Common use of Not a Contract of Employment Clause in Contracts

Not a Contract of Employment. This Agreement shall not be deemed to constitute a contract of employment, nor shall any provision hereof affect (a) the right of the Company to discharge Employee at will or (b) the terms and conditions of any other agreement between the Company and Employee except as expressly provided herein.

To the extent provided in Paragraph 4 hereof, this Agreement constitutes an amendment to the Employment Agreement.

Nothing in this Agreement shall any provision hereof affect (a) be deemed to give you the right to be retained in the service of the Company or to interfere with the right of the Company to discipline or discharge Employee you at will or (b) the terms and conditions of any other agreement between the Company and Employee except as expressly provided hereintime.

This Agreement shall not be deemed to constitute a contract of employment, nor shall any provision hereof affect (a) the right of the Company (or its subsidiaries) to discharge Employee Executive at will or (b) the terms and conditions of any other agreement between the Company or its affiliates and Employee Executive except however that the provisions in this Severance Agreement shall supercede any and all provisions in such other agreement as expressly provided hereinthey may relate to termination of employment and severance.

Further, nor no portion of this Agreement shall any provision hereof affect (a) the right of the Company (or any subsidiary of or successor to the Company) to discharge Employee Executive at will or (b) the terms and conditions of any other agreement between the Company (or the subsidiary which employs Executive, if applicable) and Employee Executive, except as expressly provided herein.
