Common use of Monitoring/Audit Clause in Contracts

Monitoring/Audit. You understand that the PRODUCTS AND SERVICES are programmed to track the number of deployed instances, nodes, authorized devices, users, throughput, consumption and other usage related data, and you consent to such operations and shall not engage in any activity designed to circumvent or obstruct, or which has the effect of circumventing or obstructing, the PRODUCTS AND SERVICES’ tracking capabilities. You grant to Provider the right to monitor usage by all of your users and to audit your books, records and accounts, at Provider’s expense, during normal business hours to verify compliance with this ▇▇▇▇, and you agree to make available to Provider or its representatives any records pertaining to this ▇▇▇▇. In the event that you use any PRODUCTS AND SERVICES other than as licensed under this ▇▇▇▇ (and/or under another agreement concluded between the parties), in addition to any other remedies available to Provider, you agrees to pay Provider the then current subscription fees and any related service fees for such unauthorized use.
