Intentional or Negligent Acts. Notwithstanding anything to the contrary in this Agreement, but subject to Section 10, each party hereto shall be solely responsible for the repair of any and all damage to the Trails caused by any intentional or negligent act or omission of its subtenants, agents, employees, business invitees and licensees.
