Mold. Whether or not you experience mold growth in the Premises depends largely on how you manage and maintain your Apartment and on your prompt notice to us of mold conditions. We will not be responsible for any injuries or damages to you or any other person relating to mold caused, in whole or in part, by your failure to clean and maintain the Premises as herein required, or to promptly notify us of conditions in need of repair or maintenance. You understand that the Apartment is subject to mold or mildew growth if not properly maintained or if excessive moisture is present. You agree to maintain the Apartment in a manner that prevents excessive moisture and the occurrence of mold or mildew growth in the Apartment. As part of your compliance with this general obligation, you agree to do the following: (a) Keep the Apartment, including without limitation the kitchen and bathroom areas, clean and dry; (b) Remove all moisture accumulation on windows, walls, ceilings, floors and other surfaces as soon as possible and within 24 hours; (c) Use fans in the bathroom and/or open bathroom windows while showering or bathing and after the shower or bath until all moisture on the mirrors, bathroom walls and tile surfaces has dissipated, after taking a shower or bath, all moisture should be wiped off the shower walls and doors, the bathtub and the bathroom floor, hang up all towels and bath mats so they will completely dry; (d) Use reasonable care to prevent outdoor water from penetrating into the interior of the Apartment via windows or otherwise; (e) Use exhaust fans or open windows whenever cooking, dishwashing or cleaning to allow moisture to escape from the Apartment; (f) Take all reasonable measures to control the moisture level in the Apartment; (g) On a routine basis, and at least once per month, visually inspect all areas of the Apartment for mold growth or signs of water damage and wetness; (h) Immediately report to Management orally and in writing any water leaks or water intrusions into the Apartment, or any excess water in or in the vicinity of the Apartment (walls, floor, ceiling, etc.) or in the building, such as plumbing leaks, roof leaks, foundation leaks, drips, sweating pipes, flooding or puddling of water; (i) Immediately report to Management orally and in writing any mold growth you find, identifying the location where found inside the Apartment; and (j) Immediately report to Management orally and in writing any problems you become aware of relating to fans, heating, air conditioning or other ventilation systems.

Mold. Whether It is generally understood that mold spores are present essentially everywhere and that mold can grow in most any moist location. Emphasis is properly placed on prevention of moisture and on good housekeeping and ventilation practices. Tenant acknowledges the necessity of commercially reasonable housekeeping, ventilation and moisture control (especially in kitchens, janitor’s closets, bathrooms, break rooms and around outside walls) for mold prevention. Without limiting the generality of the foregoing, Tenant shall adopt and implement the following guidelines: (A) report any maintenance problems involving water, moist conditions or mold to the property manager for the Industrial Center (the “Property Manager”) promptly and conduct its required activities in a commercially reasonable manner that prevents unusual moisture conditions or mold growth; (B) do not you experience mold growth in block or inhibit the flow of return or make-up air into the HVAC system; (C) maintain the Premises depends largely on how you manage at a consistent temperature and humidity level in accordance with the Property Manager’s instructions; (D) regularly conduct janitorial activities, especially in bathrooms, kitchens and janitorial spaces, to remove mildew and prevent or correct moist conditions using commercially reasonable measures; and (E) maintain your Apartment water in all drain taps at all times. In signing that certain First Amendment to Lease, Tenant acknowledges that it is currently in occupancy of the Premises and on your prompt notice certifies that, to us the best of mold conditionsTenant’s knowledge, Tenant has not observed mold, mildew or moisture within the Premises. We will not be responsible Tenant agrees to immediately notify Landlord if it observes mold/mildew and/or moisture conditions (from any source, including leaks), and allow Landlord to evaluate and make recommendations and/or take appropriate corrective action. Except to the extent caused by the gross negligence or willful misconduct of Landlord or Landlord’s agents and/or contractors, Tenant relieves Landlord from any liability for any injuries bodily injury or damages to you property caused by or any other person relating to mold caused, in whole associated with moisture or in part, by your failure to clean and maintain the Premises as herein required, growth of or to promptly notify us of conditions in need of repair or maintenance. You understand that the Apartment is subject to mold or mildew growth if not properly maintained or if excessive moisture is present. You agree to maintain the Apartment in a manner that prevents excessive moisture and the occurrence of mold or mildew growth in the Apartment. As part of your compliance with this general obligation, you agree to do the following: (a) Keep the Apartment, including without limitation the kitchen and bathroom areas, clean and dry; (b) Remove all moisture accumulation on windows, walls, ceilings, floors and other surfaces as soon as possible and within 24 hours; (c) Use fans in the bathroom and/or open bathroom windows while showering or bathing and after the shower or bath until all moisture on the mirrorsPremises. Small Areas of Mold: If mold has occurred on a small no-porous surface such as ceramic tile, formica, vinyl flooring, metal or plastic and the mold is not due to an ongoing leak or moisture problem, Resident(s) agrees to clean the areas with soap (or detergent) and a small amount of water, let the surface dry, and then within 24 hours apply a non-staining cleaner such as Lysol Disinfectant, Pine-Sol disinfectant (original pine scented), Tilex Mildew Remover, or Clorox Cleanup.

The inspection will include but is not limited to:  Window frames, visually inspect baseboards, walls and carpets  The ceiling  Any currently or formerly damp material made of cellulose (such as wallpaper, books, papers, and newspapers)  Appliances (including washers/dryers/dishwashers and refrigerators)  Around all plumbing fixtures (toilets, bathtubs, showers, sinks and below sinks)  Areas with limited air circulation such as closets, shelves and cupboards  Personal property YOU AGREE TO PROMPTLY REPORT TO US IN WRITING:  Visible or suspected mold that you do not clean as explained below. Mold may range in color from orange to green, brown, and/or black. There is often a musty odor present.  Overflows or leaks around showers/bath/sink/toilet/washers/refrigerator/air conditioners  Plumbing problems  Discoloration of walls, baseboards, doors, window frames, ceilings  Loose, missing or failing grout or caulk around tubs, showers, sinks, faucets, countertops  Clothes dryer vent leaks  Any non-operational windows, doors, fans, heating or air conditioning units  Any evidence of leaks or excessive moisture in the Residence or on the Property  Any maintenance needed at the Property YOU AGREE THAT YOU WILL NOT:  Bring any personal property into the property that may contain high levels of mold, especially “soft possessions” such as couches, chairs, mattresses, and pillows  Stack items against walls in a manner that decreases air circulation and may lead to mold  Maintain an excessive number of indoor plants  Maintain a fish tank or other water filled container without our written consent If a small amount of mold has grown on a non-porous surface such as ceramic tile, Formica, vinyl flooring, metal, or plastic, and the mold is not due to an ongoing leak or moisture problem, you agree to clean the areas with soap (or detergent) and a small amount of water, let the surface dry, and then within 24 hours apply a non-staining cleaner such as Lysol Disinfectant®, Pine- Sol Disinfectant®, Tilex Mildew Remover®, or Clorox Cleanup®. Because Tilex Mildew Remover® and Clorox Cleanup® contain bleach (which may discolor some materials), they may not be appropriate cleaners if discoloration could be a problem. You agree to comply with all instructions and requirements necessary to prepare the Residence and/or Property for investigation and remediation, to control water intrusion, to control mold growth, or to make repairs. Storage, cleaning, removal, or replacement of contaminated or potentially contaminated personal property will be your responsibility unless the elevated mold growth was the result of our negligence, intentional wrongdoing or violation of law. We are not responsible for any condition about which we are not aware. You agree to provide us with copies of all records, documents, sampling data and other material relating to any water leak, excessive moisture, mold conditions in the Residence or Property as soon as you obtain them. Violation of any of the Apartment for mold growth or signs provisions of water damage and wetness; (h) Immediately report to Management orally and in writing any water leaks or water intrusions into the Apartment, or any excess water in or in the vicinity this section will be a material breach of the Apartment (walls, floor, ceiling, etcthis Agreement.) or in the building, such as plumbing leaks, roof leaks, foundation leaks, drips, sweating pipes, flooding or puddling of water; (i) Immediately report to Management orally and in writing any mold growth you find, identifying the location where found inside the Apartment; and (j) Immediately report to Management orally and in writing any problems you become aware of relating to fans, heating, air conditioning or other ventilation systems.

Tenant hereby agrees to: keep the Premises clean and regularly dust, vacuum and mop; use ceiling fans if present; use hood vent when cooking, cleaning and dishwashing; run exhaust fan when bathing/showering and afterward for a sufficient amount of time to remove moisture; hang shower curtains inside bathtub when showering; securely close shower doors if present; leave bathroom and shower doors open after use; inspect regularly for leaks around and under sinks, tubs, toilets, dishwashers, water heaters, washers, etc.; immediately wipe down any and all moisture and/or spillages on all hard surfaces, floors, walls, vanities/sink tops, windows and xxxxx; avoid air drying dishes; not hang-dry clothes indoors; use dryer if present for wet towels; avoid excessive amounts of indoor plants and water all indoor plants outdoors; open blinds/curtains to allow light into Premises; keep closet doors ajar; use household cleaners on any hard surfaces; regularly empty dehumidifier if used; remove any moldy or rotting food immediately from the Premises and take garbage outside regularly. Tenant shall immediately report in partwriting to Landlord: visible or suspected mold; all air conditioning or heating problems or spillage; plant watering overflows; musty odors, by your failure shower/bath/sink/toilet overflows; leaky faucets, plumbing, animal urine accidents; discoloration of walls, baseboards, doors, window frames, ceiling; moldy clothing; refrigerator and air conditioning drip pan overflows; moisture dripping from or around any vents or air conditioning condenser lines; loose, missing or failing grout or caulk around tubs, showers, sinks, faucets, and countertops; clothes dryer vent leaks and any and all moisture. If mold has occurred on a small non-porous surface such as ceramic tile, Formica, vinyl flooring, metal or plastic and the mold is not due to an ongoing leak or moisture problem, Tenant agrees to clean the areas with soap (or detergent) and maintain a small amount of water, let the Premises surface dry and then, within 24 hours, apply a non staining cleaner such as herein requiredLysol Disinfectant, Pine-Sol Disinfectant, Tilex Mildew Remover or Clorox Cleanup. Landlord reserves the right to promptly notify us of conditions terminate the tenancy and Tenant agrees to vacate the premises in need of repair or maintenance. You understand the event Landlord, in its sole judgment, feels that the Apartment either there is subject to mold or mildew growth if not properly maintained present in the dwelling unit which may pose a safety or if excessive moisture health hazard to Tenant or other persons and/or Tenant’s actions or inactions are causing a condition which is presentconducive to mold growth. You agree Tenant can be held responsible for property damage to maintain the Apartment in a manner dwelling and any health problems that prevents excessive moisture and may result from their failure to take reasonable measures to prevent the occurrence and spread of mold or mildew growth or failure to notify Landlord of any mold, mildew or moisture problems immediately in writing. Violation shall be deemed a material violation under the terms of the Lease. Tenant shall hold Landlord harmless for damage or injury to person or property as a result of Tenant’s failure to comply with the terms of this section. Tenants agree to hold Landlord and its employees harmless and shall look solely to the property Owner in the Apartment. As part event of your compliance with this general obligationany litigation or claims concerning injury, you agree damage or harm suffered due to do the following: (a) Keep the Apartment, including without limitation the kitchen and bathroom areas, clean and dry; (b) Remove all moisture accumulation on windows, walls, ceilings, floors and other surfaces as soon as possible and within 24 hours; (c) Use fans in the bathroom and/or open bathroom windows while showering mold or bathing and after the shower or bath until all moisture on the mirrors, bathroom walls and tile surfaces has dissipated, after taking a shower or bath, all moisture should be wiped off the shower walls and doors, the bathtub and the bathroom floor, hang up all towels and bath mats so they will completely dry; (d) Use reasonable care to prevent outdoor water from penetrating into the interior of the Apartment via windows or otherwise; (e) Use exhaust fans or open windows whenever cooking, dishwashing or cleaning to allow moisture to escape from the Apartment; (f) Take all reasonable measures to control the moisture level in the Apartment; (g) On a routine basis, and at least once per month, visually inspect all areas of the Apartment for mold growth or signs of water damage and wetness; (h) Immediately report to Management orally and in writing any water leaks or water intrusions into the Apartment, or any excess water in or in the vicinity of the Apartment (walls, floor, ceiling, etcmildew.) or in the building, such as plumbing leaks, roof leaks, foundation leaks, drips, sweating pipes, flooding or puddling of water; (i) Immediately report to Management orally and in writing any mold growth you find, identifying the location where found inside the Apartment; and (j) Immediately report to Management orally and in writing any problems you become aware of relating to fans, heating, air conditioning or other ventilation systems.
