Common use of Non-Collusion and Acceptance Clause in Contracts

Non-Collusion and Acceptance. The undersigned attests, subject to the penalties for perjury, that he/she is the agreeing party, or that he/she is the representative, agent, member or officer of the agreeing party, that he/she has not, nor has any other member, employee, representative, agent or officer of the division, firm, company, corporation or partnership represented by him/her, directly or indirectly, to the best of his/her knowledge, entered into or offered to enter into any combination, collusion or agreement to receive or pay, and that he/she has not received or paid, any sum of money or other consideration for the execution of this Agreement other than that which appears on the face of this Agreement. In Witness Whereof, SBA and DWD have, through duly authorized representatives, entered into this MOU. To assist workers impacted by the COVID-19 pandemic, the State has determined it is necessary to expand education and training opportunities for both individuals and employers by building on already successful programs, by marketing those programs to Hoosiers impacted by the pandemic, with a focus on those that have been displaced, and by finding ways to help Hoosiers connect to job opportunities. The goal of the Rapid Recovery for a Better Future initiative is to help Hoosiers get a new job fast or skill up for a better job and dramatically improve their standard of living. We propose the following spending plan for any new federal funds made available, understanding that we must scale up or down depending on funding levels:
