Price Warranty. The Contractor warrants that the prices for the items sold to the City hereunder are not less favorable than those currently extended to any other customer for the same or similar items in similar quantities. The Contractor warrants that prices shown on this Purchase Order/Vendor Contract are complete, and that no additional charge of any type shall be added without the City’s express written consent.
Price Warranty. Seller warrants that the prices specified in this Agreement do not exceed the prices charged for like quantities of the same or substantially similar articles to any other purchaser. If prices are lowered for any other customer purchasing similar articles in similar quantities, NETAPPs price shall be lowered to such price. Seller agrees to notify NETAPP of such lower prices within ten (10) days of such sale. Seller will give NETAPP the benefit of any price declines to actual time of shipment. This Agreement must not be filled at higher prices than last quoted or charged without prior written consent of NETAPP. Prices include and Seller shall bear all duties, fees, and taxes including sales, use, property, excise, value added and gross receipts levied on this Agreement or the Goods prior to delivery to the DDP Point. Seller agrees that if any of the above is paid by NETAPP, Seller shall immediately reimburse NETAPP for the amount paid plus any related expenses and interest.

In the event Seller reduces its price(s) for such Goods or Services during the term of this Order, Seller agrees to reduce the prices hereof accordingly effective as of the date of such price reduction. Seller warrants that prices shown on this Order shall be complete, and no additional charges of any type shall be added without the University's express written consent. Such additional charges include, but are not limited to, shipping, packaging, labeling, custom duties, taxes, storage, insurance, boxing, and crating.
Price Warranty. Seller warrants that the prices for the Materials sold to Buyer under this Contract are not less favorable than those currently extended to any other customer for the same or like goods in equal or similar quantities. In the event Seller reduces Seller’s price for such Materials during the term of this Contract, Seller agrees to reduce the prices of the Materials purchased by Buyer accordingly.
Price Warranty. Seller represents and warrants that all of the prices, warranties, benefits, terms and conditions granted to Buyer hereunder are now and shall be no less favorable than the prices, warranties, benefits, terms and conditions granted to Seller’s other customers. If at any time during the term of the Agreement or any extension thereof, Seller shall offer more favorable prices, warranties, benefits, terms, or conditions for substantially the same or similar goods as those provided under the Agreement, then Seller shall within fifteen (15) calendar days after the effective date of such offering, notify Buyer of such fact in writing and offer Buyer the more favorable offering. If during the term of the Agreement, Buyer receives an offer from another supplier to supply the Goods to be supplied hereunder at a lower price than named herein, Seller shall at its option either (a) meet such lower price, or (b) permit Buyer to purchase from such source while such lower price is in effect, and the quantity purchased by Buyer will be deducted from any quantity covered by the Agreement.

Vendor warrants that the prices of the goods and services sold to Alorica hereunder are not less favorable than those currently extended to any other customer for the same or similar goods and services in similar quantities. In the event Vendor reduces its price for such articles during the term of this Order, Vendor agrees to reduce the prices hereof, correspondingly. Vendor warrants that prices shown on this Order shall be complete, and no additional charges of any type shall be added without Alorica’s express written consent. Such additional charges include, but are not limited to shipping, packaging, labeling, customs duties, taxes, storage, insurance, boxing and/or crating. If Alorica shall become entitled to such lower prices, but shall have made payment at any prices in excess thereof, Vendor shall promptly refund the difference in price to Alorica. ALORICA REQUIRES AT LEAST ONE HUNDRED AND TWENTY (120) DAYS WRITTEN NOTICE PRIOR TO ANY PRICE INCREASES. Vendor shall not ship goods or provide services at a higher cost without prior written approval from Alorica.
