Common use of No Duty to Mitigate Clause in Contracts

No Duty to Mitigate. There shall be no requirement on the part of the Executive to seek other employment or otherwise mitigate damages in order to be entitled to the full amount of any payments and benefits to which the Executive is entitled under this Agreement, and the amount of such payments and benefits shall not be reduced by any compensation or benefits received by the Executive from other employment.

No Duty to Mitigate. There In no event shall Executive be no requirement on the part of the Executive obligated to seek other employment or otherwise mitigate damages in order take any other action by way of mitigation of the amounts payable to be entitled to Executive under any of the full amount provisions of any payments this Agreement and benefits to which the Executive is entitled under this Agreement, and the amount of such payments and benefits amounts shall not be reduced by any compensation whether or benefits received by the not Executive from obtains other employment.

No Duty to Mitigate. There shall be no requirement on the part of the Executive to seek other employment or otherwise mitigate damages in order to be entitled to the full amount of any payments and benefits to which the Executive is otherwise entitled under this Agreementany contract and, and except as set forth herein with respect to the Continuation Benefits, the amount of such payments and benefits shall not be reduced by any compensation or benefits received by the Executive from other employment.

There In no event shall be no requirement on the part of the Executive be obligated to seek other employment or otherwise mitigate damages in order to be entitled take any other action by way of mitigation of the amounts payable to the full amount Executive under any of the provisions of this Agreement and, except as contemplated by Sections 2(c) and 3(a)(iv) hereof, any payments and benefits payable to which the Executive is entitled under this Agreement, and the amount of such payments and benefits hereunder shall not be reduced by subject to reduction for any compensation or benefits received by the Executive from other employment.

No Duty to Mitigate. There The Executive shall not be no requirement on required to mitigate the part ------------------- amount of the Executive to seek any payment required hereunder by seeking other employment or otherwise mitigate damages in order to be entitled to the full amount of any payments and benefits to which the Executive is entitled under this Agreementotherwise, and nor shall the amount of such payments and benefits shall not paid hereunder be reduced or offset by any compensation earned or benefits received by the Executive as a result of employment with another employer, self-employment or any amount received from any other employmentplan, program, policy or arrangement of the Company.

There In no event shall Executive be no requirement on the part of the Executive obligated to seek other employment or otherwise mitigate damages in order take any other action by way of mitigation of the amounts payable to be entitled Executive under any of the provisions of this Agreement and, except as contemplated by Paragraph 3(b) hereof, any Severance Benefits payable to the full amount of any payments and benefits to which the Executive is entitled under this Agreement, and the amount of such payments and benefits hereunder shall not be reduced by subject to reduction for any compensation or benefits received by the Executive from other employment.

There In no event shall be no requirement on the part of the Executive be obligated to seek other employment or otherwise mitigate damages in order to be entitled take any other action by way of mitigation of the amounts payable to the full amount Executive under any of the provisions of this Agreement and, except as contemplated by Sections 2(b) and 3(c)(iii)(B) hereof, any payments and benefits payable to which the Executive is entitled under this Agreement, and the amount of such payments and benefits hereunder shall not be reduced by subject to reduction for any compensation or benefits received by the Executive from other employment.

There shall be no requirement on the part of the Executive to seek other employment or otherwise to mitigate damages in order to be entitled to the full amount of any payments and benefits to which the Executive is otherwise entitled under this Agreement, and the amount of such payments and benefits shall not be reduced by any compensation or benefits received by the Executive from other employment.
