Common use of Outages and Overhauls Clause in Contracts

Outages and Overhauls. (a) Owner shall be entitled to take a Unit out of operation or reduce the Availability of the Unit to repair and maintain the Unit in accordance with Good Industry Practice and the requirements of the ISO Tariff. The dates and times of the outages and any changes to those dates and times shall be determined in accordance with the ISO Tariff. For purposes of complying with the requirements of the ISO Tariff, Other Outage shall be separated between “maintenance outage” and “forced outage,” as defined in the ISO Tariff.
