LEAVE PAY. A. In the event a teacher has depleted his present accumulated sick leave, he may, upon request, borrow a maximum of ten (10) days on his sick leave policy is provided for the following yearpurpose of protecting the teacher's income during illness or accident and to assist during time of bereavement, religious holidays, professional growth and achievement, pressing personal business, and/or emergencies within the limits of accumulated leave time. The principal may request a physician’s statement for an absence illness of three five (35) or more day’s durationdays, a teacher may be required to secure a physician's certificate covering such absence before an allowance is granted for full salary. If requested, such certificate must be forwarded by the principal with the first payroll report following the return of the teacher.
D. Any teacher 2. Absence for Work-Related Injuries or Illness
a. Teachers who is are absent from work because of an injury work-related injuries or disease illnesses shall suffer no loss of compensation or leave time for the first twenty (20) work days of such illness or injury. Examples of such compensable illnesses or injuries shall include, but are not limited to: illnesses of mumps, scarlet fever, measles, chicken pox, lice, scabies, rubella fever, or injuries of unprovoked battery on the part of a student against a teacher, accidents suffered at the workplace.
b. Teachers who are absent from work because of work-related injuries or illnesses which exceed twenty (20) working days and such absence is compensable under the Michigan Worker’s 's Compensation Law shall receive from the Board the difference between the compensation allowance under the Worker’s Compensation Law and his his/her regular salary, to within the extent, and until such time, as said teacher shall have used up any sick leave as provided herein. The difference, as stated above, shall be calculated on the monetary value limits of the accumulated sick leaveleave time. Example: Worker’s Compensation two-thirds (2/3) plus sick The amount of leave one-third (1/3) payment. One-third (1/3) sick leave payment is equal to one-third (1/3) of a sick leave daytime charged against the teachers who come under this provision shall be in the same proportion as the compensation by the Board.
E. A partial day’s absence (1) The teacher must notify the administration either in writing or verbally, within 24 hours of the injury. Teachers may use the substitute call line for less than half this notification on weekends or holidays.
(2) If the consequences of the injury are not apparent until after the 24 hour period, the Board may compensate and grant leave time to the teacher. If compensation and/or leave time is denied, the teacher may appeal the decision to a day shall be counted neutral third party mutually agreed upon by the Board and the Association.
c. If a teacher has exhausted his/her leave time and sick bank time, the Board will pay the difference between the teacher's regular daily rate and the Worker's Compensation until the teacher is eligible for long-term disability.

3. Absence Due to Death of a Relative or Friend
a. Absence without loss of pay will be countedallowed for the death of a relative (husband, wife, grandmother, grandfather, mother, father, daughter, son, sister, brother, or equivalent in-law). Special arrangements should be made with the Superintendent if approved by such absence must extend beyond a period of five (5) days.
b. Absence without loss of pay may be allowed for attending the funeral of a more distant relative or friend, provided prior approval is obtained for such absence from the Superintendent through the building principal. A half Absence for this purpose, in general, is limited to one (1) day’s absence will .
4. Absence Due to Attendance at Education Meetings
a. Teachers may attend educational meetings directly related to their field of work, without loss of time or pay provided permission to attend such meetings is granted by the principal and/or supervisor in charge and approved by the Superintendent.
b. Permission may, upon approval of the Superintendent, be charged granted for attendance by staff members at an education related activity or meeting with a teacher missing more than one hour loss of time only.
c. Visiting days may be granted to teachers at the discretion of the Superintendent and less than three and one-half (3 1/2) hours. A full day no deduction in pay shall be charged made for absences of more than three and one-half (3 1/2) hourssuch an approved absence.

C. Common Bank - The purpose of the Common Sick Leave Bank is to assist professional staff members who suffer prolonged illness. Participating faculty members can draw up to thirty (2/330) plus working days of sick leave one-third (1/3) paymentfrom the bank in one school year by fulfilling these requirements.
1. One-third (1/3) All but the last three personal sick leave payment days must be used before any withdrawal can be made.
2. Teachers may begin withdrawing from the sick bank no sooner than the 22nd consecutive workday, following the present bout with the illness.
3. A doctor’s written statement must be presented at the time of withdrawal confirming need for leave from work.
4. A teacher must have worked more than 90 days of their first year to be eligible for the bank.
5. No teacher shall draw more than 30 days from the common bank during any two (2) consecutive years.
6. Maternity leave shall be treated the same as illness with all the benefits as well as the restrictions stated above. Teachers who are not full-time teachers will participate in the contribution to, and the use of, the sick leave bank on a pro-rated basis. The Association will appoint a person who shall consult with the Superintendent prior to his ruling on request for days from the sick leave bank.
D. Each teacher shall be allowed three (3) days, of his/her sick leave allowance Section A above, to be used for personal leave days. A personal day may be used for any personal business without explanation, except they may not be used to miss Parent/Teacher Conferences or in-service days. When a teacher who has exhausted personal days is equal confronted with an extreme personal emergency otherwise qualifying for personal day use, he/she may upon application to onethe Superintendent be granted an additional paid day deductible from his/her accrued sick days. When a personal day is proposed to be taken, notice shall be given to the designated administrator at least forty-third eight (1/348) clock hours prior to said day. Emergency requests for personal days, based upon urgent and unforeseen circumstances, may be made within the forty-eight-(48) hour period. Such request may also be made under such circumstances as to particular calendar periods when personal days may not regularly be taken. Such request will not be denied without substantial reasons. Personal days may not be taken, except as qualified above, two days before or immediately following vacations, the beginning of a sick leave daysemester, or during the five (5) school days prior to the last regularly scheduled class or during the first 3 (three) students days of the school year. They may not be used in conjunction with comp time.
E. A partial day’s ▇. ▇▇▇▇▇▇▇▇▇▇▇ that teaching is an ever-changing field and the large amount of continuing education required by law, teachers taking graduate courses will be given one additional personal business day each semester they are enrolled in graduate courses. This total will not exceed two additional personal business days per school year. Teachers must show proof of enrollment either at the beginning of the semester or when submitting absence for less than half a day shall be counted as a half day’s absence. An absence which is more than a half day, but less than a full day, shall be charged as a full day. Absences of less than one (1) hour need not be counted, if approved by the paperwork to their building principal. A half day’s absence These personal business days cannot be saved if not used, and teachers must follow the guidelines spelled out in paragraph D above.
F. The Board recognized that attending conferences is necessary for teachers to keep current in their area(s) of certification. Each building will be charged for allotted 20 professional conferences days each year. The building principal will manage the use of these days on a teacher missing more than one hour and less than three and one-half (3 1/2) hours. A full day shall be charged for absences of more than three and one-half (3 1/2) hoursrotating schedule to allow equitable access to all teachers in the building.

LEAVE PAY. A. All teachers Any bargaining unit employee absent from duty because of personal illness, physical disability, illness or injury, injury shall be allowed paid the person’s full pay salary for a the period of time off, not to exceed the total number of ten (10) day’s absence in any school year. For the period the teacher is unable to resume teaching duties under this paragraph, the teacher shall not accumulate any further sick leave days until the time the teacher has returned to teaching, but shall be deducted from final pay in compensated according to Article 27.D.

E. A partial day’s absence for No less than half a day shall be counted as a half day’s absence. An absence which is more than a half day, but less than a full day, shall be charged as a full day. 8.3 A teacher who has exhausted his/her sick leave during the first year in the system shall forfeit one day's salary for each subsequent day of absence due to illness.
8.4 A teacher shall be repaid for salary deductions made as per paragraph 8.3 (above) in the following manner: One day's salary for each day of sick leave accumulated by the end of the school year.
8.5 Any teacher who has sick leave time accumulated from the previous year or who had taught the previous year and used up his/her sick leave shall be credited with fourteen (14) days on the first day he reports for duty.
8.6 Any teacher absent more than five (5) consecutive days because of illness may be required to submit a statement from a doctor certifying such illness.
8.7 The provisions of this Article shall apply to absence due to surgery when the surgeon certifies that such surgery must be performed immediately.
8.8 The Board shall provide each bargaining unit member with a written statement at the beginning of the school year setting forth the total accumulated sick leave credit, prior to June 1if any.
8.9 An employee, teachers who have accumulated between one hundred seventy-one upon severing employment with the Harbor Springs Public Schools, shall receive fifty dollars (171$50.00) for each unused sick days and one hundred eighty (180) sick days may donate 10 days towards the sick bank. The teacher shall notify the business office, in writing, day provided a letter of their intent to donate 10 days retirement/resignation is submitted to the sick bankSuperintendent not later than seventy- five (75) days preceding the official date of retirement/resignation (notification time period may be shortened by mutual written agreement of both parties). In the event of death of the employee prior to severance, this benefit shall receive from the Board the difference between the allowance under the Worker’s Compensation Law and his regular salary, be paid to the extent, and until such time, as said teacher shall have used up any sick leave as provided herein. The difference, as stated above, shall be calculated on the monetary value of the accumulated sick leave. Example: Worker’s Compensation two-thirds (2/3) plus sick leave one-third (1/3) payment. One-third (1/3) sick leave payment is equal to one-third (1/3) of a sick leave daybeneficiary.

LEAVE PAY. A. All teachers absent from duty because of personal illness, physical disability, or injury, shall be allowed full pay for a total of ten (10) day’s absence in any school year. In the event a teacher has depleted his present accumulated that an employee is disabled through an injury or illness covered by Workers' Compensation, the employee may use his/her sick leave, he may, upon request, borrow a maximum of ten (10) days on his and his/her sick leave policy for the following year. Said borrowed sick leave days shall be deducted from final reduced by the amount so as to provide 100% pay in coordination with Workers' Compensation Insurance. Under no circumstances may the event the teacher leaves the system before days have been re-accumulated. However, temporary replacement teachers shall earn one (1) paid sick day per month of continuous employment, accumulative to no more than ten (10) days per year. Furthermore, temporary replacement teachers may not borrow sick days from anticipated accumulationsbank be used for this purpose.

C. All LFEA members will donate one day for each accumulated year to the sick bank regardless of the balance in the bank until they have achieved 6 years of Lake ▇▇▇▇▇▇ teaching seniority. In the event the sick bank shall fall below 500 days, everyone will contribute a day and other members under 5 years of seniority will not be doubly charged. New members currently on staff will not be charged for their years up to this point. Directives for the use of the sick leave bank shall be as follows:
1. Upon request, medical verification will be given to the Sick Leave Bank Committee.
2. After depletion of an individual's sick leave days, a minimum of five consecutive days and one hundred eighty (180) must lapse before the teacher is eligible to apply for sick leave bank days. Days without pay shall be dispersed over five pay periods unless time granted is at the end of the fiscal year.
3. Sick leave bank days may donate 10 be granted as full days towards or half days. Any member who uses days from the sick bank. The teacher shall notify the business officebank must return each year, in writing, of their intent to donate 10 days to the sick bank, one day until withdrawn time has been replaced by the member.
4. Failure Whenever possible, requests for sick leave bank days must be made in writing.

8. These regulations may not be changed without mutual agreement between the Board and the Association.
9. A teacher may draw, from the sick leave bank, only that teacher number of days necessary to meet the LTD qualifying period as specified in Article 25, Section C.
10. The use of sick bank days cannot being able be used to donate to extend the period during which the Board of Education pays fringe benefits unless the sick bank days are part of a ten day continuous block of time. The Board will cease to pay fringe benefits for the upcoming year. No mid-year additions will be accepted. A temporary replacement teacher may carry over his accumulated an employee who is off, when that employee's personal sick days earned from year to year only have been exhausted, except as provided in the event that said teacher is continued as a regular teacher. Employment must be continuous and must be converted to regular status in order to have any accumulationabove sentence.
C. Each teacher shall present a signed statement, if requested by 11. The teacher will be returned an equivalent vacant teaching position the following September, earlier at the discretion of the Board of Education, upon medical verification that the teacher is now able to return to their full duties.
E. Teachers may use three (3) days leave for personal business, which cannot normally be handled outside school hours, such as medical, financial, legal, religious, emergency, or other situations. Teachers are required to indicate general category that personal day will be used for, but will not be required to detail reason. Application for such leave must be made in writing. The request must be made three (3) days in advance of the date requested, except in the case of an injury or disease compensable under emergency. Teachers may use personal business days adjacent to holiday and vacation time with the Michigan Workerbuilding administrator’s Compensation Law authorization. Teachers may not use personal business days on a Professional Development day. Habitual use shall be used to deny authorization. Personal days will become sick days if not used.
F. Leave of absence with pay not chargeable against the teacher's sick leave allowance shall be granted when the teacher is called and serves on jury duty. The Board will pay the make-up pay portion between the daily rate of the teacher and what they receive from the Board the difference between the allowance under the Worker’s Compensation Law and his regular salarycourt, to the extent, and until such time, as said teacher shall have used up any sick leave as provided hereinless expenses. The difference, as stated above, Retirement benefits will not be diminished by participation on jury duty. Use for other than personal illness and/or disability shall be counted, if approved in addition to the ten (10) day maximum use of sick days under Article 13.B.

The ELEA Executive Board shall provide the number of borrowed sick days for a teacher missing more than one hour each individual to the Human Resources Department. B. At the beginning of each school year, each teacher shall retain the number of sick days with the number of days of sick leave not used during the prior school year. Unused sick leave days shall accumulate from year to year without limitation.
C. If, at the beginning of any school year, a teacher is ill and unable to resume teaching duties in the school system, and such teacher has unused accumulated sick leave days at the end of the prior school year, the teacher will be allowed to use such previously accumulated sick leave days while the teacher remains ill and unable to work, provided the teacher is not otherwise employed. For the period the teacher is unable to resume teaching duties under this paragraph, the teacher shall not accumulate any further sick leave days until the time the teacher has returned to teaching, but shall be deducted from final pay in compensated according to Article 27.D.
D. If a teacher’s illness extends beyond five (5) work days, the event Board may require an examination by a physician of the teacher’s choice. The Board may require a second opinion by a physician chosen by the teacher leaves from three (3) names submitted by the system before days have been re-accumulatedBoard. However, temporary replacement teachers The second opinion shall earn be at the Board’s expense. The teacher may select an examination by only one (1) paid sick day per month of continuous employment, accumulative to no more than ten (10) days per year. Furthermore, temporary replacement teachers may not borrow sick days from anticipated accumulationsthe Board’s doctors at the Board’s expense.
B. Each teacher shall be entitled to an accumulation of the unused portion of each year’s sick leave which shall be available to him for future years. Sick leave may be accumulated to a total of one hundred eighty (180) days. At the end of the school year, prior to June 1, teachers who have accumulated between one hundred seventy-one (171) sick days and one hundred eighty (180) sick days may donate 10 days towards the sick bank. The teacher shall notify the business office, in writing, of their intent to donate 10 days to the sick bank. Failure to notify the business office prior to June 1 will result in that teacher not being able to donate to the sick bank for the upcoming year. No mid-year additions will be accepted. A temporary replacement teacher may carry over his accumulated sick days earned from year to year only in the event that said teacher is continued as a regular teacher. Employment must be continuous and must be converted to regular status in order to have any accumulation.
C. Each teacher shall present a signed statement, if requested by the Administration, indicating the reason for each absence, such statement to be filed in the principal’s office. The principal may request a physician’s statement for an absence of three (3) or more day’s duration.
D. E. Any teacher who is absent because of an injury or disease compensable under the Michigan Worker’s Compensation Law shall receive from the Board be entitled to use previously accumulated sick leave in one-third (1/3) day increments to make up the difference between the allowance under the Worker’s Compensation Law and his the regular salary, to salary during the extent, and until such time, as said teacher shall have used up any sick leave as provided herein. The difference, as stated above, shall be calculated on the monetary value period of the accumulated sick leave. Example: disability compensable under Michigan Worker’s Compensation two-thirds (2/3) plus Law, with or without interruption in consecutive days, attributable to the same accident.
F. In addition to personal illness or injury, sick leave may also be used for medical, dental, or optical examinations or treatments. No less than one-third half (1/3) payment. One-third (1/3½) sick leave payment is equal to one-third (1/3) of a sick leave dayday will be charged unless otherwise arranged with the supervisor.
E. G. A partial day’s absence for less than half a day teacher shall be counted as a half day’s absence. An absence which is more than a half day, but less than a full day, shall be charged as a full day. Absences released from regular duties without loss of less than one salary at least one
(1) hour need not day each school year for the purpose of participating in area or regional meetings of the Michigan Education Association, when lawfully scheduled.
H. Teachers who exhaust sick days may send a written request to the ELEA Executive Board to borrow up to five (5) future sick days for medically verifiable illness/disability of the individual, spouse, father, mother, sibling, child, and grandchild. Use for other than personal illness and/or disability shall be counted, if approved in addition to the ten (10) day maximum use of sick days under Article 13.B.
I. The maximum borrowed each year by the building principal. A half day’s absence entire ELEA bargaining unit will be charged capped at forty (40) days. The ELEA Executive Board shall provide the number of borrowed sick days for a teacher missing more than one hour each individual to the Human Resources Department.
J. After returning to work and less than three earning additional sick days, teachers who borrowed from their future sick days agree to repay such days at the rate of two and one-half (3 1/22.5) hoursdays per year. A full day shall Teachers may not borrow additional days until all five (5) days are repaid.
K. If the teacher does not return to work, his/her final pay will be charged for absences of more than three and reduced by an amount equivalent to the remaining borrowed sick days. Should an employee leave without repaying the borrowed sick days, the bargaining unit members will be docked one-half (3 1/20.5) hourssick day starting with the most seniored and continuing down the seniority list until all days have been repaid. Docking will only be taken from bargaining unit members with twenty (20) or more sick days. Subsequent docking shall start where the previous repayment stopped.
L. This Article is subject to reopening each year of this contract by either party.

LEAVE PAY. A. All teachers Any person in the bargaining unit absent from duty because of personal illness, physical disability, illness or injury, injury shall be allowed paid the person’s full pay salary for a the period of time off, not to exceed the total number of ten (10) day’s absence in any school year. In the event a teacher has depleted his present unused accumulated sick leave, he may, upon request, borrow a maximum leave days in his/her personal account. LEAVE PAY. A. All teachers absent from duty because of personal illness, physical disability, or injury, shall be allowed full pay for a total of ten twelve (10) day’s absence in any school year. In the event a teacher has depleted his present accumulated sick leave, he may, upon request, borrow a maximum of ten (10) days on his sick leave policy for the following year. Said borrowed sick leave shall be deducted from final pay in the event the teacher leaves the system before days have been re-accumulated. However, temporary replacement teachers shall earn one (1) paid sick day per month of continuous employment, accumulative to no more than ten (1012) days per year. FurthermoreSix (6) days will be credited between the beginning of school and December 31, temporary replacement teachers may not borrow and six (6) days will be credited between January 1 and the end of the school year. Acceptable reasons for sick days leave with pay shall be personal illness or injury and/or serious illness in the immediate family requiring the employee to be present with the seriously ill family member. For immediate family illness, the administration has the right to require the employee to provide verification from anticipated accumulationsthe family member’s attending physician that:
1. the individual under his/her care is seriously ill, and
2. that the illness requires the employee to be present with the family member. This verification by the attending physician shall be on a form provided the district. “Immediate Family” shall be interpreted to include mother, father, sister, brother, husband, wife, son, daughter, parent-in-law, grandparents, step-parents, stepbrother, stepsister, stepchild, or any person who is a permanent resident of the household in which the employee is residing.
B. Each Any teacher on sick leave for a longer period than that which they have accumulated, shall have one day of their salary deducted for each day’s absence beyond the number of accumulated sick leave days.
C. When it becomes apparent to a building principal that a teacher is abusing his sick day leave, it will be the principal’s responsibility to inform the teacher involved. If the situation still exists, the superintendent will be notified and may have the teacher substantiate future absences for the remainder of the year.
D. Teachers’ illness/sick leave will not be charged against his/her sick days when school is not in session.
E. The Board will furnish each teacher with a written statement at the beginning of each year setting forth his/her total sick leave and business day credit.
F. If, during the school year, the Superintendent is not able to get a teacher excused from jury duty, the Board of Education will pay the regular salary for jury duty. Any check for such jury duty will be sent to the ▇▇▇▇▇ Board of Education.
G. Teachers voluntarily (i.e., including retirement and resignation) leaving the employ of the Board after at least ten (10) years service in the ▇▇▇▇▇ Consolidated Schools shall be entitled to an accumulation paid eight dollars ($8.00) per day for each unused accumulated sick and/or business leave day in excess of the unused portion of each sixty-five (65) days. Payment shall not be made for more than one hundred fifteen (115) days.
H. Three (3) personal business days per year’s sick leave which , with pay, shall be available to him teachers for future yearsthe purpose of emergency or for conducting business which cannot be normally carried on after school hours or on Saturday. Sick leave Request for personal business days shall be made to the building principal at least twenty-four hours in advance, unless this is not possible due to an emergency. Personal business days should not be attached to holiday breaks and should not be used on any State testing dates, District examination dates, or Professional Development days. Should any personal business day request be denied by the building principal, an appeal may be accumulated made to the Superintendent.
I. Personal business days that are not used will be transferred to sick leave at the end of the school year. A total of unused sick leave days and transferred personal business days are cumulative to a total maximum of one hundred eighty (180) days.
J. Leaves of absence with pay not chargeable against the teacher’s sick leave or personal business day allowance shall be granted for the following reasons:
1. At the end A maximum of five (5) consecutive bereavement days per incident for a death of husband, wife, son, daughter, mother, father, brother, sister, grandparents, grandchildren, parents-in-law, stepparents, stepbrother, stepsister, stepchild, or any other member of the school yearfamily who is a permanent resident of the household in which the employee is residing. Weekends will not be included in the five bereavement days. However, prior holidays and inclement weather days falling on Monday through Friday will be included in the five (5) bereavement days. An employee may make a request to June 1the Superintendent for additional days needed for travel purposes or personal business. The Superintendent, teachers who have accumulated between one hundred seventy-one in his or her discretion, may grant up to five (1715) sick additional days. The employee’s personal business days, if any, will be allocated first followed by days and one hundred eighty (180) sick days may donate 10 days towards from the employee’s sick bank.
2. The Court appearance as a witness in any case connected with the teacher’s employment of the school, except a labor dispute where the teacher is a witness adverse to the school district.
3. Approved visitation at other schools or for attending educational conferences or conventions.
K. Any teacher who can anticipate a prolonged disability which would cause the teacher to be absent from work for five (5) consecutive days or more (such as scheduled surgery, other confinement to home or hospital, including maternity) shall notify the business officebuilding principal, in writing, of their intent to donate 10 days to the sick bank. Failure to notify the business office prior to June 1 will result in that teacher not being able to donate to the sick bank for the upcoming year. No mid-year additions will be accepted. A temporary replacement teacher may carry over his accumulated sick days earned from year to year only in the event that said teacher is continued as a regular teacher. Employment must be continuous and must be converted to regular status in order to have any accumulation.
