Passive Recreational Use Sample Clauses

Passive Recreational Use. Whether or not the Developer shall elect to purchase the Developer Premises, the Seller's Deed to the City shall convey the City Premises to the City subject to the conditions and restrictions that the City Premises be used solely for passive recreational uses (as described below) during any period the Developer Premises shall be used for office or other commercial use. The City agrees that the Seller, and its successors and assigns, as the owners, from time to time, of the Developer Premises, may specifically enforce the foregoing restrictions. The passive recreational use of the City Premises shall include, but not be limited to, the use by the public for picnicking, site seeing, bird watching and other similar recreational activities. Notwithstanding the generality of the foregoing, the City Premises shall not be utilized as a concert venue or for ballfields nor shall there be erected upon the City Premises any playground equipment. The City agrees that there shall be no further development of or improvements made to the City Premises, nor changes made to the landscaping plans submitted as part of the Approved Plans without the consent of the Seller, or its successors and assigns, as the owner's of the Developer Premises; provided, however, City may develop a marina on the Shoreland City Premises (subject to the provisions set forth below): In the event the City develops a marina on the Shoreland City Premises, the City agrees that (i) no improvements or structures shall be built or erected on the Shoreland City Premises other than pier(s) and slips and the walkways and/or boardwalks servicing the same; and (ii) the City shall, at its sole cost and expense, develop maintain, insure and operate (or cause to be operated) the marina.

  • Personal Use You may use the Account only for personal, family or household purposes. Federal or state consumer protection laws may not apply if you use the Account for other than personal, family or household purposes.

  • Residential Use Use the Apartment for residential purpose only. Under no circumstances shall the Allottee use or allow the Apartment to be used for commercial, industrial or other non-residential purposes. The Allottee shall also not use or allow the Apartment to be used as a religious establishment, hotel, guesthouse, service apartment, mess, hostel, boarding house, restaurant, nursing home, club, school or other public gathering place.

  • Commercial Use the use of the Licensed Material for the purpose of monetary reward (whether by or for the Institution or an Authorised User) by means of sale, resale, loan, transfer, hire or other form of exploitation of the Licensed Material. For the avoidance of doubt, the use by the Institution or Authorised Users of the Licensed Material in the course of research funded by a commercial organisation is not deemed to constitute Commercial Use. Recovery of costs is not being deemed Commercial Use. The use of Metadata by search engines does not constitute Commercial Use as long as that Metadata is not sold, lent, distributed or otherwise re-licensed via that search engine or the access to that Metadata on that search engine is exclusively being charged for.

  • Residential Use; Pets The bedroom space and apartment may be used solely for private residential purposes and for no other purposes. Resident may not carry on any business or other enterprise from the bedroom space or apartment, nor use any Owner- provided Internet connections for business purposes. Resident may place no signs, placards or other advertisement of any character in the bedroom space or apartment, nor display anything in an apartment or bedroom space that is visible from outside the Property or the apartment. Resident may not store at the Property or connect to a Property electrical outlet any mobility device owned by a third party. Pets are permitted in or about the Property only in specified buildings as Owner may in its discretion allow residents to maintain, in each case only following Owner's signature on a Pet Addendum for a single dog or cat per designated apartment, which requires payment of a registration fee and pet rent as provided in the Pet Addendum. All other pets are prohibited anywhere at the Property, except fish in small tanks to the extent approved by Owner in its sole discretion. Violation of the pet policy will subject Resident to deep-cleaning and daily administration fees in Owner’s discretion and may be considered as a termination of this Housing Agreement by Resident.

  • General Use You may install and Use a copy of the Software on your compatible computer, up to the Permitted Number of computers.

  • Liability for Use of Equipment City shall not be liable for any damage to persons or property as a result of the use, misuse or failure of any equipment used by Contractor, or any of its subcontractors, or by any of their employees, even though such equipment is furnished, rented or loaned by City.

  • Illegal Use You may use your FAIRWINDS Credit Union Credit Card for any transaction permitted by law. You may not use your Card for any gambling purposes, either legal or illegal. You agree that illegal use and/or use in gambling activities of this Card will be deemed an action of default and/or breach of contract and such service and/or other related services may be terminated at our discretion. You further agree, should illegal use occur, to waive the right to sue us for such illegal activity directly or indirectly related to it.
