NON-WARRANTY. Cooperative’s approvals given pursuant to this Agreement or actions taken hereunder shall not be construed as any warranty or representation to Member or any third party regarding the safety, durability, reliability, performance or fitness of Member’s generation and service facilities, its control or protective devices or the design, construction, installation or operation thereof.
NON-WARRANTY. 18.1. The Area EPS Operator does not give any warranty, expressed or implied, as to the adequacy, safety, or other characteristics of any structures, equipment, wires, appliances or devices owned, installed or maintained by the Interconnection Customer, including without limitation the Distributed Energy Resource and any structures, equipment, wires, appliances or devices not owned, operated or maintained by the Area EPS Operator.

Company's approvals given pursuant to this Agreement or actions taken hereunder shall not be construed as any warranty or representation to Member or any third party regarding the safety, durability, reliability, performance or fitness of Member's generation and service facilities, its control or protective devices or the design, construction, installation or operation thereof.
NON-WARRANTY. Nothing in this Agreement shall be construed as a warranty or representation that making, using or selling of products or services by or for the either Party will be free from infringement of any patents other than the Versata Patents and Callidus Patents as described above.
NON-WARRANTY. Neither by inspection, if any, or non-rejection, nor in any other way, does Xcel Energy give any warranty, expressed or implied, as to the adequacy, safety, or other characteristics of any structures, equipment, wires, appliances or devices owned, installed or maintained by the Interconnection Customer or leased by the Interconnection Customer from third parties, including without limitation the Generation System and any structures, equipment, wires, appliances or devices appurtenant thereto.

NON-WARRANTY. Except as otherwise expressly provided in this Agreement, nothing set forth herein shall be construed as:
NON-WARRANTY. (i) Repair services outside the scope of the warranties described in this Section VII shall be provided by the Contractor and/or the Buyer pursuant to a Repair and Service Agreement to be negotiated in good faith by the parties and signed within a reasonable time following execution of this Agreement.

NON-WARRANTY. Repairs are subject to a minimum one hour labor cost ($75.00 USD) in addition to any repair parts or components. If the item must be sent to a third party for repair, then a $75.00 (USD) handling fee will be added to the third party repair cost. Buyer will be provided with an estimate of repair costs before any repairs are performed.
