NOW THIS INDENTURE WITNESSETH. THAT in pursuance of the said Agreement executed between the Purchaser and the Vendor/Owner as well as the X.X. No.-. Touzi No.- comprised in R..S. Plot/ Dag No.-, R.S. Khatian No. -, Sub Division- , having Municipal Holding No. , _ , under Xxxx No.-, within the Municipal Corporation, under P.S.- , within the limit of , District , West Bengal, fully described in the 'A' schedule herein below, together with benefits of common user of all the common parts or common installation of the said building being together with common partition wall, common electric meter room, common, staircase, common entrance and exit for the covered Garage of the building TOGETHER WITH all fixtures, walls, sewers, drains. passages, water courses and all manner of former or other rights, liberties, easements, privileges, advantages with all right in common and amenities, facilities and benefits attached with the building for residential purpose as the COMMON PARTS AND/OR COMMON PORTION fully described in the SCHEDULE - 'C' herein below for the beneficial use and better enjoyment of the said covered Garage along with all the right, title, interest, claim and demand whatsoever exclusively relating to the said Covered Garage TO HAVE AND TO HOLD the same unto and in favour of the Purchaser absolutely and forever free from all encumbrances together with all Xerox copy of the Deeds, pattas, hereditaments and muniments of title and every part thereof which now are or is and hereafter shall or may be in the custody power or possession of the Vendor/owner and the Developer Firm through its Partners or any persons or agent of the Vendor/Owner and the Developer Xxxx without any action or proceedings in law and equity and to hold the said Common Space, messuage and hereditaments and undivided proportionate share of land hereby conveyed and transferred unto and to the use of the Purchaser and Purchaser's heirs, successors, legal representatives and assigns absolutely and forever and the Vendor/Owner or his legal heirs, representatives and assigns doth hereby bind themselves that NOTWITHSTANDING THAT any act, deed or thing whatsoever the Vendor/ Owner executed or done or knowingly suffered or to the contrary the Vendor/Owner has good right full power and absolute authority and indefeasible title and interest, to grant, convey, sell and transfer the said covered Garage hereby granted, sold, conveyed and assigned unto and to the use of the Purchaser in the manner aforesaid according to the true intent and meaning of these presents in fee simple and free from all encumbrances and liabilities and without any hindrance eviction disturbance claim or demand whatsoever from the Vendor/Owner or any other person or persons lawfully or equitably claiming from or under or in trust for the Vendor/owner and that the Vendor/owner absolutely acquired and discharge and sufficiently saved defended kept harmless and indemnified of or from and against all defects in title, lispendens attachments and liabilities whatsoever made or suffered by the Vendor/owner and all materials times hereafter Vendor/Owner through the Developer Firm hereby undertakes that at the request and cost of the Purchaser will execute and cause to be done and executed all such deed, matter, petitions for the betterment of the Purchaser's title as well as betterment of the said covered Garage and thing include the copy of the completion certificate whatsoever for more perfectly and effectually and granting and assure the said covered Garage and for the better enjoyment of the said covered Garage and for proportionate undivided land together with all benefits and rights hereby transferred as may be reasonably required, the Vendor/Owner and Developer Firm doth hereby further covenant with the Purchaser that the Purchaser shall have every right to transfer the said covered Garage together with undivided proportionate share of land by way of sale, gift, mortgage, lease, assign etc. with terms and conditions set down herein below. AND THIS INDENTURE FURTHER WITNESSETH THAT THE VENDOR, DEVELOPER FIRM AND PURCHASER jointly hereby covenant with each other that the following covenants would run in respect of the aforesaid covered Garage of the building and all the parties doth hereby declare to abide by the same :-

'C' herein below for the beneficial use rents, issues and better enjoyment of the said covered Garage along with profits thereof and every part thereof AND all the estate right, title, interest, inheritance, use, trust, property and possession claim and demand demands whatsoever exclusively upon the Schedule ‘B’ mentioned flat both at law and in equity of the vendor unto and upon or in respect of the said property or every part thereof AND all deeds, muniments, writing/writings and other evidences of title exclusive relating to or concerning the said Covered Garage TO HAVE AND TO HOLD the same unto and in favour of the Purchaser absolutely and forever free from all encumbrances together with all Xerox copy of the Deeds, pattas, hereditaments and muniments of title and every property or any part thereof which now are or is and hereafter or at any time or times shall or may be in the possession custody or power or possession of the Vendor/owner vendor herein and can or may procure the Developer Firm through its Partners or any persons or agent of the Vendor/Owner and the Developer Xxxx same without any action or proceedings suit of law or in law and equity and to hold TO HAVE AND TO HOLD the said Common Spaceproperty hereby sold unto the purchasers and forever delivered and trans- ferred the said flat mentioned in the Schedule ‘B’ hereunder written which is ab- solutely free from all encumbrances, messuage trusts, liens, impendences, attachments, claims and hereditaments demands WHATSOEVER and the property thus purchased by the purchasers and the purchasers along with their respective heirs, executors, suc- cessors shall have the right to use, occupy and possess the flat absolutely together with the common parts in common with other co-owners, purchasers of the said building and such common parts being occupiers of the common parts described in the respective schedule hereunder AND the purchaser shall use, occupy, pos- sess, let out and also shall have right to sell, convey, transfer, gift, lease, mortgage, convey or dispose of the said flat and the undivided proportionate share of said land hereby conveyed and transferred unto and to some common restrictions upon the use purchaser along with other pur- chasers of the Purchaser and Purchaser's heirs, successors, legal representatives and assigns absolutely and forever and the Vendor/Owner or his legal heirs, representatives and assigns doth hereby bind themselves that NOTWITHSTANDING THAT any act, deed or thing whatsoever the Vendor/ Owner executed or done or knowingly suffered or to the contrary the Vendor/Owner has good right full power and absolute authority and indefeasible title and interest, to grant, convey, sell and transfer the said covered Garage hereby granted, sold, conveyed and assigned unto and to the use of the Purchaser in the manner aforesaid according to the true intent and meaning of these presents in fee simple and free from all encumbrances and liabilities and without any hindrance eviction disturbance claim or demand whatsoever from the Vendor/Owner or any other person or persons lawfully or equitably claiming from or under or in trust flats for the Vendor/owner development and that the Vendor/owner absolutely acquired and discharge and sufficiently saved defended kept harmless and indemnified of or from and against all defects in title, lispendens attachments and liabilities whatsoever made or suffered by the Vendor/owner and all materials times hereafter Vendor/Owner through the Developer Firm hereby undertakes that at the request and cost of the Purchaser will execute and cause to be done and executed all such deed, matter, petitions for the betterment of the Purchaser's title as well as betterment maintenance of the said covered Garage and thing include the copy property for future benefits of the completion certificate whatsoever for more perfectly purchasers and effectually other owners and granting occupiers of the building AND also subject to the purchasers shall pay and assure discharge the said covered Garage payment of all taxes and for the better enjoyment other impositions of the said covered Garage flat wholly and for proportionate undivided land together with all benefits and rights hereby transferred as may be reasonably required, the Vendor/Owner and Developer Firm doth hereby further covenant with the Purchaser that the Purchaser shall have every right to transfer the said covered Garage together with undivided proportionate share of land by way of sale, gift, mortgage, lease, assign etc. with terms and conditions set down herein below. 'C' herein below for the beneficial use and better enjoyment of the said covered Garage along with all the right, title, title and interest, property claim and demand whatsoever exclusively relating to of the Vendors into out of or upon the said Covered Garage TO HAVE AND TO HOLD the same unto and in favour of the Purchaser absolutely and forever free from all encumbrances together with all Xerox copy of the Deeds, pattas, hereditaments and muniments of title and every part thereof which now are or is and hereafter shall or may be undivided share in the custody power or possession of the Vendor/owner said land and the Developer Firm through its Partners or any persons or agent of the Vendor/Owner said flat and the Developer Xxxx without any action or proceedings in law all other benefits, rights, herein comprised and equity and to hold the said Common Space, messuage and hereditaments and undivided proportionate share of land hereby conveyed and transferred unto and to the use of the Purchaser and Purchaser's heirs, successors, legal representatives and assigns absolutely and forever and the Vendor/Owner or his legal heirs, representatives and assigns doth hereby bind themselves that NOTWITHSTANDING THAT any act, deed or thing whatsoever the Vendor/ Owner executed or done or knowingly suffered or to the contrary the Vendor/Owner has good right full power and absolute authority and indefeasible title and interest, to grant, convey, sell and transfer the said covered Garage hereby granted, sold, conveyed conveyed, transferred, assigned and assigned unto assured or expressed or intended so to be and every part or parts thereof respectively TOGETHER WITH his and every of his respective rights, liberties and appurtenances whatsoever to the use of unto the Purchaser in the manner aforesaid according to the true intent and meaning of these presents in fee simple and purchase free from all encumbrances encumbrances, trusts, charges, liens and liabilities attachments whatsoever AND ALSO TOGETHER WITH all easement or quasi easements and without any hindrance eviction disturbance claim or demand whatsoever from other stipulations and provisions in connection with the Vendor/Owner or any other person or persons lawfully or equitably claiming from or under or in trust for the Vendor/owner beneficial use and that the Vendor/owner absolutely acquired and discharge and sufficiently saved defended kept harmless and indemnified of or from and against all defects in title, lispendens attachments and liabilities whatsoever made or suffered by the Vendor/owner and all materials times hereafter Vendor/Owner through the Developer Firm hereby undertakes that at the request and cost of the Purchaser will execute and cause to be done and executed all such deed, matter, petitions for the betterment of the Purchaser's title as well as betterment of the said covered Garage and thing include the copy of the completion certificate whatsoever for more perfectly and effectually and granting and assure the said covered Garage and for the better enjoyment of the undivided share in the said covered Garage land and for proportionate the said flat including those which are more particularly mentioned in the third schedule hereto and in common with other co-owners of the building TO HAVE AND TO XXXX the said undivided share in the said land together with and the said flat and all benefits other benefits, privileges and rights hereby transferred as may be reasonably requiredgranted, sold, conveyed, transferred, assigned and assured and every part or parts thereof absolutely and forever and subject to the Vendor/Owner purchasers covenant contained in the fourth schedule hereunder written AND ALSO subject to the purchasers paying and Developer Firm doth hereby further covenant discharging all taxes and impositions on the said flat wholly and the common expenses proportionately and all other outgoing in connection with the Purchaser that the Purchaser shall have every right to transfer said flat wholly and the said covered Garage together with undivided proportionate share of land by way of sale, gift, mortgage, lease, assign etc. with terms and conditions set down herein below.
