Mezzanine Loan Spreads. Lender and Borrower acknowledge and agree that, in connection with corresponding amendments to the Mezzanine Loan Agreement to become effective on the Modification Closing Date, the “Spread” (and the weighted average of the “Spreads”) pursuant to the Mezzanine Loan Agreement shall be as follows, during the periods specified: Mezzanine Loan Period: Spread: 12 month period from and after (and including) November 4, 2010 8.00 % 12 month period from and after (and including) the Payment Date occurring in November, 2011 8.50 % 12 month period from and after (and including) the Payment Date occurring in November, 2012 9.50 % 24 month period from and after (and including) the Payment Date occurring in November, 2013 10.00 %

  • The Mortgage Pool The Series ____-__ Certificates shall evidence the entire beneficial ownership interest in a mortgage pool (the "Mortgage Pool") of conventional, fixed rate, fully amortizing one- to four-family residential mortgage loans (the "Mortgage Loans") having the following characteristics as of ________ __, ____ (the "Cut-off Date"):
