Other Provisions Subject Hereto. Except as expressly stated in this Article, notwithstanding anything contained in this Indenture to the contrary, all the provisions of this Indenture and the Securities are subject to the provisions of this Article. However, nothing in this Article shall apply to or adversely affect the claims of, or payment to, the Trustee pursuant to Section 9.07. Notwithstanding the foregoing, the failure to make a payment on account of principal of or interest by reason of any provision of this Article VI shall not be construed as preventing the occurrence of an Event of Default under Section 8.01.
Other Provisions Subject Hereto. Except as expressly stated in the Guarantee Subordination Sections, notwithstanding anything contained in this Indenture to the contrary, all the provisions of this Indenture and the Securities are subject to the provisions of the Guarantee Subordination Sections. However, nothing in the Guarantee Subordination Sections shall apply to or adversely affect the claims of, or payment to, the Trustee pursuant to Section 607. ARTICLE FOURTEEN

Notwithstanding the foregoing, the failure to make a payment on account of principal of or interest on the Notes by reason of any provision of this Article 15 shall not be construed as preventing the occurrence of an Event of Default under Section 5.1 hereof.

Expect as expressly stated in this Article VI, notwithstanding anything contained in this Indenture to the contrary, all the provisions of this Indenture and the Securities are subject to the provisions of this Article VI. Notwithstanding the foregoing, the failure to make a payment on account of principal of or interest on the Securities by reason of any provision of this Article VI shall not be construed as preventing the occurrence of an Event of Default under Section 8.01.
Other Provisions Subject Hereto. Except as expressly stated in this Section 5.16, notwithstanding anything contained in any documentation related to the Subordinated Obligations to the contrary, all the provisions of such documentation are subject to the provisions of this Section 5.16. The provisions of this Section 5.16 shall continue to be effective or shall be reinstated, as the case may be, if at any time any payment in respect of Senior Obligations is rescinded or must otherwise be returned on the insolvency, bankruptcy or reorganization of any Payor or otherwise, all as though such payment had not been made.
