Installation and Construction. 10.0 Installation, construction and/or modification of permanent theater systems shall be compensated for at a rate of thirty ($30.00). Such systems shall include but not be limited to original installation, construction and/or modification of: acoustic shells; rigging systems; sound systems including public address and headset systems; projection and video systems; lighting systems; stage floors and decks; soft goods; electrical components and control boards and repair of same. This rate for these projects can not be used on an "In, Show, or Out" of an attraction.
Installation and Construction. All work permitted pursuant to this Agreement to be performed on the Land or in the Building shall be performed by Licensee or its Approved Contractors (defined below), at Licensee's sole cost and expense and in accordance with plans approved by Licensor in accordance with this Agreement. The term "Approved Contractors" shall mean any contractor listed on Exhibit Q annexed hereto or any other contractor approved by Licensor, such approval not to be unreasonably withheld or delayed. All installations by Licensee shall be made in compliance with applicable law. Prior to installing any Telecommunications Facilities, Licensee shall submit detailed plans and specifications of the planned installation to Licensor, for Licensor's approval, which approval shall not be unreasonably withheld or delayed. Licensor shall respond to Licensee's proposed plans within ton (10) business days after receipt with either approval or the changes required for Licensor's approval. Licensor shall cooperate with Licensee, at no cost to Licensor, in obtaining third party permits, easements or agreements necessary for Licensee to exercise its rights hereunder. During construction, Licensor shall permit Licensee to place a 40-yard rubbish container on the Land near the freight elevator or loading dock. 6.
Installation and Construction. The Company will cause the Facility to be installed and constructed substantially in accordance with the plans and specifications and wholly within the boundary lines of the Project Premises and will provide all other improvements, access roads, utilities, equipment, furnishing parking facilities, and other items required for a facility fully operable for use as a Manufacturing Facility.

  • Design and Construction In complying with the requirements of the specification both with respect to arrangement and detail, design is to conform to the best current engineering practice. Each of the several parts of the material is to be of the maker’s standard design provided that this design is in general accordance with the specification. The essence of design should be simplicity and reliability in order to give long continuous service with high economy and low maintenance cost. Particular attention should be paid to internal and external access in order to facilitate inspection, cleaning and maintenance. The design dimensions and materials of all parts are to be such that they will not suffer damage as a result of stresses under the most severe conditions. Fully detailed specifications of the several parts of the material are to be submitted describing particularly the materials to be used. The materials used in the construction of the material are to be of the highest quality and selected particularly to meet the duties required of them. Mechanisms are to be constructed to avoid sticking due to rust or corrosion. Workmanship and general finish are to be of the highest class throughout. All similar parts of the material are to be interchangeable. All equipment is to operate without undue vibration and with the least possible amount of noise and is not to cause a nuisance. All equipment is to be designed to minimize the risk of fire and any damage, which may be caused in the event of fire. The equipment is also to be designed to prevent ingress of all vermin, accidental contact with live parts and to minimize the ingress of dust and dirt. The use of materials, which may be liable to attack by termites or other insects, is to be avoided.

  • Law; Construction This Agreement and any claim, counterclaim or dispute of any kind or nature whatsoever arising out of or in any way relating to this Agreement (“Claim”), directly or indirectly, shall be governed by, and construed in accordance with, the internal laws of the State of New York.

  • Routine Maintenance, Construction, and Repair The NYISO or Connecting Transmission Owner may interrupt interconnection service or curtail the output of the Small Generating Facility and temporarily disconnect the Small Generating Facility from the New York State Transmission System or Distribution System when necessary for routine maintenance, construction, and repairs on the New York State Transmission System or Distribution System. The NYISO or the Connecting Transmission Owner shall provide the Interconnection Customer with five Business Days notice prior to such interruption. The NYISO and Connecting Transmission Owner shall use Reasonable Efforts to coordinate such reduction or temporary disconnection with the Interconnection Customer.

  • ICIF Construction The ICIF shall be designed and constructed in accordance with Good Utility Practice. Within one hundred twenty (120) Calendar Days after the Commercial Operation Date, unless the Parties agree on another mutually acceptable deadline, Interconnection Customer shall deliver to Transmission Provider and Transmission Owner “as-built” drawings, information and documents for the ICIF, such as: a one-line diagram, a site plan showing the Generating Facility and the ICIF, plan and elevation drawings showing the layout of the ICIF, a relay functional diagram, relaying AC and DC schematic wiring diagrams and relay settings for all facilities associated with the Interconnection Customer’s step-up transformers, the facilities connecting the Generating Facility to the step-up transformers and the ICIF, and the impedances (determined by factory tests) for the associated step-up transformers and the Generating Facility. Interconnection Customer shall provide Transmission Provider and Transmission Owner with Interconnection Customer’s specifications for the excitation system, automatic voltage regulator, Generating Facility control and protection settings, transformer tap settings, and communications, if applicable.

  • Interconnection Facilities Engineering Procurement and Construction Interconnection Facilities, Network Upgrades, and Distribution Upgrades shall be studied, designed, and constructed pursuant to Good Utility Practice. Such studies, design and construction shall be based on the assumed accuracy and completeness of all technical information received by the Participating TO and the CAISO from the Interconnection Customer associated with interconnecting the Large Generating Facility.

  • Contract Construction 6.27.1 The parties acknowledge that each party and its counsel have reviewed this CONTRACT and that the normal rule of construction to the effect that any ambiguities are to be resolved against the drafting party shall not be employed in the interpretation of this CONTRACT or any amendment or exhibits hereto.

  • Commencement and Completion of Construction The Company shall begin Construction Activities no later than January 1, 2014 (“Commencement Date”) and secure a final Certificate of Compliance by August 27, 2015 (hereinafter, “Completion Date”).
