Common use of Management Recognition Clause in Contracts

Management Recognition. The UNION recognizes the prerogative of the CITY to operate and manage the DEPARTMENT in all respects in accordance with its responsibilities, powers and authority subject to those rights, privileges, working conditions and past practices, which are superseded by this agreement. Provided, however, that nothing in this agreement shall be construed as the relinquishment by the CITY of obligations, responsibilities and authorities, conferred upon it by the statutes of the State of Indiana or by Muncie City Ordinances, to act in final judgment on the management of the DEPARTMENT affairs in the public interest.
