Common use of Judicial and Administrative Proceedings Clause in Contracts

Judicial and Administrative Proceedings. In the event that Business Associate receives a subpoena, court or administrative order, or other discovery request or mandate for release of PHI, Business Associate agrees to collaborate with Covered Entity with respect to Business Associate’s response to such request. Business Associate shall notify Covered Entity within seven (7) days of receipt of such request or mandate.

Judicial and Administrative Proceedings. In the event that Business Associate receives a subpoena, court or administrative order, order or other discovery request or mandate for release of PHI, Business Associate agrees to collaborate with the affected Covered Entity with respect shall have the right to control Business Associate’s 's response to such request, provided that, such control does not have an adverse impact on Business Associate’s compliance with existing laws. Business Associate shall notify the Covered Entity of the request as soon as reasonably practicable, but in any event within seven (7) business days of receipt of such request or mandaterequest.

In the event that Business Associate receives a subpoena, court or administrative order, order or other discovery request or mandate for release of PHI, Business Associate agrees to collaborate with shall notify Covered Entity with respect in writing prior to Business Associate’s response responding to such requestrequest to enable Covered Entity to object. Business Associate shall notify Covered Entity of the request as soon as reasonably practicable, but in any event within seven two (72) business days of receipt of such request or mandaterequest.

In the event that Business Associate receives a subpoena, court court, or administrative order, or other discovery request or mandate for release of PHI, other than a standard medical records request/medical records subpoena, Business Associate agrees to collaborate with shall notify Covered Entity with respect of such within five business days by providing a copy of such and any applicable comments. Covered Entity shall have the right to control Business Associate’s response to such request. Business Associate shall notify Covered Entity within seven (7) days of receipt of such request or mandate.

Business Associate shall notify Covered Entity of the request or mandate as soon as reasonably practicable, but in any event within seven five (75) days of receipt of such request or mandate and prior to responding to any such request or mandate.
