Common use of Navigation Tools Clause in Contracts

Navigation Tools. Any Keyword Search Terms to be directed to the Co-Branded Site shall be (i) subject to availability for use by DigitalWork and (ii) limited to the combination of the Keyword search modifier combined with a registered trademark of DigitalWork (e.g. "AOL keyword: XYZ Company Name"). AOL reserves the right to revoke at any time DigitalWork's use of any Keyword Search Terms which do not incorporate registered trademarks of DigitalWork. DigitalWork acknowledges that its utilization of a Keyword Search Term will not create in it, nor will it represent it has, any right, title or interest in or to such Keyword Search Term, other than the right, title and interest DigitalWork holds in DigitalWork's registered trademark independent of the Keyword Search Term. Without limiting the generality of the foregoing, DigitalWork will not: (a) attempt to register or otherwise obtain trademark or copyright protection in the Keyword Search Term; or (b) use the Keyword Search Term, except for the purposes expressly required or permitted under this Agreement. To the extent AOL allows AOL Users to "bookmark" the URL or other locator for the Co-Branded Site, such bookmarks will be subject to AOL's control at all times. Upon the termination of this Agreement, DigitalWork's rights to any Keyword Search Terms and bookmarking will terminate.

AOL reserves the right to revoke at any time DigitalWork's WebMD’s use of any any, Keyword Search Terms which do not incorporate registered trademarks of DigitalWorkWebMD. DigitalWork WebMD acknowledges that its utilization of a Keyword Search Term will not create in it, it nor will it represent it has, any right, right title or interest in or to such Keyword Search Term, other than the right, right title and interest DigitalWork Interest WebMD holds in DigitalWork's registered WebMD’s trademark independent of the Keyword Search Term. Without limiting the generality of the foregoing, DigitalWork . Upon the termination of this Agreement, DigitalWork's WebMD’s rights to any Keyword Search Terms Term; and bookmarking will terminate.
