Action for Damages. Except as otherwise expressly provided herein, in any suit or other claim brought by either party seeking damages against the other party for breach of its obligations under this Lease, the party against whom such claim is made shall be liable to the other party only for actual damages and not for consequential, punitive or exemplary damages.

Action for Damages. A breach by a party of any of the representations or warranties shall give rise only to an action for damages by the non-breaching party and shall not entitle the non-breaching party to rescind or repudiate this Agreement. The term "Damages" as used in this Article VIII refers to compensatory damages only and not to incidental, consequential, special or punitive damages (other than to the extent that any such damages are paid to a third party by the indemnified party).
