NO WAIVER BY COUNTY. In the event the COUNTY does not insist upon strict performance by A-E or does not exercise any right or option herein conferred, such event shall not be deemed or construed as a waiver or a relinquishment to any extent of any right of COUNTY to insist on strict performance or to assert or rely upon any such terms or options on any future occasion.

(Disputes) of these General Conditions, inspections or approvals, or statements by any officer, agent or employee of County indicating Contractor's performance or any part thereof complies with the requirements of this Contract, or acceptance of the whole or any part of said performance, or payments therefor, or any combination of these acts, do not relieve Contractor's obligation to fulfill this Contract as prescribed; nor is the County thereby prevented from bringing any action for damages or enforcement arising from any failure to comply with any of the terms and conditions of this Contract.

NO WAIVER BY COUNTY. No waiver of any Default under the terms of this Note will be implied from any failure of the County to take, or any delay by the County in taking, action with respect to a breach, default, or failure, or from any previous waiver of any similar or unrelated Default. The acceptance by the County of any payment under this Note that is less than the total of all amounts due and payable at the time of such payment will not constitute a waiver of the right to exercise remedies or options at that time or at any subsequent time, or nullify any prior exercise of any such remedy by the County, without the express consent of the County. The County’s waiver of any term of the Note must be made in writing and will be limited to the express written terms of such waiver.

Except as expressly set forth in this Agreement, inspections, approvals, or statements by any officer, agent or employee of County indicating that Contractor’s performance or any part thereof complies with the requirements of this Agreement, or acceptance of the whole or any part of such performance, or payments therefor, or any combination of these acts, do not relieve Contractor’s obligation to fulfill this Agreement as prescribed; nor is the County thereby prevented from bringing any action for damages or enforcement arising from any failure to comply with any of the terms and conditions of this Agreement.
NO WAIVER BY COUNTY. The County's failure to cancel or enforce this Agreement shall not be deemed a waiver of any claim or remedy the County may have against Owner. In the event the County waives a breach or default under this Agreement, such waiver shall not be deemed to be a waiver of any other subsequent breach thereof or default hereunder.
