Common use of Older Worker Clause in Contracts

Older Worker. ‌ A permanent employee who through advancing years is permanently unable to perform the employee's normal duties may be accommodated with alternate employment, if such employment is available and the employee has the qualifications required for the position. Such an employee shall not displace an employee with more seniority.
