Common use of Lease or Rental of Equipment by the CAISO Clause in Contracts

Lease or Rental of Equipment by the CAISO. Under certain circumstances, it may be prudent for the CAISO to lease or rent equipment owned by a Participating TO, (e.g., EMS/SCADA, metering, telemetry, and communications systems), instead of installing its own equipment. In such case, the CAISO and the Participating TO shall mutually determine whether the CAISO shall lease or rent the Participating TO’s equipment. The CAISO and the Participating TO shall enter into a written agreement specifying all the terms and conditions governing the lease or rental, including its term, equipment specifications, maintenance, availability, liability, interference mitigation, and payment terms.
