LANDLORD'S RIGHT TO PERFORM TENANT'S COVENANTS. Tenant agrees that, if Tenant shall at any time fail to pay within the grace period herein provided any mechanic’s lien, taxes or other fees and charges the non-payment of which may place in jeopardy Landlord’s interest in the Premises or any portion thereof, or if Tenant shall at any time fail to perform any other act to be made or performed by it under this Lease within the grace period provided therefor, Landlord may, but shall not be obligated to, upon three (3) days’ prior notice to Tenant, make such payment or perform such other act to the extent Landlord may reasonably deem such action necessary for the protection of the Premises, and without waiving or releasing Tenant from any obligation under this Lease. All sums so paid by Landlord and all reasonable expenses paid in connection therewith, including without limitation reasonable attorneys’ fees, together with interest thereon at the Interest Rate from the date of such payment until repaid by Tenant, shall be paid by Tenant to Landlord on demand.

Tenant agrees that, if Tenant shall at any time fail to pay within the grace or notice and cure period herein provided any mechanic’s 's lien, taxes or other fees and charges the non-payment nonpayment of which may place in jeopardy Landlord’s 's interest in the Premises Project or any portion thereof, or if Tenant shall at any time fail to provide the insurance required pursuant to Section 15, or perform any other act to be made or performed by it under this Lease within the grace or notice and cure period provided therefor, Landlord may, but shall not be obligated to, upon three (3) days’ prior notice to Tenant, make such payment or perform such other act to the extent Landlord may reasonably deem such action necessary for the protection of the PremisesPremises or the Project, and without waiving or releasing Tenant from any obligation under this Lease. All sums so paid by Landlord and all reasonable expenses paid in connection therewith, including without limitation reasonable attorneys’ ' fees, together with interest thereon at the Interest Rate from the date of such payment until repaid by Tenant, shall be paid by Tenant to Landlord on within fifteen (15) days of demand.

Section 1: Tenant covenants and agrees that, that if Tenant shall at any time fail to pay within the grace period herein provided make any mechanic’s lien, taxes payment or other fees and charges the non-payment of which may place in jeopardy Landlord’s interest in the Premises or any portion thereof, or if Tenant shall at any time fail to perform any other act on its part to be made or performed by it under this Lease within Lease, the grace Landlord and after ten (10) days written notice to Tenant (or a shorter period provided thereforin the event of an emergency or a different period of time if otherwise specified in this Lease), Landlord may, but shall not be obligated to, upon three (3) days’ prior notice to Tenantand without waiving or releasing Tenant from any obligation of Tenant under this Lease, make such payment or perform such other act to the extent the Landlord may reasonably deem such action necessary for the protection of the Premisesdesirable, and without waiving or releasing Tenant from any obligation under this Leasein connection therewith to pay expenses and employ counsel. All sums so paid by the Landlord and all reasonable expenses paid in connection therewith, including without limitation reasonable attorneys’ fees, together with interest thereon at the Interest Rate from the date of such payment until repaid at the maximum rate per annum allowed by Tenantlaw, shall be paid deemed Additional Rent hereunder and shall be payable to the Landlord within thirty (30) days after payment by Tenant to Landlord on demandLandlord.

All sums so paid by Landlord and all reasonable expenses paid in connection therewith, including without limitation reasonable attorneys’ ' fees, together with interest thereon at the Interest Rate from the date of such payment until repaid by Tenant, shall be paid by Tenant to Landlord on demand.
