board of Directors. Any Bonus awarded for the year ended December 31, 2005 shall be prorated based on effective date of contract.”
